HomeMy WebLinkAbout15355 ORD - 02/13/1980• • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO CONVEY BY SPECIAL WARRANTY DEED TO QUINTANA -HOWELL JOINT VENTURE, A TRACT OF LAND DESCRIBED AS THE 0.794 ACRE TRACT OUT OF THE KALER 5.8 ACRE TRACT, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FOR A CONSIDERATION OF $30,101.00 ALL AS MORE FULLY SET FORTH IN THE SPECIAL WARRANTY DEED, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; r.• AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to convey by Special Warranty Deed to Quintana -Howell Joint Venture, a tract of land described'Das the 0.794 acre tract out of the Kaler 5.8 acre tract, in the City of Corpus Christi, Nueces County, Texas, for a consideration of $30,101.00 all as more fully set forth in the Special Warranty -Deed, a copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to immediately authorize the execution of a deed in order to facilitate the sale of the above described parcel of land creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after is passage, IT IS ACCORDINGLY SO ORDAINED this the day of ��''`� , 1980. BRUCE AYCOCK, CITY A RNEY 1.5355 THE o TY OF CORPUS CHRISTI, TEXAS SPECIAL WARRANTY DMA) THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES That the City of Corpus Christi, hereinafter called Grantor, for and in consideration of the sum of Thirty Thousand One Hundred and One Dollars ($30,101) to Grantor in hand paid by Quintana -Howell Joint Venture, the receipt of which is hereby acknowledged and for which no lien is retained, either expressed or implied, has this day sold and by these presents does GRANT, BARGAIN, SELL and CONVEY unto the said Quintana -Howell Joint Venture all that certain tract or parcel of land lying and being situated in the County of Nueces, State of Texas, more particularly described as follows, to -wit: Being an irregularly shaped tract of land out of that portion of the Kaler 5.8 acre tract conveyed to the City of Corpus Christi, Texas by warranty' deed as recorded in Volume 873, Page 141, Deed Re- cords, Nueces County, Texas and more particularly described by metes and bounds as follows: Beginning at a point on the easterly right-of-way line of McBride Lane being 50 feet wide at this point, said point being the northwest corner of Lot 2E, Ehler Garden Tract as recorded in Volume 25, Page 61, Map Records, Nueces County, Texas; Thence N. 17° 16' E., along the easterly right- of-way line of abovementioned McBride Lane, said right-of-way line being 30 feet easterly of and parallel to the original centerline of said Mc- Bride Lane, a distance of 48.o feet to a point; Thence N. 78° 21' E., a distance of 77.0 feet to a point; Thence N. 17° 16' E., a distance of 52.0 feet to a point on the northerly boundary line of City owned property as described in abovementioned deed of record; Thence N. 78° 21' E., along said property line, a distance of 308.95 feet to a point being the north- east corner of this tract; Thence S. 17° 16' W., along the easterly boundary line of said City property, a distance of 100.0 feet to a point being the common southeast corner of said City property and the northeast corner of abovementioned Lot 2E; Thence S. 78° 21' W., along the common southerly boundary line of said City property and the -1- northerly boundary line of said Lot 2E, a distance of 385.95 feet to the place of beginning and con- taining 0.791+ acres, more or less. TO HAVE AND TO HOLD the above described premises herein conveyed, together with all and singular the rights and appurtenances thereto in anywise belonging to the said Quintana -Howell Joint Venture, its suc- cessors, assigns, forever and Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend all and singular the said premises herein conveyed against every person whomsoever law- fully claiming or to claim the same or any part thereof by, through, or under Grantor, but not otherwise.
