AN ORDINANCE
GRANTING CENTRAL POWER AND LIGHT COMPANY'S MOTION FOR
REHEARING AND UPON REHEARING REPEALING ORDINANCE NO. 15309
AND SUBSTITUTING THEREFOR THE FOLLOWING ORDINANCE:
MAKING FINDINGS OF FACT; APPROVING A NEW RATE SCHEDULE FOR
THE FURNISHING OF ELECTRICITY AND ELECTRIC SERVICE WITHIN
THE CITY OF CORPUS CHRISTI, TEXAS BY CENTRAL POWER AND LIGHT
COMPANY WHICH, IF IMPLEMENTED IN ALL AREAS SERVED BY CENTRAL
POWER AND LIGHT, WOULD BE REASONABLY CALCULATED TO YIELD AN
ADDITIONAL $65,471,000 IN REVENUES TO CENTRAL POWER AND
LIGHT; APPORTIONING THE REVENUE INCREASE TO EACH CLASS OF
SERVICE; DENYING PRICE ELASTICITY EFFECTS TO BE TAKEN INTO
CONSIDERATION IN DEVELOPING TARIFFS; REQUESTING A STUDY
ON THE RATE DIFFERENTIAL BETWEEN RESIDENTIAL AND COMMERCIAL
HOT WATER HEATING AND OTHER RESIDENTIAL AND COMMERCIAL USES
IN TARIFFS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Central Power and Light Company (CP&L) has appeared before
the City of Corpus Christi (the City) requesting a new rate schedule for
furnishing electricity and electric service within the City of Corpus Christi;
and
WHEREAS, the City has suspended implementation of the rate schedules
proposed by CP&L to become effective November 5, 1979 in order to permit the
City sufficient time to analyze the proposed rate changes; and
WHEREAS, the City Council has authorized the hiring of Touche-Ross
and Company, rate consultants, to study said request and report findings to
the City Council; and
WHEREAS, Touche-Ross and Company has completed their investigations
and presented the results and recommendations to the governing body of the
City both in proceedings as intervenors before the Public Utility Commission
in the rural rate case over which the Commission exercises original juris-
diction and in proceedings before the City Council in the exercise of its
original jurisdiction over electricity rates within the corporate limits of
the City; and
WHEREAS, Touche-Ross and Company has initially recommended that
CP&L be granted a $47,370,000 increase in revenues; and
WHEREAS, after the filing of Touche-Ross and Company's recommendation
it was determined that the cities in the CP&L service areas would increase
their municipal gross receipts tax from 2% to 4% with a resulting $5,878,000
cost increase to CP&L, and thus, Touche-Ross and Company has modified the
recommended revenue increase to $53,248,000; and

WHEREAS, CP&L has simultaneously appeared before the Public Utility
Commission for a rate increase in the rural areas and the Commission staff
has independently analyzed the rate increase request and recommended a
$71,492,000 revenue increase; and
WHEREAS, the parties to proceedings before the Commission in the
Commission's exercise of its original jurisdiction entered into a partial
compromise and settlement of that case which stipulated that the Commission
would allow increases designed to yield CP&L additional revenue of $65,471,000
per annum which stipulation was approved by the Commission; and
WHEREAS, the settlement amount, although in excess of the recommenda-
tion of the consultants retained by the City, was entered into based solely
upon assessment of probable greater allowance by the Commission absent said
stipulation and is not binding upon the City in the exercise of its original
jurisdiction; and
WHEREAS, the City has, after appropriate notice, opened a public
hearing on December 5, 1979 and continued as a recessed hearing on January 9,
1980; and
WHEREAS, at such hearings, representatives of CP&L, the City and
citizens appeared and gave evidence and testimony regarding the Company's
request for an electricity rate increase; and
WHEREAS, the City Council, after hearing all evidence regarding
said rate case, has carefully considered same and makes findings of fact in
this ordinance and finds that a new rate schedule hereinafter set forth is
fair, equitable, and reasonable; and
WHEREAS, CP&L has filed a Motion for Rehearing with the City
Council:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1A. That the Motion for Rehearing by Central Power and
Light Company is granted,and upon rehearing Ordinance No. 15309 is repealed
and the following provisions are substituted therefor:
SECTION 1. The City Council of the City of Corpus Christi finds that
the conclusions of Touche-Ross and Company are reasonable, but as a result of
a need to provide higher financial strength to attract capital because of high
construction costs involved in changing to other fuels, the City Council hereby

