AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO CONVEY TO QUINTANA-
HOWELL JOINT VENTURE PARCELS 4, 5, 6 AND 7 FROM THE
COUNTY - NAVIGATION DISTRICT -CITY JOINT BRIDGE RELOCA-
TION PROJECT, UPON PAYMENT OF THE CASH CONSIDERATION
OF $44,130; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to convey, on behalf of the City of Corpus Christi, the following described

property to Quintana - Howell Joint Venture, upon payment of the cash considera-
tion of $44,130:
PARCEL FOUR
0.279 acres of land out of a 0.754 acre tract conveyed to the City of Corpus
Christi by deed from Earl C. Dann and Helen Priour Dunn dated November 9, 1959,
recorded Volume 872, Page 371, Deed Records, Nueces County', Texas, lying I dia-
tely north of Up River Road, between Navigation Boulevard and McBride Lane in
Nueces County, Texas. Said 0.754 acre tract fronts on the north right -of -way line
of Up River Road 121.2 feet. This 0.279 acre tract four is more particularly
described as follows:
Beginning at a point in the north right -of -way line of Up River Road which point
lies N. 78019150 "W., a distance of 26.19 feet along said north right -of -way
line of Up River Road from the centerline of the Savage Lane Railroad Track for
the southeast corner of this tract?
Thence N. 78019150 "W., a distance of 57.95 feet along said right -of -way line of
Up River Road to a point which is the most westerly corner of the 1.172 acre Earl
C. Dunn Tract, of the 0.754 acre right -of -way tract and of this tract;

Thence N.11 40110 "E., a distance of 11.00 feet along the west line of the 0.754
acre right -of -way tract to the point of curvature of a right curve;
Thence along a right curve with radius of 249.24 feet, central angle of 28010150 ",
tangent length of 62.56 feet a distance of 122.59 feet to the end of said curve,
said curve being also in the vast line of the 0.754 acre right -of -way tract;
Thence N. 390511E., a distance of 141.01 feet to a point on a right curve whose
tangent at that point bears S. 10004125 "W., said point being the most northerly
corner of this tract;
Thence along the right curve with radius of 612.27 feet, central angle of 11001`36"
tangent length of 59.10 feet, an arc distance of 117.83 feet to the end of said
curve, which curve lies approximately 25 feet from the centerline of the Southern
Pacific Railroad track connecting the Savage Lane Railroad Track with the Missouri
Pacific Railroad Main Line Track in the southwest quadrant;
Thence S. 21006101 "W., a distance of 42.00 feet parallel to, and approximately
25 feet from the centerline of said Southern Pacific Railroad Track, to a point;
Thence S. 25032141 "W., a distance of 97.03 feet to the point of beginning, contain-
ing 0.279 acres of land, more or less.

PARCEL FIVE
0.416 acres of land out of a 16.086 acre tract conveyed
to the City of Corpus Christi by J. R. Heldenfels, Trustee,
by deed dated March 4, 1960, recorded in Volume 855, page
144, Deed Records, Nueces County, Texas, all being out of
a 171.01 acre Heldenfels Tract immediately south of UpRiver
Road between Dunn Lane and McBride Lane, and located in
Nueces County, Texas. Said 16.086 acre tract fronts on
the south right- of-way line of UpRiver Road 105.6 feet.
This 0.416 acre Tract Five is more particularly described
as follows:
Beginning at a point in the south right -of -way line of
UpRiver Road, 186.45 feet N. 77° 07' W. along said south
right -of -way line of UpRiver Road from the centerline
of the Savage Lane Railroad Track, said point being the
northwesterly corner of the 16.086 acre tract and of this
tract, and the northeasterly corner of the C. C. Refining
Company 3 -acre tract;
Thence S. 77° 07' E., a distance of 105.60 feet along the
south right- of-way line of UpRiver Road to a point, which
point is the northeasterly corner of the 16.086 acre tract
and of this tract, and the northwesterly corner of Dunn
Addition;
Thence S. 5° 53' E., a distance of 92.34 feet along the
east line of the 16.086 acre tract and the west line of
Dunn Addition to a point for the most easterly corner
of this tract;
Thence S. 28" 55' 20" W., a distance of 175.17 feet along
an extension of a line parallel to, and 25 feet west of
the centerline of the Savage Lane Railroad Track as it
crosses UpRiver Road to a point in the west line of the
16.086 acre tract for the southerly corner of this tract;
Thence N. 5° 53' W., a distance of 270.14 feet along the
west line of the 16.086 acre tract and the east line of
the C. C. Refining Company 3 acre tract to the point of
beginning, containing 0.416 acres of land, more or less.
PARCEL SIX
0.201 acres of land out of a 0.445 acre tract conveyed to
the City of Corpus Christi, by J. R. Heldenfels, Trustee,
and Howell Refining Company by deed dated June 3, 1960,
recorded in Volume 901, page 466, Deed Records, Nueces
County, Texas, all being out of a tract known as the
C. C. Refining Company 3 -acre tract, located in Nueces
County, Texas, immediately south of UpRiver Road between
Dunn Lane and McBride Lane. Said 0.445 acre tract begins
on the south right =of -way line of UpRiver Road 186.45
feet, N. 77° 07' W. along said south right -of -way line
of UpRiver Road from the centerline of the Savage Lane
Railroad Track. This 0.201 acre Tract Six is more partic-
ularly described as follows:
Beginning at the above described point on the south right -
of -way line of UpRiver Road, said point being the northeast
corner of the C. C. Refining Company 3 -acre tract, the
northerly corner of said 0.445 acre tract and the northerly
corner of this tract;

