HomeMy WebLinkAbout15294 ORD - 01/02/1980jkh:12-26-79;lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF LAGUNA ESTATES, INC., BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT "A" FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT, AND CHANGING THE ZONING OF A PORTION OF TRACT "B" TO "A-1" APARTMENT HOUSE DISTRICT AND A PORTION OF SAID TRACT "B" TO "8-4" GENERAL BUSINESS DISTRICT, SAID TRACT "B" BEING PRESENTLY ZONED "R -1B" ONE FAMILY DWELLING DISTRICT AND "I-3" HEAVY INDUSTRIAL bISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Laguna Estates, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday December 26, 1979 , at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 15243.4 MICROFILMED AUG 28WOE. SECTION 2. That the zoning of Tract "A", hereinafter more fully described, be and the same is changed from "R -1B" One Family Dwelling District to "R-2" Multiple Dwelling District: TRACT A Being 4.5 acres, more or less, out of Lots 10,11,18 & 19,Section 54, Flour Bluff and Encinal Farm and Garden Tracts, and being more particularly described as follows: BEGINNING at a point along the easterly boundary of Lot 11, Section 54, from whence the most northeasterly corner of Lot 11 bears North 29°00'00" East, 930.00 feet; THENCE South 03°10'49" West, 344.48 feet; THENCE South 29°00'00" West, 390.00 feet to the northerly right-of-way of Purdue Road; - THENCE along said Purdue Road right-of-way, North 61°00'00" West, 330.00 feet; THENCE North 29°00'00" East, 700.00 feet; THENCE South 61°00'00" East, 180.00 feet to the POINT OF BEGINNING. That the zoning of the hereinafter described portion of Tract "B", presently zoned "R -1B" One Family Dwelling District and "I-3" Heavy Industrial District be changed to "A-1" Apartment House District: Being portions of Lots 10 and 19, Section 54, Flour Bluff and Encinal Farm and Garden Tracts as shown by map recorded in Volume A, Pages 41,`42 and 43, Map Records of Nueces County, Texas, and being more particularly described as follows: COMMENCING at the most northwesterly corner of Lot 10, Section 54, thence along the westerly boundary of Lot 10, South 29°00'00" West, 660.00 feet; THENCE South 61°03'20" East, 170.00 feet to the POINT OF BEGINNING of this tract; THENCE South 61°03'20" East, 430.00 feet; THENCE South 29°00'00" West, 960.00 feet to the northerly right-of-way of . Purdue Road; THENCE along said Purdue Road right-of-way, North 61°00'00" West, 450.00 feet; THENCE North 29°00'00" East 390.00 feet; THENCE North 03°10'49" East, 344.38 feet; THENCE South 61°00'00" East, 170.00 feet; THENCE North 29°00'00" East, 270.00 feet to the POINT OF BEGINNING of this tract: (Containing 9.80 acres, more or less) -2- That the zoning of the hereinafter described portion of Tract "B" be changed to "B-4" General Business District: Being portions of Lots 9, 10, 19 and 20, Section 54, Flour Bluff and Encinal Farm and Garden Tracts as shown by map recorded in Volume A, Pages 41, 42 and 43, Map Records of Nueces County, Texas, and being more particularly described as follows: COMMENCING at the most northwesterly corner of Lot 10, Section 54, thence -along the westerly boundary of Lot 10, South 29°00'00" West, 660.00 feet; THENCE South 61°03'20" East,,600.00 feet to the POINT OF BEGINNING of this tract; THENCE South 61°03'20" East, 60.00 feet; THENCE South 04°06'50" East, 52.69 feet; THENCE South 41°15'20" East, 153.75 feet; THENCE South 00°34'50" East, 138.32 feet; THENCE South 28°37'40" West, 172.38 feet; THENCE South 65°15'20" West, 336.25 feet; - THENCE South 61°03'20" East, 57.53 feet; THENCE South 29°00'00" West, 313.55 feet to the northerly right-of-way of Purdue Road; THENCE along said Purdue Road right-of-way, North 61°00'00" West, 161.92 feet; THENCE North 29°00'00" East, 960.00 feet to the POINT OF BEGINNING of this tract. (Containing 5.2 acres, more or less) _ SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates•a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency -3- and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the oZ day of 19 V..)
