HomeMy WebLinkAbout13498 ORD - 11/24/1976j JKH:vmr:11- 4- 76;lst AN ORDINANCE ANNEXING TO THE CITY OF CORPUS CHRISTI, TEXAS, A PORTION OF MC KINZIE ROAD, PURSUANT TO ARTICLE 970a, V.A.C.S., TEXAS, AS AMENDED, AND CITY CHARTER ARTICLE I, SECTION 2(c), PROVIDING FOR ANNEXATION OF ROADS, HIGHWAYS, AND STREETS ADJA- CENT AND CONTIGUOUS TO THE CITY OF CORPUS CHRISTI; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, on the 10th day of November, 1976, a public hearing was duly held at the Regular Meeting of the City Council, following publication of due notice of said hearing in the official newspaper, pursuant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of institution of proceedings for the annexation of a defined area wholly within the extra- territorial jurisdiction of Corpus Christi, including McKinzie Road, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed on November 10, 1976; and WHEREAS, it has been determined by the City Council that the territory above mentioned, and now proposed to be annexed, abuts and is contiguous and is adjacent to the City of Corpus Christi and constitutes lands and territories used for public purposes and which is owned by any governmental i subdivision, or dedicated to a public use within the meaning of City Charter, Article I, Section 2(c), and also lands and territories subject to contractual annexation as provided by the City Charter Article I, Section 2(b); and WHEREAS, owners of a portion of the above lands are desirous of contracting with the City for the annexation of said territory to the City of Corpus Christi; and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid area hereinafter more fully described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby annexed a portion of McKinzie Road, North of I. H. 37, in Nueces County, Texas, pursuant to Article 970a, MICROFILMED_ 111301980 13498 V.A.C.S., as amended, and City Charter Article I, Section 2(c), said area being more fully described as follows: BEGINNING at the point of intersection of the west right -of -way line of McKinzie Road and the northwest corner of Interstate Highway No. 37 right -of -way, said point being on the north line of the present City limit line, for the beginning point of the tract of land herein described; THENCE N. 9 °00'00" E. along the west right -of- way -line of said McKinzie Road, passing the southeast corner of Lot 5, Riverview Estates, as shown by map of record in Volume 34, page 115, Map Records, Nueces County, Texas, at 623.76 feet, in all a distance of 669.33 feet to a point for the P.C. of a curve to the left; THENCE continue along the west right -of -way line of said McKinzie Road on the arc of a circular curve whose central angle is 25 °37132" radius 1535.12 feet, tangent 349.13 feet, a distance of 686.58 feet to a point; THENCE N. 73 031'53" along the radial line across said McKinzie Road, a distance of 60.0 feet to a point on the east right -of -way line of said McKinzie Road; THENCE in a southerly direction along the east right- of-way line of said McKinzie Road on the are of-'a circular curve whose central angle is 25 °37'18 ", radius 1595.12 feet, tangent 362.72 feet, a distance of 713.31 feet to a point; " THENCE S. 9 °00'00" W. continue along the east right -of -way line of said McKinzie Road a distance of 9.85 feet to a point which is the intersection of the east right -of -way line of said McKinzie Road and the north right -of -way line of said McKinzie Lane; THENCE continued S.9 °00'00" W. across said McKinzie Lane, passing the point of intersection of the east right -of -way line of said McKinzie Road and the south right-of-way- line of said McKinzie Lane at 60.0 feet, in all a distance of 662.57 feet to the point of intersection of the east right -of -way line of said McKinzie Road and the northeast corner of abovementioned Interstate Highway No. 37 right -of -way, said point being on the north line of the present City limit line; THENCE N. 78 °03'07" W. along the present City limit line and across said McKinzie Road a distance of 60.08 feet to the place of beginning and containing 1.870 acres of land, more or less. The above described area shall hereafter effective January 12, 1977, be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the City Charter of the City of Corpus Christi and the ordinances, resolution, laws, rules and regulations of the City of Corpus Christi, to all in- tents and purposes as the present City of Corpus Christi is so subject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional CORPUS CHRISTI, TEXAS r� /ST"` DAY OF 9 /� TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCES A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL. SAMPLE by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or pro- vision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or pro- vision hereof be given full force and effect for its purpose. SECTION 3, The necessity to immediately annex to the City of Corpus Christi the aforesaid portion of McKinzie Road and to declare that said portion hereinabove described shall hereafter be a part of the corporate limits of the City of Corpus Christi, creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that said ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the w4 day of November, 1976, ATTEST: City Secretary AP D: O'ge DAY OF NOVEMBER, 1976 J.
