HomeMy WebLinkAbout13855 ORD - 07/27/1977JKH:hb -.7 /26/77 - AN ORDINANCE AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLI- CATION FOR PROJECT GRANT IN THE AMOUNT OF $40,085 TO THE COASTAL BEND COUNCIL OF GOVERNMENTS FOR THE CONTINUATION OF THE CITY'S SENIOR COMMUNITY SERVICES PROGRAM, THE PROJECT YEAR WILL BEGIN AUGUST 1, 1977, TO JULY 31, 1978, ALL AS MORE FULLY SET FORTH IN THE APPLICATION, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL RELATED AND NECESSARY DOCUMENTS REQUIRED IN THE IMPLEMENTATION, ADMINISTRATION AND CONTINUATION OF THE AFORESAID PRO- GRAM; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to submit an application for project grant in the amount of $40,085 to the Coastal Bend Council of Governments for the continuation of the City's Senior Community Services Program, the project year will begin August 1, 1977 to July 31, 1978, all as more fully set forth in the appli- cation, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. That the City Manager be and he is hereby authorized to execute all related and necessary documents required in the implemen- tation, administration, and continuation of the aforesaid program. SECTION 3. The necessity to authorize execution of the aforesaid application for the project grant and other necessary and related documents in order to implement, administer and continue the Senior Community Services program creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the MICROFILMED JUL 0 71980 13855 Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the 9-ou ay of 1977. [Establish a volunteer escort corps to assist these elderly.] INTER - AGENCY COORDINATION AGREEMENT To improve coordination among agencies serving older persons and agencies capable of providing opportunities for older persons to serve in the community, the Coastal Bend Area Agency on Aging is asking each contract agency to agree to the following: (1) Staff members of the contract agency will participate in the activities of the Coastal Bend Council for Service Providers in Aging, an advisory committee of the Coastal Bend Council on Aging. (2) Where there is an established inter - agency council operating within the county, staff members of the contract agency will participate in the activities of that council. Where there is no established inter - agency council operating within the county, staff members of the contract agency will assist in any attempts.to organize such a council. (3) Staff members of the contract agency will plan and hold, with one agency each month, meetings to discuss mutual concerns, coordination opportuni- ties, and the like. PROGRAM REPORTING AGREEMENT To insure the availability of information needed for planning purposes, as well as to meet the federal and state requirements for programs funded under Title III, the Coastal Bend Area Agency on Aging is asking each contract agency to agree to the following: (1) The contract agency will provide monthly reports on services provided and on needs & problems identified, with copies of the report going to CBCOG /AAA; the County Commissioners Court; and the City Council of each incorporated municipality within which the program operates. (2) The contract agency will assist the AAA in determining fair estimates for the quarterly and yearly reports required by the Governor's Committee on Aging. (3) The contract agency will assist in preparing such special reports as may be requested by the above named agencies or governments. CBCOG CONTRACT N0. UNDER UNDER AGREEMENT WITH THE STATE OF TEXAS CONTRACT NO. AA3- 0448 -09 COASTAL BEND COUNCIL OF GOVERNMENTS AREA AGENCY ON AGING CONTRACT FOR SERVICES THIS AGREEMENT, entered into as of this day of 197_, by and between the City Of Corpus Christi (herein called the "Contractor ") and the Coastal Bend Council of Governments (herein called the "Area Agency "), WITNESSETH THAT: WHEREAS, the Area Agency desires to engage the Contractor to render techni- cal or professional services hereafter described in connection with an undertaking which is partially financed by a grant from the Office of the Governor's Committee on Aging under the Federal Older Americans Act of 1965 as amended. NOW, THEREFORE, the parties hereto do mutually agree as follows: 1. Employment Contractor. The Area Agency hereby agrees to engage the Con- tractor and the Contractor hereby agrees to perform the services hereinafter set forth in connection with the Project as contracted with the Office of the Governor's Committee on Aging under the Federal Older Americans Act of 1965 as amended. 