HomeMy WebLinkAbout12579 ORD - 04/02/1975MLM:lkh:hb:3 /31/75:1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED CONTRACT WITH NUECES COUNTY MENTAL HEALTH AND MENTAL RETARDATION COMMUNITY CENTER, IN SUBSTANTIALLY THE FORM ATTACHED HERETO, MARKED EXHIBIT "A ", AND MADE A PART HEREOF; REAPPROPRIATING $48,885 FROM THE GENERAL RESERVE FUND TO PROVIDE FUNDS TO COVER ONE - HALF OF THE EXISTING DEFICIT OF THE SAID NUECES COUNTY MENTAL HEALTH AND MENTAL RETARDATION COMMUN- ITY CENTER AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That the City Manager be and he is hereby authorized to execute an amendment to the contract authorized by Ordinance No. 12245, passed and approved by the City Council on August 28, 1974, authorizing execution of a contract with Nueces County Mental Health and Mental Retardation Community Center, in substantially the form attached hereto, marked Exhibit "A" and made a part hereof. SECTION 2. There is hereby reappropriated from the General Reserve Fund the sum of $48,885 to provide funds to cover one -half of the existing deficit of the said Nueces County Mental Health and Mental Retardation Community Center. SECTION 3. The necessity to authorize execution of the afore- said contract and to provide the sums hereby reappropriated at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the day of April, 1975. ATTEST: C 4tecret—ar y MAYO APPROVED: THE CITY OF CORPUS CHRISTI, TEXAS DAY OF APRIL, 1975: (uC., C ty Attorney 12579 MLM:jkh :hb:3 /31/75 AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES X • WHEREAS, the City of Corpus Christi and the Nueces County Mental Health and Mental Retardation Community Center entered into a joint agreement for the purpose of establishing and administering mental health, mental retardation, alcoholism and drug abuse services in Nueces County for the benefit of the citizens of the City of Corpus Christi as well as Nueces County; and WHEREAS, it has been determined that it would be advantageous to amend the aforesaid agreement: NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That the City of Corpus Christi, Texas, a municipal corporation and body politic, operating under the home rule statutes of the State of Texas, hereinafter called "City ", and Nueces County Mental Health and Mental Retardation Community Center, hereinafter called "The Center ", agree as follows: That Section II be amended to hereafter read as follows: II This agreement is effective August 1, 1974, and shall be reviewed annually and is subject to termination by either party with thirty days written notice. The City agrees to pay from its budgeted resources $4,166.66 per month for the continued rendition of the services described herein. The balance of the current amount budgeted by the City for the said services, now being paid in monthly installments, may be paid in one lump sum. Should City make such lump sum payment, • City's liability under this contract shall be considered discharged. City agrees to pay The Center an additional amount of $48,885, said sum representing one -half of the existing deficit of The Center. City shall be reimbursed up to one -half of said amount in the event the `;4 • Corpus Christi Independent School District and /or Del Mar College District agree to underwrite all or part of their respective portions of the deficit. Except as herein and hereby amended, the terms and conditions of the agreement heretofore entered into by the parties hereto shall be and remain in full force and effect. 1975.
