HomeMy WebLinkAbout13567 ORD - 01/12/1977jkh:1- 12 -77; 1st r. % ° t c ' AN ORDINANCE AMENDING ORDINANCE NO. 12386, PASSED AND APPROVED BY THE CITY COUNCIL ON DECEMBER 11, 1974, RELATIVE TO CLOSING OF A PORTION OF KAY STREET, BY AMENDING SECTION 1 OF SAID ORDINANCE, SO AS TO ELIMINATE THE REQUIREMENT THAT THE ABUTTING PROPERTY FIRST BE USED FOR PUBLIC HOUSING IN WHICH THE HOUSING AUTHORITY OF THE CITY OF CORPUS CHRISTI HAS PARTICIPATED AND REPLACE IT WITH A REQUIREMENT THAT THE PROPERTY FIRST BE USED FOR HOUSING FOR THE ELDERLY AND SO AS TO RELOCATE THE 10 -FOOT PEDESTRIAN ACCESS AND UTILITY EASEMENT REQUIRED THEREIN; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 12386,'passed and approved by the City Council on December 11, 1974, relative to closing of a portion of Kay Street, be and the same is hereby amended by amending Section 1 of said ordinance as follows: : I A. Amend Section 1, paragraph 1 by deleting the words "the plat attached hereto, marked Exhibit W, and incorporated herein for all pertinent purposes" in lines 7 and 8 of said para- graph and in lieu thereof adding the words "a replat of the property and also indicated on the site plan attached to the special permit for the property," said first paragraph of Section 1 to hereafter read as follows: "That Kay Street, being an unimproved 25 -foot wide strip extending 429 feet west from Carroll Lane between Copus and Houston Streets, in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby closed for use as a public street and hereby reverts to the abutting property owners from which this 25 -foot wide strip was carved; provided, however, an easement of pedestrian access is hereby retained on a 10 -foot width and dedicated to the public forever, said 10 -foot width being as shown on a replat of the property and also indicated on the site plan attached to the special permit for the property." That paragraph 2 of Section 1 be amended by deleting in the third line the words "public housing purposes in which the Housing Authority of the City of Corpus Christi has partici- pated" and in lieu thereof adding the words "housing for the elderly," said paragraph 2 to hereafter read as follows: "Provided further that the closure of the entire 25 -foot width of Kay Street is effective so long as a portion of the abutting property is first used for housing for`the elderly, and that upon failure of said use this closure shall become void and the title to said property shall revert to the City of Corpus Christi, its successors and assigns, who shall have the right to reenter and repossess itself of same." SECTION 2. The necessity to amend Ordinance No. 12386 as here- inabove set forth creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City. Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the_Z2�'r day of January, 1977.
