HomeMy WebLinkAbout12178 ORD - 07/17/1974&kh:hb:7 /16/74:lst AN ORDINANCE AUTHORIZING ACCEPTANCE OF THE PROPOSAL OF THE TEXAS MEXICAN RAILWAY COMPANY FOR THE INSTALL- ATION OF A RAILROAD CROSSING SAFETY DEVICE ON THE N.A.S. RAILROAD TRACK AT THE INTERSECTION OF EVERHART ROAD AND HOLLY ROAD, ALL AS MORE FULLY SET FORTH IN THE PROPOSAL, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING OUT OF THE NO. 220 STREET BOND FUND $4,500 FOR THE ESTIMATED COST OF INSTALLATION OF THE RAILROAD CROSSING SAFETY DEVICE, APPLICABLE TO PROJECT NO. 220 -72 -13.1; AND DECLARING AN EMERGENCY. • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to accept the proposal of the Texas Mexican Railway Company for the in- stallation of a railroad crossing safety device on the N. A. S. railroad track at the intersection of Everhart Road and Holly Road, all as more fully set forth in the proposal, a copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. There is hereby appropriated out of the No. 220 Street Bond Fund the sum of $4,500 for the estimated cost of installation of the railroad crossing safety device above described, applicable to Project No. 220 -72 -13.1. SECTION 3. The necessity to authorize acceptance of the pro- posal and to appropriate the necessary funds for the installation of the aforesaid railroad crossing safety device creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the 1 day of July, 1974. Box 9277 Corpus Christi, Texas 78408 Dear Mr. Stewart: Q,,t�� P. fn_ Q • This is to confirm our telephone conversation March 25, 1974, concerning the installation of track circuit for connection to your traffic signals at Everhart and Holly Roads. The Texas Mexican Railway Company will furnish labor and all material to install the track circuit, including insulated joints, instrument case, track rectifiers, interlocking relays, track transformer, meter loop, and all wiring to enable City to connect traffic signals to the track circuit for the purpose of pre - empting normal traffic timing, to warn of approaching train traffic. It is estimated that this installation can be installed at a cost to the City of $4,500.00. This cost can be held firm through June, 1974, provided authority to order material is issued by this date. Please allow seven to nine month lead time to obtain material and installation. I hope this is the information you need to progress this project. I I I " ; / 0 Corpus Christi, Texas day of- , 19 -ZiZ- TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
