HomeMy WebLinkAbout14405 ORD - 07/26/1978JKH:vp:7 /24/78:lst t ~� AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF THE CITY OF CORPUS CHRISTI AND HOLT - HULINGS REALTY COMPANY BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A, BEING A TRACT OF LAn OUT_•F-[t5'f ' __§,__TTQD_WfW-RU6RrFARM LOTS AND ON TRACT B, BEING TRACT OF LAND OUT OF LOT_ -R, DRICKS ADDITION, AS MORE FULLY DESCRIBED HEREINAFTER, SITU- ATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE- FAMILY DWELLING DISTRICT TO "I -2" LIGHT INDUSTRIAL DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of The City of Corpus Christi and Holt - Hulings Realty Company for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons / wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday , July 26. 1978 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: r • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same i ereby amended by making the change hereinafter set out. r CROFILMEQ, JUL 0 81980 1440 SECTION 2. That the zoning on Tract A, being a tract of land 'out of Lot 8, Baldwin -Moore Farm Lots and on Tract B, being a tract of land out of Lot 1 -R, Block A, Hendricks Addition, situated in the City of Corpus Christi, Nueces County, Texas and more particularly described hereinafter: TRACT A BEGINNING at a point in the common southeast corner of said Lot 8 and the northeast corner of Lot 9, said Baldwin -Moore Farm Lots, for the southeast corner and POINT OF BEGINNING of this tract; THENCE along the common east boundary line of said Lot 8, Baldwin -Moore Farm Lots, and the west boundary line of Lot 1, Cormar Industrial Tracts as shown by plat recorded in Volume 25, Page 65, Map Records, Nueces County, Texas N 00 °03'40" E 877.48 feet to a point being the southeast corner of Lot 1R, Block A. Hendricks Addition as shown by plat recorded in Volume 32, Page 19, Map Records, Nueces County, Texas for an exterior corner of this tract; THENCE with the south boundary line of the said Lot 1R, Block A, Hendricks Addition, N 89 °58'11" W 200.23 feet to an iron rod for the most southwesterly corner of said Lot 1R, Block A, for an interior corner of this tract; THENCE for the west boundary of said Lot 1R, Block A, Hendricks Addition, N 00 003'40" E 217.80 feet to a point in the south line of Hendricks Addition as shown by plat recorded in Volume 28, Page 55, Map Records, Nueces County, Texas for an exterior corner of this tract; THENCE along the south boundary line of said Hendricks Addition, N 89 058111" N 800.00 feet to a point for an exterior corner of this tract; Thence S. 42° 21' 21" E for a distance of 1,482.88 feet to the point of beginning,'such area containing approximately 11.574 acres, more or less. TRACT B BEING a portion of Lot 1 -R, Block A, Hendricks Addition as recorded in Volume 32, Page 19, Nueces County Map Records, Nueces County, Texas. BEGINNING at a 5/8 -inch iron rod in the southwest corner of Lot I -R, Block A, Hendricks Addition; _ THENCE North 00 °03140" East for a distance of 217.80 feet to a point for corner; THENCE South 89 °56'20" East for a distance of 200.00 feet to a point for corner; THENCE South 00 003140" West for a distance of 217.80 feet to a 5/8 -inch iron rod; THENCE North 89 °56'20" West for a distance of 200.00 feet to the POINT" OF BEGINNING, such area containing approximately 1 acre, more or less. be and the same is hereby changed from "R -1B" One Family Dwelling District to "I -2" Light Industrial District. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. , SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 26th day of JULY , 19 78 . BRUCE AYCOCK, CITY ATTORNEY By- Assistant C Attorney Corpus Christi, Te as _day of 19 ? y TO THE-MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
