HomeMy WebLinkAbout13490 ORD - 11/24/197611 -8 -76 AN ORDINANCE AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, BY AMENDING CHAPTER 55, ARTICLE II RULES AND REGULATIONS OF DEPARTMENT OF PUBLIC UTILITIES, SECTION 55 -25, SECURITY FOR THE PAYMENT OF BILL AND PERFORMANCE OF OTHER OBLI- GATIONS BY CUSTOMER, TO ESTABLISH A DEPOSIT SCHEDULE FOR RESIDENTIAL AND COMMERCIAL CUSTOMERS; PROVIDING FOR THE ACCEPTANCE OF CERTIFICATES OF DEPOSIT FOR THAT PORTION OF REQUIRED DEPOSITS IN EXCESS OF $500: PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH;_PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 55 -25 of the Code of Ordinances, City of Corpus Christi, 1976 Revision, be and the same is hereby amended to hereafter read as follows: "Section 55 -25. Security for the payment of bill and performances of other obligations by customer. The customer shall, upon request by the city, deposit with the city as security for the payment of bills owing and to become owing and without limitation by such statement, as security also for the performance of all other obligations of the customer, a sum of money equal to two (2) average monthly bills for service furnished or to be furnished'as estimated by the city. In case the customer's bills for any two (2) consecutive monthly billing periods of normal operation actually prove to exceed appreciably the amount of the deposit, the city may, at its option, require the customer to deposit an additional amount of money sufficient to make the total on deposit with city equal to the amount of bills for the two (2) consecutive months, and the customer agrees in such case to deposit with the city such additional amount of money. The minimum deposit for services will be in accordance with the following schedule: ) ti Residential 1. $25 for gas, water, wastewater and garbage 2. $20 for gas only 3. $10 for water or water and wastewater only 4. $5 for garbage only 5. No additional deposit for garbage if another service is requested.. MI�ROF/�MFDIu„U, rL ��icu 13400 gun► 1980 Commercial 1. $15 for water and wastewater 2. $25 for gas If the required deposit exceeds $500, the city will accept a certificate of deposit in lieu of cash for amounts in excess of $500. The deposit need not be applied against delinquent account until a final bill is rendered to the customer, and the existence of a deposit shall not relieve the customer of any of the charges provided in this Code for performing procedures in connection with delinquent accounts, disconnections, reconnections, damages to property or other charges which may be made against the customer in accordance with rules and regulations of the department of public utilities of the city or ordinances of the city." SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 3. That if for any reason any section, paragraph, subdi- vision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent juris- diction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. This ordinance shall be effective upon final passage and publication thereof. SECTION 5.