2. Area Covered. The Contractor shall perform all the necessary services' provided under this Contract in connection with and respecting the boundaries of 3. Scope of Services. The Contractor shall perform in a satisfactory and proper manner; as determined by the Area Agency, the following services: a. Provide supporting services in accordance with the approved plan of operation dated and allow the Area Agency to monitor same. A copy of the program is made a part of this Contract. b. For the purposes of clarifying the meaning of supporting services described in the approved project application, the following definitions, as pro- vided in the Federal Regulations (Title 45, Chapter IX, Part 903) implementing Title III of the Older Americans Act of 1965 as amended (Public Law 93 -29), are made a part of this Contract: - (1) Information sources or services which provide a location where State, area or other private agencies or organizations: (i) maintain current information with respect to the opportuni- ties and services available to older persons, and develop current lists of older persons in need of services and opportunities; and (ii) employ a specially trained staff, including bilingual individuals as appropriate, to inform older persons of the opportunities and services which are available, and assist them to take advantage of such opportun- ities and services. -1- a o (2) Referral.services which assist individuals to identify the type of assistance needed, place individuals in contact with appropriate services, and follow -up to determine whether services were received and met the need identified, and which provide for the maintenance of proper records for use in identifying ser- vices offered and gaps in existing services systems; (3) Transportation services designed to transport older persons to and from community facilities and resources for the purpose of applying for and receiving services, reducing isolation, or otherwise promoting independent living, but not including a direct subsidy for an overall transit system or a general reduced fare program for a public or private transit system. Such transportation services shall be, insofar as possible, part of an area transportation plan; (4) Escort services which assist individuals who, for a variety of factors, are unable to use conventional means of transportation to reach needed services or require such assistance for reasons of personal security or protection; and (5) Outreach services including search and find activities, which seek out and identify hard -to -reach individuals and assist them in gaining access to needed services. (6) Multi- purpose Senior Center means a community facility for the organization and provision of a broad spectrum of services, which may include the provision of health, social and educational services and provision of facilities for recreational activities for older persons. c. The Area Agency will assist in securing and making available infor- mation necessary to operate an information and referral system and will promote interagency cooperation making services accessible to the elderly. d. Provide the Area Agency a verified and proper monthly statement for services provided in accordance with the procedures prescribed by the Area Agency. e. Hire or promote only such personnel who can meet specific qualifi- cations as set forth in the job descriptions which have been approved as a part of the plan of operation unless a waiver of a specific required qualification is obtained in writing from the Area Agency prior to the hiring or promotion of the individual involved. f. Observe the Federal requirements in other regulations as specified by the Area Agency and the Governor's Committee on Aging as they relate to parti- cular programs in providing the services contemplated under this Contract. g.(1) Furnish the Area Agency with Fiscal Reports and a breakdown of expenditures each month in a format prescribed by the Area Agency. Specifically, the Contractor agrees to furnish Fiscal Reports on or before the 15th day following the end of the billing month. (2) Contractor agrees to provide matching funds in the amount indicated in the approved project application and to document same in the monthly billing for cost reimbursement. h. Furnish the Area Agency with various monthly statistical reports as required by the Area Agency in the format prescribed by the Area Agency. !Km N W i* Make available at reasonable times and for reasonable periods those books, records, and supporting documents kept current by the Contractor and its Sub - Contractors pertaining to this project for purposes of inspection, monitor- ing, auditing or evaluating by the Area Agency personnel or their representatives. j. Maintain and retain supporting fiscal documents adequate to assure that claims for Federal matching funds are in accord with applicable Federal require- ments. Said document shall be maintained and retained by the Contractor and all Sub - Contractors, if any, for a period of three years after the end of the Federal Fiscal Year if audit by or on behalf of the Area Agency has occurred by that time. If such audit has not occurred, the documents must be retained until audit or until five years following the end of the Federal Fiscal Year, whichever is earlier. In all cases, documents shall be retained until the resolution of audit questions. Contractor agrees to reimburse the Area Agency for any and all pro- ject costs determined by audit or otherwise during this project period or at some later date to be ineligible expenditures. k. Comply with Federal Civil Rights Act of 1964, as amended, Article 6252 -16; and Texas Revised Civil Statutes, as amended, including but not limited to, giving equal opportunity both to those seeking employment and those seeking services without regard to race, color, religion, sex, or national origin. 