The Mayor Pro -Tem presented to -the Council a communication in writing pertaining to said proposed ordinance, as follows: "Corpus Christi, Texas June 30, 1976 "TO THE CITY COUNCIL Corpus Christi, Texas - Gentlemen: The public importance and pressing need for the permanent improvements to be constructed by use of the proceeds of bonds voted at an election held June 26, 1976, create an emergency and an imperative public necessity requiring the suspension of rules and'Charter provisions requiring ordi- nances to be considered and voted upon at three regular meetings. I, therefore, request that the City Council pass the proposed ordinance canvassing election returns for the issuance of said bonds as an emergency measure. You will please consider this request in connection with the ordinance which is to be introduced for passage by the City Council on this subject. {'! Read, - City Secretary Alton White,, Jr:,' Tax Assessor - Collector • .sir � 'a �F - with the following absent: Mayor Jason Luby constituting a quorum, at which time the following among other business was transacted: Dr. Tipton, Mayor Pro -Tem, presented for the con- sideration of the Council an ordinance. The ordinance was read by the City Secretary. Councilman Ed de Ases moved that the Charter provision prohibiting ordinances from being passed finally on the date introduced be suspended for the reasons Fstated in the written reauest of the Mayor Pro -Tem and stated in the emergency clause of the ordinance. The motion was seconded by Councilman Bob Gulley The motion was carried by a unanimous vote by the City Council, viz: AYES:: Councilmen de Ases, Gill, Gulley, Lozano, and Sample.' kNAYS,: None.- ' The Mayor Pro =Tem requested that the records show that'he'voted 'Aye: ",This was, done. Councilman 'Ed de Ases-, moved that the ordinance' be passed finally :, 'The motion was carried by the following vote: ;AYES: Councilmen�de Ases, Gill, Gulley, Lozano, and Sample. ;14 NAYS: None. The Mayor Pro -Tem requested that the records show that he voted Aye. This was done. The Mayor Pro -Tem announced that the ordinance has been passed. The ordinance is as follows: e r ORDINANCE CANVASSING ELECTION RETURNS STATE OF TEXAS TY OF NUECES OF CORPUS CHRISTI WHEREAS, the City Council of said City duly ordered an lection to be held in said City on the 26th day of June, 976, on the Proposition hereinafter stated; and WHEREAS, said City Council has investigated all matters ining to said election, including the ordering, giving e, officers, holding, and making returns of said election; WHEREAS, the election officers who held said election have made the returns of the result thereof, and said returns been duly delivered to said City Council; and WHEREAS, it is hereby officially found and determined: t a case of emergency or urgent public necessity exists ch requires the holding of the meeting at which this Ordi- ce is passed, such emergency or urgent public necessity ng that the proceeds of the bonds heretofore voted are uired as soon as possible and without delay for necessary urgently needed public improvements; and that said meeting open to the public, and public notice of the time, place purpose of said meeting was given, all as required by non's Ann. Civ. St. article 6252 -17, as amended. ,RE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHRISTI, TEXAS: 1. That the City Council officially finds and determines hat said election was duly ordered, that proper notice of said lection was duly given, that proper election officers were my appointed prior to said election, that said election was my held, that due returns of the result of said election have een made and delivered, and that the City Council has duly anvassed said returns, all in accordance with law and the rdinance calling said election. 2. That the City Council officially finds and determines that the following votes were cast at the election on the submitted Proposition by the resident, qualified electors who voted at the election: PROPOSITION 13,244 VOTES: FOR ) THE ISSUANCE OF EXHIBIT, MEETING, BANQUET, AUDITORIUM AND CONVENTION 12,924 VOTES: AGAINST ) FACILITY AND SITE BONDS A copy of the vote tabulation is attached hereto and made a part hereof, marked Exhibit "A ". 3. That the City Council officially finds, deter - mines and declares the result of said election to be that the Proposition so submitted has received a favorable majority vote in all respects and has carried, and that the aforesaid bonds may be issued in accordance with law. 4. That the public importance and pressing need for the aermanent improvements to be constructed by use of the proceeds of the sale of said bonds create an emergency and - an imperative public necessity requiring the suspension of rules and Charter provisions requiring the same to be con- . 4 sidered and voted upon at three regular meetings, and such facts require that this, ordinance be passed and take effect immediately as an emergency measure, and such rules and provisions are hereby suspended and,this ordinance is passed i and shall take effect as,an emergency measure, and shall be in full force and effect immediately upon its passage. �.
