PRESENT: Mayor Luther Jones Council Members: Dr. Jack Best David Diaz Ci i.ff Zarsky ABSENT: Mayor Pro Tem.Edward L. Sample Jack K. Dumphy Betty N. Turner City Manager R. Marvin -Townsend City Attorney J. Bruce Aycock City Secretary Bill G., -Read Mayor Luther Jones called the meeting to order at Travis Elementary • School and stated that the purpose of the meeting was to conduct -the Assessment` — Hearing on street improvements in the Broadmoor Park Area. Mayor -Jones welcomed the citizens to the meeting and introduced the members of the City Council who were present and the City staff. City Secretary Bill G. Read verified that the necessary quorum was present to conduct a legally constituted meeting. - City Manager R. Marvin Townsend informed the members of the audience that the purpose of the public hearing is to discuss the street improvement project and explain the assessments thatwillbe levied against the abutting property as - a part of the project. Mr. Townsend then asked City Attorney J. Bruce Aycock to conduct the first portion of the hearing. City Attorney Aycock explained the procedure to be followed and stated that the Council must determine from the testimony that the proposed assessments are no greater than the amount of the enhancement to the property. Mr. Aycock called as his first witness Mr. James K. Lontos, Director of Engineering and Physical Development, and ascertained through questioning that he is a registered Professional Engineer in the State of Teas and that he has been employed in his present position since 1973 and by the City of Corpus Christi since 1960. Mr. Lontos also testified that he is thoroughly familiar with the Broadmoor Park Street Improvements. - Minutes Special Council Meeting January 2, .1980 Page 2 Mr. Lontos explained that the Broadmoor Park Area Street Improvement project includes the following streets: 1. Niagara, Sarita, and Cleo Streets, from Baldwin Boulevard to South Port Avenue; 2. Sonora Street, from South Port Avenue to David Street; 3. McDaniel Street, from Sarita Street to David Street; and 4. Shely Street, from Niagara Street to David Street. He located the various streets on the map and stated that this project was included in the Community Development Program and is the result of Voluntary Paving petitions signed by property owners in the area. Mr. Lontos stated that the project includes new water. lines., as well as improvements to the streets, curbs, gutters and sidewalks. He noted that sidewalks currently exist on both sides of Niagara Street but the.staff recommends replace- ment of some of the sidewalks; however, if some of the sidewalks are in good condition, a credit will be allowed for those property owners. Mr. Lontos continued his presentation by informing the Council that the low bid of $821,493.55 was submitted by APCCO; the total preliminary .assessments will be $148,858.78; and the City's portion of the project is $672,634.77. He also explained the assessments that will be charged the property owners for various types of property, which is based on the kind of zoning that is in effect, noting that $.75 per square foot Is the maximum charge for sidewalks. He also explained that the property owners will be allowed five years at an interest rate of 5a to pay for their assessments, and in hardship cases, even a longer period of time will be allowed. City Attorney Aycock called as his next witness, Mr. William J. Holly, who testified that he was'a licensed Real Estate Broker in the City of Corpus Christi; that he is knowledgeable about real estate values in this City; and that he is quite familiar with this particular Broadmoor Park area and with each and every parcel of property affected by the street improvement project. Mr. Holly stated that after examining all of the property abutting the proposed street improvements, he had found only three pieces of property that are irregularly shaped and on which he recommends a reduction in the amount of their assessment. Mr. Holly stated that these pieces of property are as follows: i Minutes • Special Council Meeting January 2, 1980 Page 3 Item No. 69 - Mr. Wm. H. Holmes,- Lot B, Block C, Broadmoor Park 2 • Extension Recommended reduction: $572.95 Item No. 126 - Mr. Wm. H. Holmes - Lots 11 & 12, Block D. Broadmoor Park !