AUTHORIZING THE FILING OF A GRANT APPLICATION FOR
SECTION 5 FUNDS IN THE AMOUNT OF $778,455 FOR
FISCAL YEAR 1979-80 WITH THE DEPARTMENT OF TRANS-
PORTATION, UNITED STATES OF AMERICA, UNDER THE
URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED;
DESIGNATING THE CITY MANAGER AS THE AUTHORIZED
REPRESENTATIVE; AUTHORIZING HIM TO SIGN SAID
GRANT APPLICATIONS AND ANY OTHER NECESSARY
DOCUMENTS REQUIRED TO SUBMIT THE APPLICATION AND
ALL DOCUMENTS NECESSARY TO ACCEPT THE GRANT UPON
ITS APPROVAL BY DEPARTMENT OF TRANSPORTATION; AND
DECLARING AN EMERGENCY.
WHEREAS, the Secretary of Transportation is authorized to make
grants for mass transportation projects; and
WHEREAS, the contract for financial assistance will impose
certain obligations upon the applicant, including the provision by it of
the local share of project costs; and
WHEREAS, it is required by the U. S. Department of Transportation
in accord with the provisions of Title VI of the Civil Rights Act of 1964,
that in connection with the filing of an application for assistance under
the Urban Mase Transportation Act of 1964, as amended, the applicant give an
assurance that it will comply with Title VI of the Civil Rights Act of 1964
and the U. S. Department of Transportation requirements thereunder; and
WHEREAS, it is the goal of the applicant that minority business
enterprise be utilized to the fullest extent possible in connection with
this project, and that definitive procedures shall be established and
administered to ensure that minority businesses shall have the maximum
feasible opportunity to compete for contracts when procuring construction
contracts, supplies, equipment contracts, or consultant and other services:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY, COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized to execute
and file an application for $778,455 for Fiscal Year 1979-80 on behalf of the
City of Corpus Christi, Texas, with the U. S. Department of Transportation, to
aid in the financing of operating assistance projects pursuant to Section 5
of the Urban Nass Transportation Act of 1964, as amended, and to sign any
documents and certifications required to submit the application.

SECTION 2. That the City Manager is hereby authorized to
execute and file with such application an assurance or any other document
or documents required by the U. S. Department of Transportation effectuating
the purpose of Title VI of the Civil Rights Act of 1964.
SECTION 3. That the City Manager is hereby authorized to
furnish such additional information as the U. S. Department of Transportation
may require in connection with the application or the project.
SECTION 4. That the City Manager is authorized to set forth and
execute affirmative minority business policies in connection with the project's
procurement needs.
.SECTION 5. That the City Manager is authorized to execute grant
contract agreements on behalf of the City of Corpus Christi with the U. S.
Department of Transportation for aid in the financing of the operating
assistance projects and any other documents necessary to accept the grant upon
its approval by the Department of Transportation.
SECTION 6. The necessity to authorize the City Manager to make
application as soon as practicable to obtain available Federal funding
for the above described project creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the
City Council and the Mayor having declared such emergency and necessity to
exist, and having requested the suspension of the Charter rule and that this
resolution take effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY SO RESOLVED, this the 27 day of February,
1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the dateit
is introduced, or at the present meeting of the City Council.
