AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
AGREEMENT WITH BOSTON COLLEGE FOR A SUMMER COLLEGE
WORK -STUDY PROGRAM, ALL AS MORE FOLLY SET FORTH IN
THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS
ATTACHED HERETO AND MADE A PART HEREOF, MARKED
EXHIBIT "A "; AND DECLARING AN EMERGENCY,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be and he is hereby authorized
to enter into an agreement with Boston College for a Summer College Work- -Study
Program, all as more fully set forth in the agreement, a substantial copy of
which is attached hereto and made a part hereof, marked Exhibit "A ".
SECTION 2. The necessity to authorize execution of the aforesaid
agreement in order that the program may be initiated without delay creates a
public emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally on the
date of its introduction but that such ordinance or resolution shall be read at
three several meetings of the City Council, and the Mayor having declared such
emergency and necessity to exist, and having requested the suspension of the
Charter rule and that this ordinance take effect and be in full force and effect
from and ter its passage, IT IS ACCORDINGLY SO ORDAINED, this the day

AGREEMENT WITH AN OFF - CAMPUS AGENCY, PURSUANT TO TITLE I, PART C, OF THE ECONOMIC
OPPORTUNITY ACT OF 1964, PUBLIC LAW 88452, 78 STAT. 513, AS AMENDED, TO STIMULATE AND
PROMOTE THE PART -TIME EMPLOYMENT OF STUDENTS, PARTICULARLY STUDENTS FROM LOW -
INCOME FAMILIES, WHO ARE IN NEED OF THE INCOME FROM SUCH EMPLOYMENT TO PURSUE
COURSES OF STUDY AT SUCH INSTITUTION, AND COMMONLY KNOWN AS THE COLLEGE WORK-
STUDY PROGRAM.
This agreement is entered into between BOSTON COLLEGE, and the City of Corpus Christi

for the purpose of providing work to students eligible to participate in the College WorkStudy Progrm. 7WS

Schedules to be attached to this agreement from time to time, bearing the signature of an authorized official of
Boston College and of the Agency, will set forth brief descriptions pf the work to be performed by students under
this agreement, the total number of hours per week each student will be utilized, the hourly wage to he paid each
student and the total amount of earnings for which each student is eligible. Any or all of these may be changed
from time to time upon written agreement between Boston College and the Agency. Furthermore, it is agreed that:
(1) The work is to be performed for a public or private non - profit organization.

(2) The work will not result in the displacement of employed workers or impair existing contracts for
services.
(3) The work will he governed by such conditions of employment, including compensation, as will be
appropriate and reasonable in light of such factors as type of work performed, geographical region
and experience of the employee.
(4) The work does not involve the construction, operation, or maintenance of so much of any facility as
is used, or is to he used, for sectarian instruction or as a place for religious worship. Further, no
project may involve political activity or work for any political party.
(5) The student will be assigned an hourly wage rate (mutually act by B.C. and the agency) which will
be appropriate and reasonable in terms of the work performed, his proficiency and prevailing wage
rates within the community, but in no case less than the current applicable minimum wage low.
(6) The agency will provide responsible supervision for the employee.
(7) The agency will submit weekly a list of hours worked and .a statement of the student's satisfactory
performance on forms supplied by Boston College.
(8) Number o/ Hours:
(a.) During an academic semester, the agency should not expect to employ the student more than 15
hours during any week in which there are classes. While the law permits exceptions to the
above provided that the semester average does not exceed 15 boors per week, Boston College
students should not be employed for more than 15 hours a week without prior permission from
the Financial Aid Office at the College.
(b.) During the summer vacation and other regular vacation periods, students may he employed up
to but not exceeding 40 hours a week. This is not intended to limit the rights of the student or
agency in the matter of employment for additional hours or periods of time for which compensa-
tion is to be paid from sources other than work -study funds.
(9) The student will be paid by Boston College based on the established hourly rate and the number of
hours worked. The agency will then he billed by the College for 2017. of the student's salary, plus
any additional required costs such as Workman's Compensation. This amount at present is approximately
1.04 %.

The Federal - institutional matching ratio of 80.20 ii of the student's compensation for work performed
began Aug. 20, 1963, and will continue at that rate. If there are future modifications in this part of the
law, a simple attachment to this agreement can be mutually arranged between the College and the agency.
(10) The Agency agrees that no student will he denied work or be subjected to different treatment under
this agreement on the grounds of race, color, or national origin, and it will comply with the provisions
of the Civil Rights Act of 1964 (P.I.. 88.352; 78 Stat. 252) and the Regulations of the Department
of Health, Education, and Welfare which implement the Act
(11) Students will be made available to the Agency by Boston College for performance of specified work
assignments by signed authorizations only. Authorizations must be revised for each academic semester
and for the summer program.
(12) Students may be removed from work on a particular assignment or from the Agency by Boston College,
either on its own initiative or at the request of the Agency.
(13) Correspondence concerning the conduct of this program, report of hours, etc„ should he sent to
Boston College, Office of Financial Aid, c/o Work -Study Coordinator.
(14) It is further specified that:

right to control and direct the services of the student for the Agency. it shall also determine
that the students meet the eligibility requirements for employment under the College Work -Study
Program, assign students to work for the Agency, determine that the students do perform their
work in fact, and disburse the appropriate salary to them. The Agency's right shall be limited to
direction of the details and means by which the result is to he accomplished.
(B) The Agency shall be deemed the employer for purposes of this agreement. It has the right to
control and direct the services of the students. Boston College shall be limited to determining
that the students meet the eligibility requirements for employment under the College Work-Study
Program, to referring students to cork for the Agency, to determining that the students do perform
their work in fact, and to accounting for proper use of Federal funds assigned for this program.
