Special Council Meeting
May 23, 1988

Mayor Turner called the meeting to order in the Council Chamber of City
Hall at 4:08 p.m.
Assistant City Secretary Zahn called the roll and verified that the
necessary quorum of the Council and the required charter officers were present
to conduct the meeting.
The Council went into closed session pursuant to Article 6252-17, Section
2(e), V.A.C.S., to discuss pending litigation.

Mayor Turner reconvened the Special Council Meeting at 5:38 p.m.
A motion was made by Council Member Rhodes to authorize the City Manager to
enter into an agreement to resolve: Cause No. 957-3, City of Corpus Christi v.
Helen A. Royal, et al, Cause No. 966-4, City of Corpus Christi v. Helen A.
Royal, et al, Cause No. 88-2020-F, and Helen A. Royal and Breakwater Corporation
vs. City of Corpus Christi and Texas State Aquarium Association with the
understanding that the parties involved sign the proposed agreement by 8:00
p.m., May 23, 1988. The motion was seconded by Council Member Schwing and
passed by the following vote: Turner, Moss, Rhodes, Schwing voting "Aye";
Guerrero voting, "No."
There being no further business to come before the Council, the Mayor
adjourned the Special Council Meeting at 5:40 p.m. on May 23, 1988.

Article 6252-17, V.A.C.S., of the following agenda of the City
considered at the above special council meeting:

D. To take the following action as necessary for the negotiation; resolution,
or support of the above pending litigation:
Approval of the following Motion:
That the City Manager be authorized to settle
966-4, and Cause No. 88-2020-F in accordance

Approval of the following Ordinance:
Authorized the City Manager to enter into a lease of certain described
property with Helen A. Royal and Breakwater Corporation for a period not to
exceed six (6) months; and declaring an emergency.
An urgent public necessity exists to discuss these matters due to pending
settlement negotiations, offer deadlines, and the necessity to take such action
as necessary for the negotiation, resolution, or support of the above pending
litigation, if any, prior to the scheduled hearing before the Special
Commissioners in Cause No. 966-4, which is scheduled for May 24, 1988, at 9:00
a.m., which creates an emergency and imperative public necessity to call a
Special Council meeting. The opportunity for timely resolution of this
litigation prior to Court deadlines creates an emergency situation and will save
the City money and time and enable the Texas State Aquarium project to proceed
without delay.
