HomeMy WebLinkAbout12776 ORD - 08/27/1975JKH:VMR:8- 26- 75;IST AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER: (1) TO SUBMIT AN ADMINISTRATIVE GRANT CONTRACT FOR THE CITY OF CORPUS CHRISTI, AS THE ADMINISTRATIVE UNIT OF THE COASTAL BEND MANPOWER CONSORTIUM, TO THE GOVERNOR'S OFFICE OF MIGRANT AFFAIRS IN THE AMOUNT OF $1,958.00, AND (2) TO EXTEND THE GRANT CONTRACT UPON TERMINATION ON AUGUST 31, 1975, AND UPON MUTUAL AGREEMENT BETWEEN THE GOVERNOR'S OFFICE Olf MIGRANT AFFAIRS AND THE ADMINISTRATIVE UNIT FOR THE PERIOD OF SEPTEMBER 1, 1975 TO APRIL 111, 1976, ALL AS MORE FULLY OUTLINED AND SET FORTH IN THE GRANT CONTRACT, IN SUBSTANTIALLY THE FORM ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL RELATED AND NECESSARY DOCUMENTS IN THE IMPLEMENTATION AND ADMIN- ISTRATION OF THE AFORESAID PROJECT; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THE NECESSITY TO AUTHORIZE THE CITY MANAGER TO SUBMIT THE AFORESAAD GRANT CONTRACT AND EXECUTE THE NECESSARY DOCUMENTS IN THE IM- PLEMENTATION AND ADMINISTRATION OF THE SAID PROJECT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH 1-2776' EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS cr- THE per/ DAY OF AUGUST, 1975• ATTEST: 1 011 CRETARY• MAYOR THE CITY OF CORPUS CHRISTI, TEXAS DAY OF AUGUST, 1975= 79 �, CITY ATTO GOVERNOR'S OFFICE OF MIGRAIIT•AFFAIRS Administrative Grant STATE OF TEXAS j COUNTY OF TRAVIS Z This grant entered into as of ' April 15, 1975 shall govern certain activities of the Governor's Office of Migrant Affairs Migrant Population Study financed under a prime grant from the State Manpower Services Council (SMSC) during the period April 15, 1975 to August 31 , 1976, which are to be carried out by Ql of or Vs Christi Texas .hereinafter referred to as the "Grantee" on a al OT t e Governor's Office of Migrant Affairs, hereinafter referred to as the "Grantor ". I. GRANT CONDITIONS A. The Grantee promises and agrees to comply with the following special conditions. 1. Assign appropriate Grantee personnel to perform duties as an Outreach Worker in performance of the Migrant Population Study. 2. Technical assistance for Grantee personnel assigned specific duties in performance of the Migrant-Population Study shall be provided by Grantor and /or its authorized representative. 3. Expenses for which Grantor will support Grantee personnel • assigned specific duties in performance of the Migrant Population Study are so set forth in Section.JV of this Grant contract. 4. Upon termination of this grant contract on August 31, 1975 and upon mutual agreement between Grantor and Grantee in writing this grant contract may be extended upon approval by the Coastal Bend Manpower Consortium of the City of Corpus Christi to be valid and effective for the period September 1, 1975 to April 14,_1976. Contingent upon acceptance by Grantee of the extension as provided for herein (Section I, Para. A; sub -para 4, this grant contract) an additional obligation for $3,264.75 would be contracted for by means.of an addendum to this grant contract heretofore. The Grantee shall in a satisfactory manner as determined by the Grantor, comply with the special conditions listed above for the Grantor as approved in the SMSC grant to the Grantor. B. All activities authorized by this grant will be performed in accordance with the approved SMSC grant, the approved budget, grant conditions herein, and relevant SMSC /COMA directives. II. BUDGET SPENDING'LIMITATIONS A. Deviations from budget must bec approved by Grantor in writing. B. 'Total amount of budget herein obligated by Grantor to Grantee shall not exceed $1,958.00 III. CHANGES Any changes to this grant must be in writing and mutually agreed to by Grantor and Grantee. IV. PAYMENT A. Grantee shall be advanced a sum of 652.00 which represents a 45 day operating cash fund. B. Thereafter all payments to Grantee shall be on a cost - reimbursement basis. Allowable costs under this contract shall be limited exclusively to the following budget item- and budget amount:: Budget Items Budget Amounts 1. Travel ..... ......................S1.95A.o0 C. Grantee for initial advance shall submit a STATE OF TEXAS Purchase Voucher certified by appropriate Grantee Official. D. Grantee for all subsequent advances on a cost - reimbursement basis will submit a STATE OF TEXAS Purchase Voucher certified by appropriate Grantee Official. Attached with the certified voucher will be a "Status of SMSC /COMA Cash Transactions Report ". This fiscal report shall be