AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 2
TO THE CONTRACT WITH HELDENFELS BROTHERS, INC. FOR IMPROVE-
MENTS TO THE CORPUS CHRISTI BEACH SANITARY SEWERS, WHICH
PROVIDES FOR THE CONSTRUCTION OF FIVE NEW MANHOLES IN LIEU
OF REHABILITATION OF THESE MANHOLES, A SUBSTANTIAL COPY OF
WHICH CHANGE ORDER IS ATTACHED HERETO, MARKED EXHIBIT "A",
AND MADE A PART HEREOF; APPROPRIATING $4,600 OUT OF THE
NO. 250 SANITARY SEWER BOND FUND APPLICABLE TO PROJECT
NO. 250-77-21, BROADWAY SEWER LINES AND LIFT STATIONS -
CORPUS CHRISTI BEACH AREA; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. That the City Manager be authorized to execute Change
Order No. 2 to the contract with Heldenfels Brothers, Inc. for improvements
to the Corpus Christi Beach Sanitary Sewers, which provides for the construc-
tion of five new manholes in lieu of rehabilitation of these manholes, a sub-
stantial copy of which change order is attached hereto, marked Exhibit "A",
and made a part hereof.
SECTION 2. That there is hereby appropriated the sum of $4,600
out of the No. 250 Sanitary Sewer Bond Fund applicable to Project No. 250-77-21,
Broadway Sewer Lines and Lift Stations - Corpus Christi Beach Area.
SECTION 3. The necessity to authorize execution of the change order
and appropriation of the sums necessary to proceed with the improvement project
aforesaid creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor, having declared
that such emergency and necessity exist, having requested the suspension of the
Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the /3 day of.u.y ,

THIS WORK WAS FOUND NECESSARY DURING CONSTRUCTION AND WAS AUTHORIZED BY THE ENGINEERS ON
EMERGENCY BASIS, AT CONTRACT UNIT PRICES.
Why was this change necessary? (If left off the plans and specifications, explain why.)
During construction several existing manholes were found to be so deteriorated structurally
that it was unwise to attempt to reuse or repair them. Extreme infiltration also existing
because of loss of bricks and mortar.
How can similar changes be avoided in the future? Provision could be made to construct all new
manholes in lieu of attempting to salvage old ones.

For the reasons set forth in the emergency clause of the foregoing ordinance„ a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally an
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
