HomeMy WebLinkAbout13177 ORD - 05/12/1976• JRH:vmr:5- 11- 76;lst • TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE DOCU- MENTTS NECESSARY F2& THE ACQUISITION OF PARCEL 3_07 FOR THE CORPUS CHRISTI BEACH PARR SITES PROJECT; APPROPRIATING AND REAPPROP_RIATING $42,347.50 OUT OF THE FIFTH ENTITLEMENT PERIOD, GENERAL REVENUE SHARING FUND, WHICH AMOUNT IS TO BE TRANSFERRED TO NO. 291 PARR BOND FUND, PROJECT 291- 72 -12, OF WHICH AMOUNT $42,000 IS FOR LAND ACQUISITION AND $347.50 IS FOR INCIDEN- TAL COST RELATED TO CLOSING OF THE PURCHASE OF AFORESAID PARCEL; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,/ SECTION 1. That the City Manager be and he is hereby authorized to execute documents necessary for acquisition of Parcel 307 from Guaranty National Bank and Trust, Trustee of the Estate of Oscar C. B. Nau, et al for the Corpus Christi Beach Park Sites Project, said parcel being more particularly described as follows: Being a part of the Levi Jones Original Survey Number 21, and being out of the Brooklyn Addition to the City of Corpus Christi, Texas, as shown by map of record in Volume A, Pages 31 and 32, Map Records, Nueces County, Texas, and being a portion of the two tracts of land conveyed to Oscar C. B. Nau by Constable's Deed as recorded in Volume 201, Page 508, Deed Records, Nueces County, Texas. Since the said Tracts I and II are not identified on the recorded Brooklyn Addition map and the metes and bounds description of said Tracts as called in said Constable's Deed are obviously in error and the beginning points have been destroyed, it is the purpose of the following description to correctly described the abovementioned property as it is situated on the ground: Beginning at a point on the East Right -of -Way of 60 foot wide Gulfbreeze Boulevard, (formerly "B" Street), said point being the Northwest corner of a tract of land known as Lot 13, Block 387, Brooklyn Addition, as shown by map of record in Volume 30, Page 90, Map Records, Nueces County, Texas, said Lot 13, being a portion of Tract II of the said Tracts I and II conveyed to Oscar C. B. Nau, for the beginning point of the tract of land herein described; Thence N. 0° 59' E., along the East Right -of -Way line of said Gulfbreeze Boulevard, passing the Northwest corner of said Tract II at 67.46 feet, in all a distance of 142.46 feet, more or less to a point in the South boundary line of a tract of land conveyed to the City of Corpus Christi by the Southern Pacific Company by deed of record in Volume 1224, Page 248, Deed Records, Nueces County, Texas for the Northwest corner of said Tract I; VMICROALME9 JUN 161980 J=77 0 0 Thence N. 78° 00' E., along the South boundary line of said City of Corpus Christi property, a distance of 110.0 feet, more or less, to a point in the margin of Corpus Christi Bay; Thence in a Southerly direction along the margin of said Corpus Christi Bay, passing the Southeast corner of said Tract I at 104.0 feet, more or less, in all a distance of 175.0 feet, more or less to a point in the North boundary line of said Lot 13; Thence N. 89° 29' W., along the North boundary line of said Lot 13, a distance of 141.0 feet to the place of beginning; and containing 18, 582.94 square feet, more or less. Said Tract above described being the same property conveyed by Constable's Deed dated June of 1932 from Carl Morgan, Constable of Nueces County, Texas by his Deputy Oscar C. B. Nan, recorded in Volume 201, Page 508, Deed Records, Nueces County, Texas. SECTION 2. That there is hereby appropriated and reappropriated the sum of $42,347.50 out of the Fifth Entitlement Period, General Revenue Sharing Fund, which amount is to be transferred to the No. 291 Park Bond Fund, Project No. 291- 72 -12, of which amount $42,000 is for the land acquisition and $347.50 is for incidental costs related to closing of the purchase of the aforesaid parcel. SECTION 3. That the necessity to authorize acquisition of the aforesaid parcel and to provide the sums necessary in order that the Corpus Christi Beach Park Site Project may be continued without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the �� day of May, 1976 Z Sec etary MAYOR THE CITY OF CORPUS CHRISTI, TE =DAY OF MAY, 1976 J. Entitlement Period - General Revenue Sharing Fund Account from which it is proposed to be drawn, and such money is not appropriated for any other purpose. These funds will be used for the acquisition of Parcel 307, Corpus Christi Beach Park Sites, from the Oscar C.B. Kau Estate and will be trans- ferred to the 291 Park Bond Fund, Project 291- 72 -12.
