AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A SUBLEASE. FOR
JOINT USE OF PREMISES BETWEENTHE-TEXAS EMPLOYMENT COM-
MISSION AND.THE CITY. FOR 2,701 SQUARE FEET.OF OFFICE
SPACE IN A BUILDING LOCATED AT 4410 DILLON LANE FOR A
MONTHLY RENTAL OF $1,175, FOR A TERM BEGINNING FEBRUARY
1, 1980, AND CONTINUING ON A MONTH-TO-MONTH BASIS UNTIL
ALL STAFF ARE RELOCATED TO THE EMPLOYMENT OPPORTUNITIES
PILOT PROGRAM (EOPP) CORPUS CHRISTI FIELD CENTER, ALL AS
SHOWN AND MORE FULLY SET FORTH.IN THE SUBLEASE, A SUB-
STANTIAL COPY OF WHICH IS HERETO ATTACHED AND MADE A PART
HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute a sublease
for joint use of premises between the Texas Employment Commission and the City
for 2,701 square feet of office space in a building located at 4410 Dillon
Lane for a monthly rental of $1,175 for a term beginning February 1, 1980, and
continuing on a month-to-month basis until all staff are relocated to the
Employment Opportunities Pilot Program (EOPP) Corpus Christi Field Center, all
as shown and more fully set forth in the sublease, a substantial copy of which
is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the aforesaid
sublease at the earliest practicable date to afford needed space for the City
of Corpus Christi creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordinance
or resolution shall be readat three. several meetings- of the City Council,
and the Mayor, having declared that such emergency and necessity exist, and
having requested the suspension of the Charter rule and. that this ordinance
be passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

SUBLEASE FOR JOINT USE OF PREMISES
THE STATE OF TEXAS II
COUNTY. OF NUECES
WHEREAS, the Texas Employment Commission hereinafter referred to as
the Commission, and the City of Corpus Christi, Texas, hereinafter referred to
as City, desire to jointly occupy and use an office space for the administration
of the Employment Opportunities Pilot Program (EOPP) in conjunction with the
Commission's Work Incentive Program (WIN); and
WHEREAS, the Commission, as lessee, and Port Ayers Associates, Inc.,
as lessor, have previously entered into a two year lease of approximately 5,796
square feet of office space in a building at 4410 Dillon Lane, as more fully
described below; and
WHEREAS, the City presently has certain Employment Opportunities
Pilot Program (EOPP) personnel in portions of said office space as part of its
contract with the Commission, such personnel comprising 45.2% of the total staff
personnel employed at the said Commission's lease site; and
WHEREAS, the City and the Commission desire to enter into this sub-
lease for joint use of a portion of the Commission's leased premises:
NOW, THEREFORE, the City and the Commission agree as follows:
1. Premises. The Commission hereby subleases for the joint use of
the City and the Commission, approximately 2,701 square feet of office space
in a one-story masonry commercial building containing approximately 5,796 square
feet of office floor space located on a portion of 6.485 acres, more or less,
being all of Lot C-1, Hamlett-Rychetsky Tract, as shown by plat recorded in
Volume 34, Page 143, Map Records, Nueces County, Texas, and all of Lot D-4,
Hamlett-Rychetsky Tract, as shown by plat recorded in Volume 37, Page 99, Map
Records, Nueces County, Texas, identified locally as 4410 Dillon Lane.
2. Term. The term of this sublease shall begin on February 1, 1980,
and will continue on a month-to-month basis until all Employment Opportunities
Pilot Program (EOPP) personnel have been relocated to the permanent Employment
Opportunities Pilot Program (EOPP) Carpus Christi Field Center.
3. Rent. The City shall pay the Commission the monthly rental of
one thousand one hundred seventy-five dollars ($1,175), said monthly rental not
to be paid in advance, but to be billed by the Commission on the first day of each

month and to be paid by the City to the Commission,'not later than the 15th
day of each succeeding month.
4. The Commission agrees to furnish at its own expense the following:
A. water and sewer services;
B. utilities; and
C. janitorial services.
5. Fixtures. Any fixtures, furniture or equipment which is installed
by the City shall remain the property of the City and may be removed at any time.
6. Cancellation. This sublease agreement may be cancelled by either
party on the last day of any calendar month upon giving thirty (30) days' written
notice to the other party.

We hereby authorize the Texas Employment Commission the expressed
consent to sublet parts of the Commission's leased property at 4410 Dillon
Lane to the City of Corpus Christi for the operation of the Employment
Opportunities Pilot Program. The Texas Employment Commission will pay all
rents and the lessor will hold the Texas Employment Commission responsible
for all rents and conditions of this lease,

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