determines that CP&L is authorized to implement within the City, effective
February 4, 1980,rates as set forth in the Electric Rate Schedules and Terms
and Conditions,copies of which are attached hereto as Exhibit A and made a
part hereof, which Schedules and Terms and Conditions are hereby in all things
approved, ratified, confirmed, accepted and filed in substitution for any
and all Electric Rate Schedules and Terms and Conditions heretofore filed by
said Central Power and Light Company with this governing body which, if
implemented in all areas served by CP&L, would be reasonably calculated to
yield an additional $65,471,000 in revenues to CP&L.
SECTION 2. The City Council determines and hereby finds that in
order to collect the additional $65,471,000 in revenues the Company should
apportion said revenue increase to each class of service in accordance with
the cost of service allocation attached hereto as Exhibit B and incorporated
herein producing the return differentials by customer class of approximately
0.825 for residential; 1.132 for commercial and small industrial; 1.044 for
large industrials;. 1.095 for flat rates and 0.992 for municipal customers.
SECTION 3. The City Council determines and hereby finds that CP&L
should develop charges to recover from each class the above described amounts
using the same methodology as was utilized to develop the proposed charges
except that no price elasticity effects shall be taken into consideration.
SECTION 4. CP&L shall not include within its tariff any separate
charge for gross receipt taxes or any other lawful levies by incorporated
municipalities.
SECTION 5. CP&L is ordered to pay to the City the amount of funds
paid by the City to the Executive Committee of the cities served by CP&L
for rate consultants and attorneys to assist with the rate -making proceedings
as certified as necessary and reasonable to the Company by the Executive
Committee in this case and in the 1976 rate case on or before February 14,
1980. These total expenses are estimated to be $275,000.
SECTION 6. CP&L shall present to the City within six months from
the effective date of the rate changes authorized by this ordinance a study
of the rate differential between residential and commercial hot water heating
and other residential and commercial uses; analyzing the equity and reasons
for such differential and report on the feasibility of water heater tariffs.

SECTION 7. It is not intended that the provisions of this ordinance
shall in any way restrict or limit the power of rate regulation by the City, or
constitute a waiver of the right to redetermine the rates applicable within
the City at any time and require the furnishing to the City of such information
as the City may deem necessary for the purpose of considering any such redeter-
mination of rates.
SECTION 8. The charges and terms and conditions prescribed in this
ordinance shall apply to all electricity used by each customer with whom such
charges and terms and conditions are applicable as soon as practicable after
February 4, 1980.
SECTION 9. The City Secretary is hereby ordered to deliver a certified
copy of this ordinance to CP&L.

AVAILABILITY
This schedule is available for electric service used for residential purposes
in individual private dwellings and in individually metered apartments.
Where two housekeeping units are served through one meter, the minimum bill
and the kilowatt hour steps other than the water heater block will be doubled
for billing purposes. Where more than two housekeeping units or apartments
are served through one meter, billing will be on the applicable non-
residential rate.
TYPE OF SERVICE
The electric service furnished hereunder will be single phase, 60 hertz, at
the Company's standard secondary voltage. Three phase service will be
furnished as provided in Company's published Terms and Conditions Governing
Electric Service.

billed at the regular rate.
Water Heater Specifications
1. All single-family dwelling units and all multi -family dwelling units
having provisions for individual laundry facilities must have at least
one water heater having not less than 40 galldns capacity or must have
multiple heaters having a combined capacity of at least 50 gallons.

