A RESOLUTION
•
WHEREAS, Resolution No. 15287, passed and approved by the City Council
on December 26, 1979, called for the improvement of McArdle Road and urged the
Texas Department of Highways and Public Transportation to proceed with all due
haste in the completion of the plans and specifications; and
WHEREAS, said resolution requested a construction starting date of no
later than July, 1980; and
WHEREAS, further discussion with the property owners along McArdle
resulted in a desire to limit construction activity during the Christmas shopping
season of 1980; and
WHEREAS, the discussions with property owners resolved various outstand-
ing questions regarding additional right-of-way dedication.
NOW, THEREFORE, it is hereby resolved that the following amendments
to Resolution No. 15287 be approved:
1. That the Department of Highways and Public Transportation be requested to
develop plans and specifications with the following basic roadway features:
A. McArdle Road from the western boundary of Padre -Staples Mall to Staples
Street be constructed 48 feet wide to provide two 18 -foot wide lanes,
one in each direction and a 12 -foot center left turn lane. The design
should include a right turn lane at Staples after the owners dedicate
an additional 8 feet; 2 feet for right-of-way and 6 feet for sidewalk
easement.
B. The section from Staples to Stratton Drive be constructed with two
moving lanes in each direction and a center left turn lane. The City
will accept dedication deeds of approximately 12 additional feet to
allow for the left turn lane. Right-of-way acquisition from the Texaco
Station at the intersection of Airline Road and McArdle is authorized
by this resolution.
C. The section from Stratton Drive to Crescent be transitioned from the
60 -foot to collector street section of 40 feet to be in line with the
rest of McArdle to Nile Drive.

2. That the timetable be modified to the extent that the City Council desires
to have construction started immediately after January 1, 1981.
3. That the City assures the Department of Highways and Public Transporta-
tion that all easement and right-of-way dedications and acquisition will
be completed by not later than June 1, 1980.
The necessity to immediately proceed with the plans and specifica-
tions for the improvement of the aforesaid portion of McArdle Road creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall be
read at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity exist, having requested the suspen-
sion of the Charter rule and that this resolution be passed finally on the
date of its passage, IT IS ACCORDINGLY SO RESOLVED, this the apday of
January, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