Thence S. 5° 53' E. a distance of 270.14 feet along the
east line of said 3 acre, and 0.445 acre tracts to a
point, which point lies on an extension of a line parallel
to, and 25 feet west of the centerline of the Savage Lane
Railroad Track as it crosses UpRiver Road, said point being the
most easterly corner of this tract;
Thence S. 28° 55' 20" W., a distance of 83.38 feet along
said extension to a point on the west line of the 0.445
acre tract, for the most southerly corner of this tract;
Thence N. 1° 02' W., a distance of 246.10 feet to a point,
which point is a westerly corner of the 0.445 acre tract
and of this tract;
Thence N. 10° 07' 18" E., a distance of 97.14 feet along
the westerly line of the 0.445 acre tract to the point of
beginning, containing 0.201 acres of land, more or less.
PARCEL SEVEN
0.056 acres of land out of a 0.254 acre tract conveyed
to the City of Corpus Christi by Katie Dunn and E. C. Harris,
et UK, by deed dated June 29, 1959, recorded in Volume 859,
page 565, Deed Records, Nueces County, Texas, being out of
Tract No. 1 of the John Dunn One -Acre Tracts immediately
south of UpRiver Road between Dunn Lane and McBride Lane, and
in Nueces County, Texas. Said 0.346 acre tract fronts on
the south right -of -way line of UpRiver Road 120.85 feet.
This 0.056 acre Tract Seven is more particularly described
as follows:
Beginning at a point in the south right- of-way line of
UpRiver Road 80.85 feet N. 78° 21' 40" W. of the centerline
of Savage Lane Railroad Track, said point being the north-
westerly corner of Dunn Addition, of the 0.346 acre tract
and of this tract, and the northeasterly corner of a 16.086
acre railroad right -of -way tract out of the Heldenfels 171.01
acre tract;
Thence S. 7° 00' E., a distance of 92.34 feet along the
west line of Dunn Addition, the 0.346 acre tract, and the
east line of said Heldenfels Tract, to a point for the south
corner of this tract;
Thence N. 28° 11' 48" E., a distance of 91.28 feet along a line
parallel to, and 25 feet west of the centerline of the Savage
Lane Railroad Track to a point in the south rigbt -of -way line
of UpRiver Road for the east corner of this tract;
Thence N. 78° 21' 40" W., a distance of 55.53 feet along the
south right -of -way line of UpRiver Road and the north line of
Dunn Addition and the 0.346 acre tract to the point of
beginning, containing 0.056 acres of land, more or less.

SECTION 2. The necessity to immediately authorize execution of
the aforesaid deed in order to facilitate the sale of the aforesaid parcels
or tracts creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordi-
nance or resolution shall be read at three several meetings of the City
Council, and the Mayor having declared such emergency and necessity to exist,
and having requested the suspension of the Charter rule and that this ordi-
nance be passed finally on the date of its introduction and take effect and
be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the d ay of February, 1976.

That the City of Corpus Christi, hereinafter called Grantor,
for and in consideration of the sum of Forty -Four Thousand One Hundred
Thirty and No /100 Dollars ($44,130.00) to Grantor in hand paid by Quintana-
Howell Joint Venture, the receipt of which is hereby acknowledged, and
for which no lien is retained, either expressed or implied, has this day
sold, and by these presents does GRANT, BARGAIN, SELL and CONVEY unto the
said Quintana -Howell Joint Venture all those certain tracts or parcels of
land lying and being situated in the County of Nueces, State of Texas,
more particularly described as follows, to -wit:

belonging to the said Quintana Howell Joint Venture, their successors and
assigns, forever, and Grantor does hereby bind itself, its successors and

herein conveyed against every person whomsoever lawfully claiming or to
claim the same or any part thereof by, through, or under Grantor.