1. Establish a method to secure the confidentiality of records relating to clients in accordance with the applicable Federal Law, being Section 402(A) (9) of Title IV, Part A of the Federal Social Security Act, as amended, and the Rules '- and Regulations issued pursuant thereto as well as the applicable State Law, being Section 33 of Article 695C, Vernon's Texas Civil Statutes, as amended, and the Rules and Regulations issued pursuant thereto. M. Contractor shall assume responsibility for the protection, at all times, of all physical property and equipment used by the facility or facilities, being maintained to carry out the plan of operation and take appropriate measures to insure meeting its obligation. The Contractor must furnish the Area Agency with a written, factual report of any equipment which is damaged or stolen and the circumstances concerning such loss and, in the event of any theft, vandalism, or other offense against said property, must notify appropriate local law enforce- ment authorities. n. Contractor shall identify all equipment purchased with funds allo- cated to the Contractor under such contract by appropriate tags or labels affixed thereto, and maintain a current inventory of such equipment which will be avail- able to the Area Agency at all times upon request. 4. Personnel. The Contractor represents that he has, or will secure at his own expense, all personnel required in performing the services under this Con- tract. Such personnel shall not be employees of or have any contractual relation- ship with the Area Agency. 5. None of the work or services covered by this Contract shall be sub- contracted without the prior written approval of the Area Agency. 6. Time of Performance. The services of the Contractor are to commence as soon as practicable after the execution of this Contract and shall be undertaken -3- -0 0 so as to assure their expeditiouous completion in the light of the purposes of this Contract, but in any event all of the services required hereunder shall be completed on or before 7.a. Compensation. The Area Agency agrees to reimburse the Contractor a sum not to exceed $ for the above services. b. Method of Payments. The Area Agency will pay to the Contractor the amount or amounts set forth in Paragraph 6 above, which shall constitute full and complete compensation for the Contractor's service hereunder. Such sum will be paid in monthly payments upon receipt of a reimbursement voucher for payment from the Contractor specifying that he has performed the work under this Contract in conformance with the Contract and that he is entitled to receive the amount =requisitioned under the terms of the Contract. 8. Termination of Contract for Cause. If, through any cause, Contractor shall fail to fulfill in timely and proper manner his obligations under this Con- tract, or if the Contractor shall violate any of the covenants, agreements, or .stipulations of this Contract, the Area Agency shall thereupon have the right to terminate this Contract by giving written notice to the Contractor of such termin- ation and specifying the effective date thereof, at least five (5) days before the effective date of such termination. In that event, all finished or unfinished documents, data, studies, surveys, and reports prepared by the Contractor shall at the option of the Area Agency, become its property, and the Contractor shall be entitled to receive just and equitable compensation `for any satisfactory work completed on such documents and other materials. Notwithstanding the above, the Contractor shall not be relieved of lia- bility to the Area Agency for damages sustained by the Area Agency by virtue of any breach of the Contract by the Contractor, and the Area Agency may withhold any payment to the Contractor for the purpose of setoff until such time as the exact amount of damages due the Area Agency from the Contractor is determined. 9. Termination for Convenience of Area Agency. The Area Agency may termin- ate this Contract. at any time by giving written notice to the Contractor of such termination and specifying the effective date thereof, at least fifteen (15) days before'the effective date of such termination. In that event, all finished or unfinished documents, data, studies, surveys, and reports prepared by the Contractor shall at the option of the Area Agency, become its property, and the Contractor shall be entitled to receive just and equitable compensation for any satisfactory work completed on such documents and other materials. 10. Changes. The Area Agency may, from time to time, require changes in the scope of services of the Contract to be performed hereunder. Such changes, including any increase or decrease in the amount of the Contract's compensation, which are mutually agreed upon by and between the Area Agency and the Contractor, shall be incorporated in written amendments to this Contract. 