HomeMy WebLinkAbout13236 ORD - 06/16/1976jkh:6- 16 -76; 1st 7 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT "A" FROM "R -1B" ONE FA1'IILY DWELLING DISTRICT AND SPECIAL PERMIT TO "B -3" BUSINESS DISTRICT, AND ON TRACT "B" FROM "R -1B" ONE FAMILY DWELLING DISTRICT AND SPECIAL PERMIT TO "A -2" APARTMENT HOUSE DISTRICT, BOTH TRACTS BEING OUT OF LOTS 1 AND 2, BLOCK AR, CARROLL PLACE #5, MORE PARTICULARLY DESCRIBED HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recbmmendations concerning the application of t_ he City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and'be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday June 16, 1976 at Special Council Fleeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565,- It seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as ariended, be and the same is hereby amended by making the change hereinafter set out. That the zoning on Tract "A" be and the same is hereby changed from "R -1B" One Family Dwelling District and Special Permit to "B -3" Business District, and on Tract "B" from "R -1B" One Family Dwelling District and Special Permit to "A -2" Apartment House District, both tracts being out of Lots 1 and 2, Block AR, Carroll Place #5, more particularly described as follows: Tract A Being a portion of Lot 1, Block AR, Carroll Place Addition Unit 5, as recorded in Volume 35, Page 57, Nueces County Map Records, Nueces County, Texas. BEGINNING at a 5/8" iron rod, such point being on the northwest corner of the intersection of 14ontego Drive and Weber Road; THENCE on a curve to the right whose radius is 10' with a delta of 90° 30' 45" for a distance of 15.29' to a 5/8" iron rod; THENCE South 280 58' west for a distance of 352' to a 5/8" iron rod; THENCE on a curve to the right whose radius is 10' with a delta of 89° 29' 15" for a distance of 15.62' to a 5/8" iron rod; THENCE North 510 32' 45" west for a distance of 20.09' to a point for corner; THENCE North 28° 58' east for a distance of 372' to a point ' for corner; THENCE South 610 32' 45" east to the place of beginning, such area containing approximately 0.16 acre of land, more or less. Tract B All of Lot 2, Block AR and a portion of Lot 1, Block AR, Carroll Place Addition Unit 5, as recorded in Volume 35, page 57, Nueces County Map Records, Nueces County, Texas. That portion of Lot 1, Block AR, Carroll'Place Addition Unit 5 being as follows: BEGINNING at a 5/8" iron rod in the northwest corner of Lot 1, such point also being the northeast corner of Lot 2 and also located on the southwest right of way line of Montego Drive; Thence South 610 32' 45" east for a distance of 445.15' to a point for corner; THENCE South 28° 58' west for a distance of 372' to a point for corner, such point being on the northeast right of way line of Holly Road; THENCE North 61° 32' 45" west for a distance of 442' to a 5/8" iron rod, such point also being the southwest corner of Lot 1; THENCE North 28° 27' 15" east to the place of beginning, such area containing approximately 3.97 acres of land, more or less. -2- SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension _. of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of JU JJ 192-1..
