AN ORDINANCE
AMENDING CHAPTER 36, PARKS, RECREATION, CULTURAL AND
LEISURE TIME ACTIVITIES, ARTICLE II, COLISEUM_AND
EXPOSITION HALL, BY AMENDING SECTION 36 -41, BASIC
RATE TABLE OF RENTALS, AND SECTION 36 -43, CLASSIFICA-
TION OF SPECIAL SERVICES AND SCHEDULE OF CHARGES, SO
AS TO INCREASE RENTAL CHARGES IN EXPOSITION HALL AND
THE COLISEUM, AS MORE FULLY SET FORTH HEREINAFTER;
PROVIDING FOR EXCEPTIONS TO THE SAID INCREASE;
PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That Chapter 36, PARKS, RECREATION, CULTURAL AND
LEISURE TIME ACTIVITIES, Article II, COLISEUM AND EXPOSITION HALL, be and
same is hereby amended so as to amend Sections 36 -41 and 36 -43 to hereafter
read as follows:
"Section 36 -41. Basic Rate Table of Rentals.
(A) Class I, Commercial:

The above rates shall be deemed to be the minimum rates, and in
the event that ten percent (10 %) of the gross receipts of all
admissions, after admission taxes, shall exceed the minimum
charge, then said ten percent (10 %) shall be deemed the rental.
(B) Class II, Noncommercial - Profitmakin
The above rates shall be deemed to be the minimum rates, and in
the event that seven percent (7 %) of the gross receipts of all
admissions, after admission taxes, shall exceed the minimim
charge, then said seven percent (7 %) shall be deemed the rental
charge.

The above rates shall be deemed to be the minimum rates, and in
the event that 5% of the gross receipts of all admissions, after
admission taxes shall exceed the minimum charge, then said 5%
shall be deemed the rental charge. At the time of execution of
the series contract, lessee shall place on deposit with the city an
amount equal to the minimum rental for one event, which deposit shall
be retained throughout the term of the series contract. Upon com-
pletion of each event, payment shall be made by lessee for that
event on the basis of 5% of gross receipts of all admissions,
after admission taxes, or the minimum rental, whichever is greater.
At the completion of the series contract period, a recalculation
shall be made and the adjusted rental charge shall be 5% of the
total gross receipts of all admissions, after admission taxes,
for all events in the series, or the sum of the minimum rentals
for each event in the series, whichever is greater; and final
settlement shall be made on this basis. All other charges and
conditions for use of the Coliseum, such as public address system,
tables, risers, etc., shall be the same as for events charged at
the Class I rate.
(E) Class V, Athletic Events:
This rate will apply to any series of live athletic events and /or
closed circuit television events involving the reproduction of
live athletic events, when the lessee contracts for seven or more
events, of which at least five are live, during a twelve -month
period. The series contract shall specify the dates of events
in the series, or the lessee may elect to not specify dates of
events. If dates are specified in the contract, then the con-
tract shall provide that both the city and the lessee shall have
the option to cancel or withdraw not more than two of the specific
dates during the twelve- months period of the contract by providing
written notice at least thirty days in advance, and that otherwise
the lessee shall be responsible for the basic rental for each
date specified, whether used or not. Additional dates may be
added during the course.of the series by mutual agreement. If
the lessee elects not to specify dates in the contract, then
lessee shall acknowledge by affidavit at the time of execution of
the contract that sufficient dates to fulfill lessee's obligation
may not be available due to other bookings of the Coliseum, and
that in the event that lessee fails to carry out at least seven
events he shall be liable to pay retroactively the Class I rate
for those events which were completed and paid initially. at the
Class V rate. The Class V rate shall not apply to any events
conducted on Saturday, Sunday, holidays, or days before holidays.

(F) 'Evening rates' are based upon a four -hour period beginning
after 6:00 P.M.
(G) 'Daytime rates' are based upon a four -hour period between
7:00 A.M. and 6:00 P.M.
(H) 'Move -in and move -out rated are based upon a twenty -four
hour period.
(I) 'All day rates' are based upon a twenty -four hour period.
(J) 'Overtime and rehearsal rates' are based upon a one -hour
period.
(K) 'Rates for activities or exhibits which use less space than
that set forth in the basic rate table' will be computed on
the basis of the percentage of space contracted for or
utilized, whichever is the greater. These rates will be
computed by the coliseum manager and will be based upon the
basic rate table."

SECTION 2. The amended rate schedules hereinabove set forth shall
not apply to events on or after August 1, 1976, for which contracts have been
signed prior to August 1, 1976.
SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction it
shall not affect any other section, paragraph, subdivision, clause, phrase,

word, or provision of this ordinance, for it is the definite intent of
this City Council that every section, paragraph, subdivision, clause, phrase,
word, or provision hereof be given full force and effect for its purpose. -
SECTION 4. Publication shall be made one time in the official
publication of the City of Corpus Christi, by publishing the caption of this
ordinance, stating in substance the purpose of the ordinance.