2. Individually metered mobile homes and multi -family dwelling units
without provisions for individual laundry facilities must have at
least one water heater having not less than 30 gallons capacity.
3. The capacity of any single heating element must not exceed 6,000 watts.
4. The heating elements of twin element water heaters will be so controlled
that not more than one element can operate at any one time.
Section 3
Space Heating Service Without Elect.ic Water Heater - Winter Months Only
When all electric service used on the premises is supplied through one meter,
and when electricity is the sole source of energy for all comfort heating on
the premises, and when all electric space heating equipment is permanently
installed, the first 500 Kwh used per month will be billed on the rate in
Section 1, and, during the Winter Months only, all kilowatt hours used in
excess of 500 will be billed at 1.45c per kilowatt hour. Iz

1. If kilowatt hours are less than 800, customers will be billed in
accordance with Section 2, at a rate of 1.57c per kilowatt
hour for the 400 kilowatt hour block provided therein.
2. If kilowatt hours are 800 or more, customers will'be billed in
accordance with Section 3 except at a rate of 1.23s per kilowatt
hour, for all kilowatt hours in excess of 500 kilowatt hours per
month.

AVAILABILITY
This schedule is available for service supplied in the lighting
of outdoor areae by means of mercury vapor or sodium vapor lamps
installed in luminaires. Lamps will be operated by photo -electric
control to provide lighting service from dusk to dawn, or -approxi-
mately 4.000 hours per year, except when controlled by a Customer -
operated switch. The 7,000 Lumen Lamp is available with amber or
plain refractors.

Company will, upon request of Customer, relocate or change any of
its facilities used in rendering service hereunder, insofar as it
may be practical and permissible, provided Customer pays to
Company at the time such change is made, all costs incurred by
Company in making the change.

TERMS AND CONDITIONS
Service will be furnished under Company's Rules and Regulations
Governing Electric Service. If an outage of a security light
maintained by Company occurs. Customer shall notify the Company
promptly at its nearest office of such outage and Company will be
allowed one working day, defined as any day other than a Saturday,
Sunday, or holiday, after such outage has been so reported in
which to restore the lamp to service. If Company fails to restore
any lamp which it is obligated to maintain to service within one
working day after official notice from Customer of the outage,
Customer shall be entitled to a credit for the pro rata cost or
charge by Company for such lamp for the period of time it remained
out subsequent to the expiration of one working day after official
notice of the outage.
Company will, upon request of Customer, relocate or change any of
its facilities used in rendering service hereunder insofar as it
may be practical and permissible, or will render service under any
other security lighting service rate offered by the Company provided
Customer pays to. Company. at the time such change is made or such
different security lighting service is rendered, all costs incurred
by Company in making the change, including costs of equipment or
facilities rendered unusable by reason of the change of facilities
or service.

interval or for use of Customer's connected load, instead of measured
kilowatts, to determine the Customer's maximum kilowatts for billing
purposes.

TOWER FACTOR CLAUSE
The Company reserves the right to make tests from time to time to determine
the power factor of the Customer's installation. Should the average lagging
power factor during the month be below 80%, the number of kilowatts furnished
the Customer will be increased for billing purposes by 0.4% for each 1% by
'which the average lagging power factor is below 80%.
RIMARY VOLTAGE DISCOUNT
If the'electric service is delivered at primary voltage of the distribution
system and if the Customer owns, operates, and maintains all the facilities
for receiving such service at delivery voltage, a discount of 10 cents per
kilowatt of created demand will be made on the demand charge.
TRANSMISSION VOLTAGE DISCOUNT
If the electric service is rendered and metered at Transmission Line Voltage
(69,000 volts or higher) and if the Customer owns, operates, and maintains
all the facilities for receiving such service at delivery voltage, an
additional discount of 10 cents per kilowatt of created demand will be
made on the demand charge.
IETERING VOLTAGE
If either primary or transmission voltage is metered on the secondary sine
of the transformer, 1.5 per cent of the metered Kwh will be added to cover
transformer losses.

