AN ORDINANCE
AMENDING ORDINANCE NO. 12808, PASSED AND APPROVED
BY THE CITY COUNCIL ON SEPTEMBER 24, 1975, AS AMENDED
BY ORDINANCE NO. 12848, CAPTIONED AS FOLLOWS: "APPROV-
ING AND ADOPTING THE WRITTEN STATEMENT AND REPORT OF
THE DIRECTOR OF ENGINEERING AND PHYSICAL DEVELOPMENT
SHOWING ESTIMATES OF VARIOUS COSTS FOR THE IMPROVEMENT
OF:
1. Molina Drive, from the north right -of -way line of
West Point Road to the south right -of -way line of
Horne Road;
2. Barrera Drive, from the north right -of -way line of
West Point Road to the south right -of -way line of
Bloomington Street;
3. Angela Drive, from the north right -of -way line of
West Point Road to the south right -of -way line of
Bloomington Street; and
4. Villareal Drive, from the west right -of -way line of
Elvira Drive to approximately 175 feet west of Molina
Drive to connect with the existing improvements in
the City of Corpus Christi, Nueces County, Texas,
DETERMINING AND FIXING THE PORTION OF SAID COST TO BE
PAID BY THE CITY OF CORPUS CHRISTI; DE'T'ERMINING THE
NECESSITY OF LEVYING AN ASSESSMENT AGAINST SAID ABUTTING
PROPERTY; ORDERING AND SETTING A HEARING TO BE HELD ON
WEDNESDAY, OCTOBER 29, 1975, AT 7:00 P.M., IN SKINNER
ELEMENTARY SCHOOL, TO GIVE NOTICE OF SAID HEARING AS
REQUIRED BY THE LAWS OF THE STATE OF TEXAS AND THE
CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN
EMERGENCY." SO AS TO RESCHEDULE THE SAID PUBLIC HEARING
FOR 7:00 P.M., Wednesday, November 26, 1975,
AT SKINNER ELEMENTARY SCHOOL; KEEPING IN EFFECT ALL
OTHER PROVISIONS OF THE SAID ORDINANCE NO. 12808; AND
DECLARING AN EMERGENCY.
WHEREAS, heretofore, on the 24th day of September, 1975, the City
Council by the enactment of Ordinance No. 12808 determined that it was
necessary to improve the following streets by paving:
1. Molina Drive, from the north right -of -way line of West
Point Road to the south right -of -way line of Horne Road;
2. Barrera Drive, from the north right -of -way line of West
Point Road to the south right -of -way line of Bloomington
Street;
3. Angela Drive, from the north right -of -way line of West
Point Road to the south right -of -way line of Bloomington
Street; and
4. Villareal Drive, from the west right -of -way line of Elvira
Drive to approximately 175 feet west of Molina Drive to
connect with the existing improvements in the City of
Corpus Christi, Nueces County, Texas;
and adopted the written statement and report of the Director of Engineering
and Physical Development, showing estimates of various costs for the improve-
ment of the aforesaid streets; and
WHEREAS, in accordance with the laws of the State of Texas and
the Charter of the City of Corpus Christi, a public hearing was set for
Wednesday, October 29, 1975, at 7:00 P.M., for the purpose of hearing
owners of abutting property, and of railways and of street railways, if
any, or their agents or attorneys, and all persons interested in said matter,
as to the amount to be assessed against each owner and his abutting property
and railways and street railways, and as to the benefits to said property
by reason of said improvements, or any other matter or thing in connection
therewith, and the City Secretary was directed to give notice of the -time
and place of such hearing and of other matters and facts in accordance
with the terms and provisions of the Act passed at the First Called Session
of the Fortieth Legislature of the State of Texas, known as Chapter 106
of the Acts of said Session, together with any amendments thereto, now
shown as Article 1105b of Vernon's Texas Civil Statutes; and
WHEREAS, the members of the City Council desire to reschedule
the said public hearing:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 12808, passed and approved by the
City Council on September 24, 1975, as amended by Ordinance No. 12848,
passed by the City Council on October 8, 1975, concerning approval and
adoption of the written statement and report of the Director of Engineering
and Physical Development showing estimates of various costs for the improve-
ment of the following streets:
1. Molina Drive, from the north right -of -way line of West
Point Road to the south right -of -way line of Horne Road;
2. Barrera Drive, from the north right -of -way line of West
Point Road to the south right -of -way line of Bloomington
Street;
3. Angela Drive, from the north right -of -way line of West
Point Road to the south right -of -way line of Bloomington
Street; and
4. Villareal Drive, from the west right-of -way line of Elvira
Drive to approximately 175 feet west of Molina Drive to
connect with the existing improvements in the City of
Corpus Christi, Nueces County, Texas,
fixing the portion of said costs to be paid by the City of Corpus Christi
and the owners of abutting property, and setting a public hearing, be and
the same is hereby amended by rescheduling the said public hearing for
Wednesday, November 26, 1975, at 7:00 P.M., at Skinner Elementary School,
in the City of Corpus Christi, Nueces County, Texas.

SECTION 2. That except as hereby amended, the terms, conditions
and provisions of Ordinance No. 12808 shall be and remain in full force and
effect.
SECTION 3. The necessity to immediately adopt the provisions
hereof in order that the orderly and proper proceedings may be conducted
for the improvement of the aforesaid streets, within the limits set forth,
creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall
he passed finally on the date of its introduction and that such ordinance or ,
resolution shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist, having
requested the suspension of said Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this thee2f day of October, 1975.

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