submitted to the Grantor on or before the fift;i working day following the month for which the costs were incurred within. The "Total" administrative expenditures as reflected within the "Status of SMSC /GOMA Cash Transactions Report" shall be the amount of cash to be advanced on a cost - reimbursement basis. Upon receipt by Grantor of a certified voucher and originally signed "Status of SMSC /GOMA Cash Transaction Report" from Grantee,.Grantor shall review for approval. If approved, payment shall be made to Grantee by a STATE OF TEXAS Treasury Warrant. V. GRANT EXTENDING BEYOND ENDING DATE OF PRIME GRANT The period of this grant may be extended only by written agree- ment of both parties hereto with prior_approval._from SMSC._ VI. SUSPENSION AND TERMINATION The Grantor may in accordance with published regulations suspend or terminate this grant in whole or part for cause, which shall include: 1. Failure or willingness of the Grantee to comply with activities herein agreed to,with applicable statutes and Executive Orders, or with such SMSC /GOMA directives as-may become applicable at any time. 2. Submission by the Grantee to the Grantor reports which are incorrect or incomplete in any material respect. 3. Ineffective or improper use of Federal funds by the Grantee. 4. Making any change which significantly impairs the re- presentative character of the Grantee's policy making body or the Grantee's capacity to enlist community support. Page 3 of 4 s 5. Failure of the Grantee either to adequately monitor program activities delegated to other agencies or to .provide effective guidance to such agencies in carrying out the purpose and activities of the portions of the approved program delegated to them. In the event that the Grantee fails to comply with the above conditions the Grantee may be suspended or terminated in whole or part by Graptor. In;such event, part of the grant funds and the Grantee functions, obligations, records (or copies)lauthority and property relating to assistance provided the Grantee under this funding shall be trans- ferred by Grantor to another agency able to provide such services. No suspension or termination will affect any expenditure or legally binding commitments made prior to receiving notice of suspension or termination, provided such expenditures or commitments were made in good faith and not in anticipation of termination and are other- wise allowable. Funds shall not be treated as commited for this purpose solely by virture of a Grantee contract commitment to a delegate agency. Upon suspension or other termination,,the disposition of unexpended Federal funds and property purchased with program funds will be subject to Grantor direction. VII. DISCRIMINATION No person in the United States shall on the ground of race, color, religion, creed, national origin, sex and age be subject to discrimination under the program approved as a result of this contract funding. The Grantee shall comply with Executive Order 11246, as supplemented by Department of Labor (DOL) regulations in 41 CFR,. Part 60. . - VIII. AUDIT AND RECORDS A. Grantee hereby agrees to allow U. S. Comptroller General or authorized representative or Grantor aca.:ss to books, documents, papers, and records of Grantee that are relevant to this grant. B. 'Grantee further allows audit, examination, excerpts, and transcriptions of above records by U. S. Comptroller General or authorized representative -or Grantor. C. Grantee further agrees that all records, relevant to this contract, shall be retained for a' minimum of (3) three years. IX. COMPLIANCE WITH LOCAL LAWS The Grantee shall comply with all applicable laws, ordinances, and codes of the State and Local governments. X. OTHER CONTROLLING TERMS The Grantee will not assert any rights at common law or in equity or establish any claim to statutory copyright in any materials or information developed under this grant, but the Grantor shall have the right to use, reproduce, or publish any or all of such information and other materials without the necessity of obtaining any permission from Grantee without expense or charge. It is expressly understood and agreed by the parties hereto that all performances on the part of the Grantor are contingent upon and subject to actual receipt by the Grantor of sufficient and adequate funds and /or other consideration from the sources contemplated by this grant outside the Grantor to fully perform the obligations and duties of the Grantor as specified by this grant.