11. Equal Employment Opportunity. a. The Contractor will not discriminate against any employee or person seeking employment with regard to race, color, religion, sex, national origin, or age. The Contractor shall take affirmative action to ensure that applicants are employed and that employees are treated during employment, without regard to race, color, religion, sex, or national origin. Such action shall include, but not be limited to the following: employment, upgrading, demotions, or transfers, -4- recruitment or recruitment advertising, layoffs or terminations, rates of pay or other forms of compensation; selection for training including apprenticeship; and participation in recreational and educational activities. The Contractor agrees to post in a conspicuous place available to employees and applicants for employment notices to be provided setting forth the provision of this non - discrimination clause. b. The Contractor shall keep such records and submit such reports con- cerning the racial and ethnic origin of applicants for employment and employees as may be requested by the Area Agency, and as may be required by law. c. The Contractor agrees to comply with such rules, regulations or guidelines as the Area Agency may issue to implement these requirements. 12. Interest of Members of Planning Agency and Others. No officer, member or employee of the Area Agency and no members of its governing body, and no other public official of the governing body of the locality'or localities in which the Project is situated or being carried out who exercises any functions or respon- sibilities in the review or approval of the undertaking or carrying out of this Project, shall participate in any decision relating to this Contract which affects his personal interest or have any personal or pecuniary interest, direct or indi- rect, in this Contract or the proceeds thereof. 13. Findings•Confidential' Any reports, information, data, etc., given to or prepared or assembled by the under this Contract which the Area Agency requests to be kept as confidential shall not be made available to any individual or organization by the Contractor without the prior approval of the Area Agency. 14. Officials Not to Benefit. No Members of or Delegates to the Congress of the United States of America, and no Resident Commissioner, shall be admitted to any share of part thereof or to any benefit to arise herefrom. 15. Assignability. The Contractor shall not assign any interest in this Contract and shall not transfer any interest in the same without the prior written consent of the Area Agency. 16. Interest of Contractor. The Contractor covenants that he presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of services required to be performed under this Contract. The Contractor further covenants that in the per- formance of this Contract no person having any such interest shall be employed. Marvin Townsend, City Manager Name' Title- o _ o NARRATIVE SENIOR COMMUNITY SERVICES TITLE III TRANSPORTATION PROGRAM The Senior Community Services program proposes to address the following objective in accordance with the proposed Area Agency on Aging's objective for Transportation and Escort Services: To provide transportation services to older persons residing in Nueces County with special attention to the needs of low - income and mobility- impaired elderly. The Transportation component of the Senior Community Services Program provides transportation services in Nueces County to approximately 8,000 elderly persons. The demand for the service has increased significantly over the 1976 -1977 grant year. The demand rate is twice that of the previous year. Conversely, the federal funding level has decreased by the same level. The local contribution has had to absorb the difference in order that the level of service remain unchanged. Transportation services are prioritized in order to fulfill the most im- mediate needs of the elderly population. Trips are scheduled in this order for priority: (1) To senior centers for meals; (2 To medical services; (3 To social service agencies; (4) To grocery stores; (5) To senior centers for other activities. Persons needing the service schedule their trip with Senior Community Ser- vices twenty -four hours in advance of their pickup time. This requirement may be waived in special circumstances. The elderly users have expressed their satisfaction with the service for the following reasons: (1) Bus operators offer assistance in boarding and disembarking from the vans; (2) Door -to -door service is providing necessitating minimal walking for elderly persons; (3) Spanish- speaking elderly find the bi- lingual drivers and dispatcher accommodating; (4) Enjoyment in riding with persons with similar age and socio - economic characteristics; (5) Availability of a no- charge transportation service. Senior Community Services has found that among the 19,300 persons 60 years of age or older in the City and 23,200 in the County, one of the most formidable problems is transportation. Other problems include housing, income, employ- ment, lack of health services and nutrition. Under no circumstances will Senior Community Services ever be able to alleviate all the needs. It can and has, up to now, been able to make measurable strides within the community to make the needs of the elderly -- those needs not being met by Senior Com- munity Services -- better known and better addressed by the entire community. Thes a needs make no distinction of race, creed, color or sex. Needs are significantly similar among the elderly and Senior Community Services will continue to take the leadership role in the community and in the County to bring to bear all available resources to address these needs. -2- Corpus Christi, Texas 0-1tk, ay of 19�_ TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
