HomeMy WebLinkAbout14799 ORD - 02/28/1979• jkh:2-27-79;lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT TO THE ENGINEERING CONTRACT WITH URBAN ENGINEERING FOR RESIDENT INSPECTION SERVICE IN CONNECTION WITH THE SLIP LINING OF McARDLE ROAD SANITARY SEWER TRUNK MAIN, AS MORE FULLY SET FORTH IN THE ENGINEERING CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute an amendment to the Engineering Contract with Urban Engineering for resident inspection service in connection with the slip lining of McArdle Road Sanitary Sewer Trunk Main, the contract originally having been authorized by Ordinance No. 14268, a copy of the amendment to the said Engineering Contract being attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to authorize execution of the aforesaid contract amendment in order that the McArdle Road Sanitary Sewer Trunk Main project may continue without delay, and that needed improvements and rehabili- tation may be completed at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the e2, day of February, 1979. BRUCE ,1#'COCK ,,,CITY ATTORNEY MAYOR THE CITY OF 14799 HRISTI, TEXAS MICROFV1FD '3UL 08 1980 • AMENDMENT NO. 1 TO CONTRACT FOR ENGINEERING SERVICES ON MCARDLE ROAD SANITARY SEWER SLIPLING URBAN ENGINEERING The City of Corpus Christi and Urban Engineering agree to the following amendment to the contract for engineering services regarding the sliplining of the McArdle Road Sanitary Sewer Trunk Main which was authorized by the City of Corpus Christi on April 12, 1978 by the passage of Ordinance No. 14268: SECTION A. SERVICES Urban Engineering agrees to perform in addition to the services outlined in Section C, 1 through 9 in the previously approved contract, Resident Construction Services as outlined below. 1. Provide resident inspection personnel and services for all phases of inspection at substantially all times the contractor is actively working on the project, provide detailed daily reports of construction activity, and mark up project plan prints with as -built changes and notes. 2. Coordinate day-to-day work details with the City and the Contractor as needed. SECTION B. LIMITATIONS The Engineer will, to the best of his ability and in accordance with prudent professional principles, judge and certify to the City whether, in his opinion, the Contractor has or has not complied with the terms of the construction contract. The Engineer does not undertake to guarantee that the Contractor will complete his work, that he will complete it within a certain time, or that defects will not exist in his work, and assumes no responsiblity for the job safety practices of the Contract, whether or not same are referred to in the construction speci- fications and contract documents. The Engineer does not undertake to guarantee that the cost of construction of the project will not exceed any certain amount, other than the Fees agreed to herein. SECTION C. COMPENSATION The City will compensate the Engineer for services rendered an amount not to exceed $17,837.22, based on an estimate of $2,972.87 per month over an estimated • • six-month construction period. Payments shall be made as follows: 1. After work begins, the Engineers may invoice the City on a monthly basis for partial completion as provided in E.P.A. Appendix C-1, Required Provisions, attached to original agreement authorized by Ordinance No. 14,268. 2. Requests for payment shall be accompanied by personnel time summaries, invoices and other supportive documentation. 3. Payments to the Engineer by the City are not to be construed as partial release or acceptance of the overall performance of the work called for under this contract. EXECUTED THIS day of , 1979.