This schedule is available for primary service on an annual basis where
the Customer furnishes, installs and maintains all transformers and dis-
tribution facilities from and at a point of delivery to be designated by
the Company. The minimum billing demand will be determined by Company
based on consideration of Customer's connected load and operation condi-
tions but in no event will the minimum monthly billing demand be less
than six hundred (600) kilowatts. Service will be supplied to the
entire premises through a single delivery and metering point and at a
single voltage.
This schedule is not available for standby, temporary, or resale except
in conjunction with applicable rider.
TYPE OF SERVICE
Single or three phase, 60 hertz, service will be supplied at Company's
standard primary voltage.
MONTHLY RATE
Demand Charge
$3,704.56 for first 600 kilowatts, or less, of billing demand.

Minimum Monthly Bill
The minimum monthly bill will be the demand charge, but not less than

DETERMINATION OF BILLING DEMAND
The Customer's billing demand will be the kilowatt load established by
Customer during the 15 -minute period of maximum use during the month
but not less than 600 kilowatts.
POWER FACTOR CLAUSE
The Company reserves the right to make tests from time to time to
determine the power factor of the Customer's installation served here-
under. Should the average lagging power factor during the month be
above 90%, the number of kilowatts furnished to Customer will be
decreased for billing purposes by 0.4% for each 1% by which the average
lagging power factor is above 90%. Should the average lagging power
factor during the month be below 80%, the number of kilowatts furnished
the Customer will be increased for billing purposes by 0.4% for each
1% by which the average lagging power factor is below 80%.
TRANSMISSION VOLTAGE DISCOUNT
If the electric service is rendered and metered at Transmission Line
Voltage (69,000 volts or higher) and if Customer owns, operates, and
maintains all the facilities for receiving such service at delivery
voltage, a discount of 10 cents per kilowatt of created demand will be
made on the demand charge.
METERING VOLTAGE
If service is metered on the secondary side of the transformer, 1.5
percent of the metered kwh will be added to cover transformer losses.
If transmission voltage is metered on the secondary side of the trans-
former, 1.5 percent of the metered kwh will be added for transformer
losses.

Service will be furnished under Company's Rules and Regulations Governing
Electric Service.

AVAILABILITY
This schedule is available under Company's Contract for Electric Service
and is applicable to all electric service other than separately metered
lighting furnished to cotton gins.
Service will be furnished through one meter, at one point of delivery
and at one voltage, and any additional transformation necessary will be
supplied by Customer.
Any service used during the off-season will be billed under one of
Company's rate schedules applicable to the class of service furnished.
Customer's Operating Season will start of each year, or
such later date as Customer first takes service, but not later than
of each year, and will end not later than the following
. The above season shall not be for a period longer than
six months.
TYPE OF SERVICE
Single or three phase, 60 hertz, service will be supplied at Company's
standard secondary voltage.
MONTHLY RATE
Demand Charge
$5.88 each kilowatt of billing demand but not less than $29.38.
Plus an Energy Charge
.$0.0099 per Kilowatt hour used
In any month, should the net cost per kilowatt hour when billed on the
above rate exceed 6.86p per kilowatt hour which rate does not incluJe
fuel cost adjustment, then such billing shall be waived and all kilowatt
hours used that month will be billed at the rate of 6.860 per kilowatt hour.
CENTRAL POWER AND LIGHT COMPANY
Minimum Seasonal and Monthly Billing
Customer shall pay to Company hereunder during each Operating Season not less
than $17.63 per kilowatt of the highest maximum demand or 60% of the connected
load whichever Is the greater, said payment to be made in monthly installments
as follows:
Beginning with the bill rendered for service used during the first month of
each operating season not_less than $5.88 per kilowatt shall be paid each
month until Customer shall have paid the Company for service rendered during
the Operating Season not less than $17.63 per kilowatt of the highest maximum
demand established, or 60% of the connected load, whichever is the greater.
All amounts by which such minimum monthly payments may have exceeded Customer's
monthly bills under the above rate will be carried on the books of the Company
as a credit available only to apply to payment for service furnished hereunder
between the time the seasonal minimum has been fully paid and the expiration
of such operating season.
Operating season as used herein will mean and be any operating season
commencing on the effective date or any anniversary of the effective date
of the operating season as set out in a preceding section of this schedule.
..The Customer's connected load will be the sin of the manufacturer's name
plate ratings of all motors connected. One horsepower will be considered
750 watts.

