HomeMy WebLinkAbout13583 ORD - 01/19/1977• JKH:vmr:1- 18- 77;lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF M. J. HOT MIX CORPORATION BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A: 23.175 ACRES; AND TRACT B: 10.610 ACRES, BOTH OUT OF SURVEY 416, ABSTRACT 838, AND SURVEY 421, ABSTRACT 572, OUT OF SHARES 2 AND 3 OF THE GEORGE FRANK PARTITION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE- FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS. the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of M. J. Hot Mix Corporation for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday , Jan{rary 19, 1977 at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, at seq, of the Ordinance and Resolution is Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the Zoning on the following described Tract A: 23.175 acres; and Tract B: 10.610 acres, both out of Survey 416, Abstract 838, and Survey 421, Abstract 572, out'of Shares 2 and 3 of the George Frank Partition, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "R -1B" one - Family Dwelling District to "B -4" General Business District each Tract described as follows: TRACT A BEGINNING at a point in the east right of way line of Rand Morgan Road, said point also being the most northwesterly corner of Lot 1, Block B of the Frank Addition as recorded in Volume 37, Page 199, of the Nueces County Plat Records, for the most southwesterly corner and POINT OF BEGINNING of this tract; THENCE along said east right of way line of Rand Morgan Road N 0° 06' 00" W 139.69 feet to a point for the northwest corner of this tract; THENCE leaving the east right of way line of Rand Morgan Road S 65° 15' 00" E 990.69 feet to the point of curvature of a circular curve to the left having a central angle.of 24° 49' 52" a radius of 856.78 feet and a tangent length of 188.62 feet for a northerly corner of this tract; THENCE along the arc of said circular curve to the left 371.32 feet to the point of reverse curvature of a circular curve to the right having a central angle of 24° 49' 39 ", a radius of 170.140 feet and a tangent length of 37.45 feet, for a northerly corner of this tract; THENCE along the arc of said circular curve to the right 73.73 feet to the point of tangency for a northerly corner of this tract; THENCE S 650 15' 13" E 1322.03 feet to a point for the northeast corner of this tract; THENCE S 0° 06' 51" E 661.18 feet to a point in the north right of way line of State Highway No. 9 for the southeast corner of this tract; THENCE along said north right of way line of State Highway No. 9, N 65 °15' 13" W 1401.14 feet to a point for a southerly corner of this tract; THENCE leaving the north right of way line of State Highway No. 9, N 0° 04' 52" W 550.00 feet to a point for a southwesterly corner of this tract; THENCE S 890 54' 00" W 213.00 feet to the point of curvature of a circular curve to the right having a central angle of 240 51' 00 ", a radius of 375.34 feet and a tangent length of 76.09 feet, for a southerly corner of this tract; THENCE along the arc of said circular curve to the right 149.78 feet to the point of tangency for a southerly corner of this tract; THENCE N 65° 15' 00" W 992.28 feet to the POINT OF BEGINNING. TRACT B BEGINNING at a point in the southwest right of way. line of Interstate Highway 37, said point also being the northeast corner of Lot 1, Block 8 of the said Solar Estates, Unit 1 Subdivision for the most northerly corner and POINT OF BEGINNING of this tract; THENCE along said Southwest right of way line of Interstate Highway 37, S 560 .22' 21" E 1527.69 feet to a point for the northeast corner of this tract; THENCE leaving said Southwest right of way line of Interstate Highway 37, S 0° 06' 51" E 360.77 feet to a point for the southeast corner of this tract; THENCE N 560 22' 21" W 1527.94 feet to a point for a southwest corner of this tract; THENCE N 00 04' 52" W 129.23 feet to a point for a southwest corner of this tract; THENCE N 82° 50' 18" W 274.46 feet to a point, in circular curve to the left having a central angle of 7° 15' 42" a radius of 467.00 feet and a tangent length of 28.63 feet, said point also being the most westerly corner of this tract; THENCE in an easterly direction along the 4rc of said circular curve,to the left 59.19 feet to the point of tangency for a.corner of this tract; THENCE N 891 54' 00" E 213.24 feet to a point for an interior corner of this tract; THENCE N 00° 04' 52" W 200.45 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi; Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Nap of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative piiblic necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from an �tits a ssage, IT IS ACCORDINGLY SO ORDAINED, this the day of , 19%7.
