AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT WITH THE COASTAL BEND COUNCIL OF
GOVERNMENTS FOR THE ACQUISITION OF RADIO
EQUIPMENT AND COMUNICATIONS TOWERS, AND
THE HIRING OF A CONSULTANT TO PREPARE PLANS
AND SPECIFICATIONS AND SUPERVISE THE INSTAL-
LATION OF THE SYSTEM, ALL AS MORE FULLY SET
FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF, MARRED EXHIBIT "A "; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1, That the City Manager be and he is hereby authorized
to execute an agreement with the Coastal Bend Council of Governments for
the acquisition of radio equipment and communications towers, and the
hiring of a consultant to prepare plans and specifications and supervise
the installation of the system, all as more fully set forth in the
contract, a substantial copy of which is attached hereto and made a part
hereof, marked Exhibit "A ".
SECTION 2. The necessity to authorize the execution of the
aforesaid contract at the earliest practicable date creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor, having
declared such emergency and necessity to exist, having requested the
suspension of the Charter rule and that this ordinance take effect and be

THIS AGREEMENT being between the Coastal Bend Council of
Governments, hereinafter known as C.B.C.O.G., and the City of Corpus
Christi, Texas,

Pursuant to the agreement with the Criminal Justice Division
of the Governor's Office that the Coastal Bend Council of Governments would
be the recipient of a grant from the Criminal Justice Division to be used
for the purchase of radio equipment to be used by Coastal Bend Criminal
Justice Agencies, the City of Corpus Christi by Ordinance 412750, adopted
August 13, 1975, agrees to participate in the aforementioned grant, by
depositing with C.B.C.O.G. the sum of Thirty -Four Thousand Five Hundred
Dollars ($34,500) which will allow the City of Corpus Christi to receive
One Hundred Three Thousand Five Hundred Dollars ($103,500) in Criminal
Justice funds to be used for the purchase of additional radio equipment
for the Police Department, said ordinance lists what equipment will be
purchased for the specified sum allowed.

The C.B.C.O.G. will contract with North Central Council of
Governments, hereinafter known as N.C.T.C.O.G., for the purchase of radio
equipment offered to N.C.T.C.O.G. on a bid for that area, the low bidder
on N.C.T.C.O.G. being General Electric and their contractors.
The Coastal Bend Council of Governments will contract with the
successful low bidder to install two 100 -foot communication towers with
85 pounds wind loading. The Council of Governments is authorized to hire
a consultant who is qualified to prepare plans and specifications and to
supervise the installation of the communications equipment.

That C.B.C.O.G. as recipient of the grant will issue all
purchase orders for the purchase and installation of the radio equipment
as requested by the C.B.C.O.G. Area Criminal Justice Agencies who will be
participating.

That C.B.C.O.G. will not approve payment of any bills to the
bidder or N.C.T.C.O.G. until the agency receiving the equipment certifies
that the equipment is installed and operating according to manufacturer's
specifications and warranties.
V
In the event the full amount of money on deposit is not spent
by the specified date in the grant, the City of Corpus Christi will be
reimbursed its prorata share of the unspent money.

Upon completion of the installation and checkout of said equip-
ment and certification of satisfactory completion by the City of Corpus
Christi, said equipment shall become the property of the City of Corpus
Christi, and will be maintained in operating condition for the We of
the equipment.
VII
C.B.C.O.G. will be entitled to any interest earned on deposits
made by the City of Corpus Christi under this agreement.