/2 Recommended reduction: $581.27 Item No. 157 - Mr. Alonzo M. Gonzalez - Lot 1, David Brown Tract Recommended reduction: $816.49 Following Mr. Holly's testimony, Mayor Jones ascertained that 10 property owners were present to discuss their assessments. Mr. Jesse Suarez, 3101 David Street, inquired about the sewer line on David Street and Shely Street, stating that he understands that the sewer line is blocked in this area. Mr. Lontos replied that there are no plans to replace the sewer line as a part of this project; but the staff will investigate this and report to Mr. Suarez. Council Member Zarsky explained to Mr. Suarez that the City has a tele- vision camera with which sewer lines can be examined without necessitating tearing up streets to discover breaks and portions that might be blocked. Mrs. Alice V. Guerra, 2830 Sarita, who owns property listed as Item No. 89, questioned the driveway price on her property. - Mr. Lontos explained that compared to the cost for sidewalks, the drive- way costs might seem to be excessive but are actually much less than they would be if constructed by a private contractor at the property owner's request. Mrs. Guerra expressed appreciation that these improvements are being made to her street. Mayor Jones suggested that a staff member visit Mrs. Guerra to explain the assessment levied against her property for her driveway. Mrs. Eulalia Olivera, 2913 Niagara Street, Item No. 62, informed the Council that she has a driveway already as well as a new sidewalk. Mr. Lontos assured her that if the sidewalk is in good condition, she will be given a credit at the time of construction. fir. Joe Jiminez stated that he has a rent house on Niagara Street and asked how far beyond the street the driveway will extend. inutes . Special Council Meeting January 2, 1980 Page 4 Mr. Lontos replied that on Niagara Street, the driveways extend to the sidewalks. City Manager Townsend, noting that sidewalks already exist on Niagara Street and it is possible that some of the property owners will be granted a credit for existing sidewalks, suggested that any residents who live on Niagara Street submit their names, and if they are entitled to a reduction because of existing sidewalks, a report will be'provided•the Council next week. Mr. Eliseo C. Guerrero, 2746 Sarita Street, Items No. 81 and 168, asked • about the total charge for his assessments in the amount of $1,300.95. Mr. Marion Brown, Voluntary Paving Coordinator, explained to Mr. Guerrero that his property is a corner lot; the driveway for this property is 19 feet wide for an assessment charge of $526.69; and assured Mr. Guerrero that- if he decides a smaller driveway would be satisfactory, then his assessment could be reduced accordingly. 1 Mr. Guerrero stated that he really does need a driveway of that width. Mr. Gloria Candelario, 2713 Sarita Street, Item No. 103, stated that several years ago, his driveway Was torn up by the City and was never replaced. Mayor Jones inquired as:to whether or not Mr. Candelario knew why the driveway was torn up, and Mr. Candelario indicated that he did not know. Mr. Lontos explained that the driveway at this property was a concrete driveway that extended beyond the property line and into the right-of-way. He stated that it could have been torn up by the Cityin order to replace a water line. City Manager Townsend expressed the opinion that if it was a proper drive- way and the City did, in fact, destroy it, it should have been replaced. -He assured Mr. Candelario that the matter will be investigated. Mr. Townsend did explain, however, that on -all property on which concrete driveways are located, these drive- ways are being removed so that they will be up to standard; therefore, Mr. Candelario is receiving the same treatment as all other property owners. City Manager Townsend assured the property owners that if there are trees or other landscaping on their property, the contractor on the project will attempt to work with the property owners to save the trees. 'Minutes' Special Council Meeting January 2, 1980 Page 5 Mr. Lontos stated that the contract will be awarded next week and work will probably begin in about 30 days. Mr. Lontos then introduced other members of the Engineering staff as fol- lows: Mr. Marion Brown, Voluntary Paving Coordinator; Mr. Erasmo Garza, Mr. Dan Ambriz, and Mr. Harry Maxim, all in the Voluntary Paving Section; Mr.'Victor Medina, Construction Engineer; and Mr. Robert Garcia, who will be_thp construction inspector on the project.