The above rate is subject to the provisions of Sheet No. 01-1, Section D:
Rules and Regulations Governing Electric Service.
TERMINATION OF BILLING DEMAND
The Customer's billing demand will be the kilowait load established by

DETERMINATION OF BILLING DEMAND
Should Customer's monthly energy consumption be less than 1,000 kilowatt
hours, the billing demand will he estimated and will be equal to one kilo-
watt per horsepower of largest motor or other inductive -type electric device
connected, but not less than five kilowatts. Should Customer's monthly energy
consumption exceed 1,000 kilowatt hours, the Customer's billing demand will

DETERMINATION OF BILLING DEMAND
The customer's billing demand will be the kilowatt load established during
the 15 -minute period of maximum use during the month but not less than
15 kilowatts.
POWER FACTOR CLAUSE
The Company reserves the right to make tests from time to time to determine
the power factor of the Customer's installation. Should the average lagging
— power factor •lqring the month be below 80%, the number of kilowatts fur-
nished the Customer will be increased for billing purposes by 0.4% for each
1% by which the average lagging power factor is below 80%. For Customers
whose maximum kilowatt demand exceeds 600 Kw, should the average lagging
power factor be above 90%, the number of kilowatts furnished to Customer
will be decreased for billing purposes by 0.4% for each 1% by which the
average lagging power factor is above 90%.
PRIMARY VOLTAGE DISCOUNT
If the electric service is delivered at primary voltage of the distribution
system and if the Customer owns, operates, and maintains all the facilities
for receiving such service at delivery voltage, a discount of 10 cents per
kilowatt of created demand will be made on the demand charge.
TRANSMISSION VOLTAGE DISCOUNT
If the electric service is rendered and metered at Transmission Line Voltage
(69,000 volts or higher) and if the Customer owns, operates, and maintains
all the facilities for receiving such service at delivery voltage, an
additional discount of 10 cents per kilowatt of created demand will be made
on the demand.charge.
IETERING VOLTAGE
If either primary or transmission voltage is metered on the secondary side
of the transformer, 1.5 percent of the metered Kwh will be added to cover
transformer losses.

.This schedule is available under Company's contract for electric service
and will be applied to electric service furnished for irrigation pumping
installations having motors of five horsepower or more connected.
This schedule is available for irrigation pumps only, and is not avail-
able for resale, temporary, standby, or other service.
TYPE OF SERVICE
Three phase, 60 hertz, service will be supplied at Company's standard
secondary voltage.
MONTHLY RATE
Demand Charge
$2.45 per kilowatt of maximum demand, but not leas than $12.26 II

2.100 each for all kilowatt hours used.
In any month in which the net cost to Customer for service under the above
quoted rate exceeds 4.55.0 per kilowatt hour, Customer's bill will be I I
computed on the basis of 4.550 per kilowatt hour provided this will not I
suspend any requirements with reference to minimum annual or monthly
bills or payments.
Minimum Annual and Monthly Billing
Customor shall pay to -the Company hereunder during each contract year
not less than $17.92 per horsepower of connected load in monthly payments
as follows: Beginning with the first month of each contract year, there
will be paid not less than one -twelfth of the total annual guarantee for
that year, and in connection with the second monthly bill for said
contract year, there will be paid an amount sufficient to bring the
payments for said year up to a figure equal to at least two -twelfths of
the annual guarantee for said year, and similarly thereafter there will
be paid, for and in connection with each month's operation, an amount
sufficient to bring the payments for said year of operation up to a
figure which bears the same ratio to the annual guarantee for that year
as the portion of the year which has expired bears to the entire year.

Any and all amounts by which said monthly installments of such minimum
monthly payments may have exceeded Customer's monthly bill under the
above tale will be carried on the books of the Company as a credit
available only to apply to payment for electric energy furnished
during the remainder of. the then current contract year.
Contract year, as used herein, will mean and be the fiscal year beginning
with the date service furnished hereunder is initially connected or
anniversary of the date service was initially connected. In case the
initial connect date differs from the effective date of contract,
contract will be considered as expiring with a contract year.
Connected load as used herein will mean and be the total of all motors
connected as determined by the manufacturer's nameplate ratings, but
not less than the connected load shown in Paragraph 1 of the Electric
Service Contract.

