HomeMy WebLinkAbout11841 ORD - 12/19/1973• aRR:jk3i:hb:12 /19/73:1st AN ORDINANCE AMENDING SECTION 21 -30 OF THE CORPUS CHRISTI CITY CODE, AS AMENDED, PROVIDING FOR TRAFFIC SAFETY ADVISORY BOARD, SO AS TO ADD TO SUB- SECTION 30.1, EX- OFFICIO MEMBERS, THE TRAFFIC SAFETY COORDINATOR; ADDING TO SUBSECTION 30.3 OFFICERS THE TRAFFIC SAFETY COORDINATOR IN LIEU OF THE DIRECTOR OF TRAFFIC ENGINEERING: AMENDING SECTION 21- 31,PURPOSE AND DUTIES OF THE BOARD, ITEM (e) SO AS TO PROVIDE FOR FOSTERING PUBLIC KNOWLEDGE AND SUPPORT OF TRAFFIC LAW ENFORCEMENT AND UNDERSTANDING OF CITY TRAFFIC SAFETY PROBLEMS; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 21 -30 of the Corpus Christi City Code, as amended, providing for Traffic Safety Advisory Board, be and the same is hereby amended by adding to Sub- section 30.1, Ex- Officio Members, following the word "represen- tative" and before the words "and the Director of Traffic Engineering" the words "together with the Traffic Safety Coordinator ", said Subsection 30.1 to hereafter read as follows: "30.1 Ex- Officio Members. The City Manager, and, at his option, his designated representative, together with the Traffic Safety Coordinator and the Director of Traffic Engineering shall serve as ex- officio members without vote. The board is hereby authorized to appoint as ex- officio members without voting privileges any additional members. The presence of any ex- officio members shall never be con- sidered in determining a quorum for the transaction of board business." SECTION 2. That Section 21 -30 of the Corpus Christi City Code, as amended, be and the same is hereby amended by adding to Subsection 30.3, Officers, the words "Traffic Safety Coordinator or such other person as the City 11841 -0 • Manager may designate" in lieu of "Director of Traffic Engineering" in the second sentence of said Subsection, and the words "Traffic Safety Coordinator ", in lieu of "Director of Traffic Engineering ", said Subsection 30.3 to hereafter read as follows: "30.3 Officers. Following the annual appointment of three (3) new members, the board shall meet at its earliest convenience and shall, by majority vote, elect a chairman who shall preside at all meetings of the board and a vice chairman who shall preside in the absence of the chairman. The Traffic Safety Coordinator, or such other person as the City Manager may designate, shall act as the secretary of the board and shall send all notices for the meetings of the board, keep and preserve the minutes, have custody and keep all documents and papers filed with the board, advise and consult with City officials as to the board's work and recommendations, assist the board and its committees in planning and coordinating its programs, maintain liaison with organized community groups and others effectively situated to carry forward all plans and policies of the board and all traffic accident prevention activities which may be approved by the board, and perform such other duties as may be of assistance to said board, consistent with the primary obligations of the Traffic Safety Coordinator to City management." SECTION 3. That Section 21 -30 of the Corpus Christi City Code, as amended, be and the same is hereby amended by amending Item (e) of Subsection 31 -31, Purpose and Duties of the Board, said Item (e) to hereafter read as follows: "(e) Fostering public knowledge and support of traffic law enforcement and understanding of City 'traffic safety problems." SECTION 4. That all ordinances or parts of ordinances in conflict herewith be and they are hereby repealed to the -2- extent of such conflict. SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect. SECTION 6. The necessity to promptly make the hereinabove described amendments to the ordinance providing for a Traffic Safety Advisory Board of the City of Corpus. Christi, its organization, purpose, and duties, creates a public emer- gency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspen- sion of the said Charter rule and that this ordinance be passed finally on the date of its introduction and that such ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of December, 1973.
