HomeMy WebLinkAbout15342 ORD - 01/30/1980vp:1/30/80•]st AN ORDINANCE ABANDONING A 10 -FOOT UTILITY EASEMENT BETWEEN LOTS 18-22 AND 43-47 AND ALONG THE SOUTHERN BOUNDARIES OF LOTS 22 AND 47, BLOCK 12, FLOUR BLUFF PARK, SUBJECT TO DEDICATION OF ALTERNATE EASEMENTS; REPLATTING OF THE SUBJECT PROPERTY; RELOCATING OF ALL EXISTING UTILITIES; AND PROVIDING A SEWER LINE TO SERVE CITY PROPERTY LOCATED AT THE CORNER OF MC DONALD AND SOUTH PADRE ISLAND DRIVE AND THE PAYMENT OF $175 TO THE CITY TO KILL AN EXISTING GAS LINE WITHIN THE EASEMENT, ALL AT THE OWNER'S EXPENSE; AND DECLARING AN EMERGENCY. • WHEREAS, there exists a 10 -foot utility easement between Lots 18-22 and 43-47 and along the southern boundaries of Lots 22 and 47, Block 12, Flour Bluff Park, subject to dedication of alternate easements by the owner and sub- ject to other conditions set forth hereinafter. WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 10 -foot utility easement between Lots 18-22 and 43-47 and along the southern boundaries of Lots 22 and 47, Block 12, Flour Bluff Park, in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to dedication of alternate easements by the owner; replatting of the subject property; relocating of all existing utilities; and providing a sewer line to serve City property located at the corner of McDonald and South Padre Island Drive, with the City paying the difference in cost of an 8 -inch line as compared to a 6 -inch line, and the payment of $175 to the City to kill an existing gas line within the easement, all at the owner's expense. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public Q6\��o����0. 15342 ��® • • emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage.
