FOR $15,000 FOR THE PROVISION OF A SHELTER AND COUNSELING SERVICES FOR BATTERED WOMEN, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERE- TO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; APPROPRI- ATING $15,000 FROM THE NO. 102 GENERAL FUND RESERVE, ACTIVITY 4299, CODE 490, FOR TRANSFER TO ACTIVITY 3624, CODE 301; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That authorization is hereby given for execution of a contract with the Corpus Christi Area Women's Shelter, Inc., for $15,000 for the provision of a shelter and counseling services for battered women, all as more fully set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. That there is hereby appropriated the sum of $15,000 from the No. 102 General Fund Reserve, Activity 4299, Code 490, for transfer to Activity 3624, Code 301, for the aforesaid services. SECTION 3. The necessity to authorize the contract and to provide the sums necessary in order to perform the services hereinabove described creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the__LL_day of January, 1978. MICROFILMED i�i2� JUL 0 7 19 s0 • AGREEMENT THE STATE OF TEXAS Y COUNTY OF NUECKS j This Agreement is entered into by and between the City of Corpus Christi, hereinafter referred to as the "City "; and the Women's Shelter of the Corpus Christi Area, Inc., hereinafter referred to as the "Shelter ". 1. The Shelter agrees to provide the following services. A. A temporary refuge for battered women and their children residing in Nueces County from an abusive home situation. B. Emotional support for battered women which will facilitate self - determination. C. Counseling to strengthen the family unit through evaluation of stresses that provoke violence. D. Community information concerning the social problems of women battering and household violence. 2. In addition, the Shelter agrees tot A. Provide all housing., food, support activities and staff necessary to carry out a successful program designed to achieve the above services. B. Conform with and comply with all applicable local, state and federal rules and regulations governing this type of program, including but not limited to the requirement that the guidelines established. be agreeable to the City for determination of who qualifies or does not qualify for free support. After the effective date of this Agreement and before such guidelines are established, the Shelter will make every effort to obtain reimbursement for the reasonable unit costs of its services. C. Operate in a non - partisan manner to serve women residents of Nueces County without discrimination as to race, color, creed, national origin or age. X�/ CJ D. Be responsible for the operation and maintenance of its program. establish the number of persons it may serve, and operate the program within available funds from whatever sources derived. Such program operation and maintenance will be coordinated with the City - County Health and Welfare Director. E. Provide the City - County Health and Welfare Director with monthly reports of operating costs, income and number of clients served indicating the financially needy versus the non - financially needy. F. Allow the City's Director of Finance or his representative to inspect all books and records at any reasonable time. G. Provide that any acquired interest in personal or real property will pass to the City and the County on an equal basis upon dissolution of the Shelter. H. Hold the City harmless from any and all liabilities which may arise in connection with the operation of the Shelter and that liability insurance covering the operations of said Shelter will be obtained to the extent that the City might be liable under the Texas Tort Claims Act. I. Seek funding from sources other than the City and recognize that the City's participation is temporary. 3. In consideration of the Shelter providing the above described services for women of Nueces County, the City agrees to pay the total sum of Fifteen Thousand Dollars ($15,000) in support of the Women's Shelter of the Corpus Christi Area, Inc. program. Initial payment of Four Thousand Dollars ($4,000) will be made as soon as it is practicable upon execution of this Agreement and One Thousand Dollars ($1,000) each month thereafter for a period of eleven (11) months subject to available budgeted funds.