-meter and at a nominal secondary voltage. Any additional transformation
necessary will be supplied by customer.
This schedule is not available for :standby, temporary, resale service or for
only the auxiliary equipment of irrigation pumping plants.

Three phase, 60 hertz service wi.11 he supplied at Company's standard

MONTHLY RATE

Minimum Annual and Monthly Payment
During each year of operation under this contract, customer will pay to
Company a minimum annual payment of not less than an amount computed on
the basis of the number of horsepower of Customer's connected load, as

AVAILABILITY
Available to political subdivisions and eleemosynary institutions
for street lighting service on public streets and highways, in
public parks, and upon the grounds of schoolyards or educational
institutions by means of lamps installed in (a) overhead fixtures
supported by poles of the Company's existing distribution system,
or.(b) ornamental standards conforming to standard specifications
and mutually satisfactory to both the Customer and the Company.
Lamps may be -supplied from either series or multiple systems and
from overhead or underground circuit at the option of the Company.
Service includes maintenance, lamp renewal and energy; except that
where the lighting fixture is owned, operated and maintained by
the Customer, service includes energy only.

This rate is available to political subdivisions and eleemosynary
institutions for the lighting of public streets.
TYPE OF SERVICE
Service is to an ornamental type unit consisting of a metal or
fiberglass pole with a 7,000 -Lumen mercury vapor or a 10,000 -Lumen
sodium vapor lamp in a promenade -type luminaire of aluminum finish.
Company will own, install, and maintain lighting equipment and will
furnish and control the electric energy necessary for dusk -to -dawn
every night, lighting service.

This schedule is available to municipalities, counties, schools or other
institutions of education not organized for profit, and the State Highway
Department for electric service to traffic control signals and signs, where
the signals and signs and related facilities are owned, operated, and main-
tained by the Customer, and where service facilities of suitable voltage are
adjacent to the location to be served.
MONTHLY RATE
(A) Flasher Type Signals
(1) $2.o5 per month for a fixture having not more than 75 watts
in lamps connected.
(2) When the total wattage of the fixture or fixtures served by
one service drop exceeds 75 watts, billing will be at the
rate of 2.73c per kilowatt hour used. Monthly Kwh use, for
billing purposes, will be estimated by Company, based on
data supplied by Customer on each signal's wattage and hours
of operation, but the monthly charge will be not less than
$2.05.

Electric service furnished for the lighting of traffic
directing signs operated and controlled by and through a

Customer on each sign's wattage and hours of operation.
(2) Signs served by individual service drops, where the signs are
not served by the same circuit and controls as the street
lighting system, will be billed at the rate of 2.73¢ per Kwh,

TERMS AND CONDITIONS
Service will be furnished under Company'e Rules and Regulations
Governing Electric Service and the following additional terms and
conditions pertaining to this tariff:
The Company will furnish to Customer electrical energy and street
lighting service for the operation from dusk to dawn of street
lights served under this tariff provided that the cost of installa-
tion
of each lamp, including wooden pole mounted brackets or orna-
=mental standards and the required circuit installed by the Company
is no more than $150 on wooden pole mounted brackets, $300 on orna-
mental standards, or $ 450 in the case of twin lamps mounted on one
ornamental standard. Costs of installation in excess of those stated
here will be reimbursed Company by Customer by nonrefundable payment
and Customer will not require any title in and to said facilities
by reason of such payment.
Company will, upon request of Customer, relocate or change any of
its facilities used in rendering service hereunder insofar as it
may be practical and permissible, or will render service under any
other public street lighting service rate offered by the Company
provided Customer pays to Company at the time such change is made
or such different street lighting service rendered all costs incurred
by Company in making the change, including coats of equipment or
facilities rendered unusable by reason of the change of facilities
or service.

