HomeMy WebLinkAbout14134 ORD - 01/18/1978JKH:hb:1/17/78 TEXAS: AN ORDINANCE AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE TEXAS ANTIQUITIES COMMITTEE FOR THE EXHIBITION OF THEIR ARTIFACTS AT THE CORPUS CHRISTI MUSEUM FEBRUARY 12 THROUGH MARCH 26, 1978; AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. is BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute an agreement with the Texas Antiquities Committe for the exhibition of their artifacts at the Corpus Christi Museum February 12 through March 26, 1978, all as more fully set forth in the agreement, a substantial copy of which agreement is attached hereto and made a part hereof, marked Exhibit "A" SECTION 2. The necessity to authorize the City Manager to execute the hereinabove described agreement so that the citizens of Corpus Christi may view these historical artifacts creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the J � day of January, 1978. Section, 6 of the City Chart MICROFILMED IMIT JUL 0 71980 1A ig EXHIBITION LOAN AGREEMENT An exhibition entitled Treasure, People, ships and Dreams containing antiquities and data recovered from A.D. 1554 Spanish shipwrecks on the Texas Tidelands has been prepared by the 'Texas Antiquities Committee (TAC) for loan to various institutions. This self - contained exhibit consists of approximately exhibit cases, weighs 10,640 pounds, and occupies at least 2,400 square feet of floor space. A plan and photographs of the exhibit are available to qualified institutions from the TAC. A one -page, fold -up, illustrated brochure will be provided at nominal cost to hosting institutions for free public distribution. A comprehensive illustrated catalogue of the exhibit can be sold on a share of the profit basis. Bookings of this exhibit are valid only when made through.the TAC. The following agreement form must be completely filled in, signed by the contracting officer of the borrowing institution and returned to the Texas Antiquities Committee. The exhibit will be used for public educational purposes only. Na com- mercial use may be made of this exhibit. No entrance fee will be charged and no fund raising event will be held in connection with this exhibit. 2. 'It is agreed that the borrower of the exFiibit will provide full insurance ✓ coverage at borrower's sole expense and from an insurance carrier approved by TAC. Said insurance coverage shall be in the combined minimum amount of $145,000.00 and shall be made payable to TAC. The insurance coverage- shall be on an individual item by item basis and each item shall be covered by full insurance from the time it is delivered by a commercial mover, approved by TAC, to be transported to borrower's location; such insurance shall cover the exhibit the entire time that the exhibit is in the possession of the borrower or is under its direction and control. Under "direction and control" shall include the time the exhibit is in transit to borrower's location. Proof of insurance coverage will be mailed to TAC prior to the beginning of the loan period. TAC will provide an itemized list of exhibit contents for insurance purposes. 3. The borrower will make arrangements for a commercial mover approved by TAC to transport the.exhibit within four (4) days after the closing of the previous exhibition. The borrower shall pay in full all transporta- tion costs from the previous site. If the borrower wishes to provide their own transportation of the exhibit, means and methods of transporta- tion must meet the approval of the TAC. 4. The borrower agrees to provide docents for lecture tours of the exhibit for the general public, schools, and other organized groups. The TAC agrees to provide initial introductory training to the docent group of the borrowing institution. 5. The borrower must examine the exhibit upon receipt, report its condition on forms provided by TAC and mail said report within forty - eight (48) hours. Upon closing of the exhibit, a 'second condition report will be made promptly to TAC. 6. The borrower agrees to provide an opening reception with invitations sent to whomever they desire and to persons on a mailing list provided by the TAC. 7. Installation of the exhibit will be coordinated with the TAC represen- tative, Mrs. Cindy Sherrell, and will be carried out according to instructions provided by TAC. Minimal electrical requirements are three 35 -amp circuits. A fork lift is required for handling some exhibit specimens. 8. The borrower agrees to take all reasonable precautions for the protection of the exhibit while in their custody including appropriate precautions prescribed by fire department regulations, handling, unpacking and re- packing of the exhibit under professional supervision, and electronic and security guard protection against•damage or theft. Minimum security requirements will be negotiated with a representative of TAC_ 9. Cases may not be opened nor any repairs by undertaken without prior explicit permission from the TAC. Replacement of light bulbs will be done in accordance with instructions provided by TAC. 10. The borrower agrees to notify TAC immediately of any theft or damage occurring while the exhibit is in their,possession. The Borrower must.provide at least three installation photographs so TAC may have a permanent visual record of each installation. 12. The exhibit catalogue contains a capsule history of the shipwrecks, the archeological recovery and the conservation effort and is profusely Illustrated with graphics and photos of the antiquities. Retail price is $ and wholesale price is $ . The borrower agrees to handle the sale of the exhibit catalogue and to reimburse the TAC in the amount of the wholesale price. The borrower agrees to purchase an appropriate quantity of the brochure at cost and distribute it free to the public. 13. The TAC will provide the borrower with publicity materials. The borrower agrees to give credit to the TAC in all acknowledgments, printed material, press releases aA any other information released. The borrower agrees to send the TAC available press clippings, or press releases. 14. The TAC agrees to provide one copy of the film Graveyard of the GuZf which may be shown to the public while the exhibit is at the borrower's institution. The film is 16.mn. color, sound, about 35 minutes in length. 15. Cancellations are valid only when made in writing. A cancellation fee of $100.00 will be charged to the borrower. Postponements are considered cancellations. Application is hereby made for the exhibition "Treasure, People, Ships and Dreams" and the foregoing conditions approved. APPROVED BY: Title: R.