If an outage of a street light. maintained by Company occurs, Customer
shall notify the Company promptly,at its nearest office of such outage
and Company will be allowed five7.4eye after such outage has been so C
reported in which to restore the lamp to @fervid*. If Company fails
to restore any lamp which it is obligated to maithtain to service
within five days after official notice from Customer of the outage, C
Customer shall be entitled to a credit for the pro rata cost or
charge by Company for such lamp for the period of time it remained

TERMS AND CONDITIONS
Service will be furnished under Company's Rules and Regulations Govern-
ing Electric Service and the following additional terms and conditions
pertaining to this rate:
1. Service will be supplied through a separate circuit which will be in-
stalled by Customer to which no equipment except the heating elements
of the water heater may be connected. This service will be measured
through a separate meter owned and maintained by the Company and
located at the point of delivery for Customer's regular service.
2. The capacity of the individual heating elements will not exceed 225
watts per gallon of storage tank capacity or 54 kilowatts per storage
tank.
3. All multiple dwelling units having provisions for individual laundry
facilities must have at least one 40 gallon capacity water heater when
each dwelling unit is provided with an individual water heater unit.
If laundry facilities are not. provided for the individual dwelling
unit, the water heater size may be reduced to 30 gallon capacity. The
capacity of any single dwelling unit heating element will not exceed
6,000 watts. The heating elements of twin element water heaters will
be so controlled that not more than one element can operate at any
one time.

4. Application of this rider other than as shown in #3 will require at

circuit will be installed by Customer and will be terminated at metering
point for Customer's regular service and will be used only to supply service
to equipment used for comfort space heating ur to an integral all -electric

AVAILABILITY
This Rider is available to Customers receiving service at transmission
voltage on Company's Large Industrial Power Rate Schedule 39 for amounts
of power in excess of Firm Power supplied under Schedule 39.
The availability of service under this Rider is subject to the Company,
at its sole discretion, having sufficient capacity to make available,
during Off -Peak hours, this service, and is subject to Company's ability
to obtain and use sufficient fuel for the generation of all the electric
power and energy required by Company's customers.
MONTHLY RATE
Demand Charge
For power supplied up to the then current Contract Capacity established
for Firm Power under Company's Large Industrial Power Rate Schedule 39,
whether supplied during On -Peak or Off -Peak hours, the charge shall be
$5.22 per KVA of the created demand or 80% of the Contract Capacity,
whichever is greater.
For power supplied during Off -Peak hours in excess of the then current
Firm Power Contract Capacity the charge shall be $1,45 per KVA.
Energy Charge
For energy supplied, charges shall be calculated as per Company's Lai,e
Industrial Power Rate Schedule 39.
DETERMINATION OF OFF-PEAK BILLING DEMAND AND CONTRACT CAPACITY
Off -Peak Billing Demand is the average KVA supplied during the thirty
minute period of maximum use during the Off -Peak hours of the billing month
in excess of the On -Peak KVA billing demand.
Firm Power Contract Capacity, as modified by this Rider, shall be the .verage
KVA supplied during the thirty minute period of maximum use during On -Peak
hours of any billing month, but not less than 40,000 KVA.
DEFINITION OF ON -PEAK AND OFF-PEAK HOURS
For the purpose of this Rider, On -Peak shall mean those period of time
falling between the hours of 8 AM and 10 PM, Monday through Friday, on any
date from June 1 to September 30, inclusive, except Labor Day and Independence
Day. If the latter falls on Sunday, the following Monday shall not be
considered On -Peak. All other times are Off -Peak.

DEFINITION OF INTERRUPTIBLE POWER
Interruptible Power is power and energy in excess of Firm Power and
energy contracted for under Company's Large Industrial Power Rate
Schedule 39 that the Company shall make available to, the Customer
subject to the provisions of this Rider. The Company shall make
reasonable efforts to make said interruptible power available to
Customer at said point of delivery.
At any time, the Company may withdraw all or any part of the inter-
ruptible power, with or without notice to the Customer. Company agrees,
after the withdrawal of interruptible power, to notify Customer's
plant operator and furnish available information as to the withdrawal
of such power. By verbal notice to Customer's plant operator, Company
will declare when interruptible power is again available.
