HomeMy WebLinkAbout15403 ORD - 03/05/1980JBA:jkh; 3-5-80;4th AN ORDINANCE ORDERING AN ELECTION TO BE HELD IN THE CITY OF CORPUS CHRISTI, TEXAS, ON THE 5TH DAY OF APRIL, 1980, UPON THE QUESTION OF ADOPTING AMENDMENTS TO THE CITY CHARTER OF THE CITY OF CORPUS CHRISTI, TEXAS, AND THAT SUCH ELECTION SHALL BE HELD JOINTLY WITH THE CORPUS CHRISTI JUNIOR COLLEGE DISTRICT REGENT ELECTION; SETTING FORTH PROPOSITIONS TO BE VOTED ON AT SAID ELECTION; PROVIDING SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, the City Council, after public hearings held on January 21, 1980, February 4, 1980, February 18, 1980, and February 27, 1980, upon proposed amendments to the City Charter, determines that an election be held to permit the voters who are qualified to vote under the Constitution and laws of the State of Texas to cast their votes concerning said amendments; and WHEREAS, the City Council finds that a petition for Charter amend- ments, filed with the City Secretary on February 18, 1980, has been certified as validated to the City Council by the City Secretary on March 5, 1980, and that such proposed Charter amendment should be incorporated on the ballot for the election on April 5, 1980, as Proposition Number 14: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. An election is hereby ordered to be held on Saturday, the 5th day of April, 1980, in the City of Corpus Christi, Nueces County, Texas, at which election shall be submitted to the voters who are qualified to vote under the Constitution and laws of the State of Texas, the following amendments to the City Charter of the City of Corpus Christi, Texas: 1zis ? PROPOSITION NUMBER 1 Shall Article II, Section 16(a) regarding public council sessions, as now contained in the Charter of the City of Corpus Christi, Texas, be amended to permit closed sessions allowed by state law, so that subsection (a) henceforth reads: 15403 (a) The city council shall meet in regular session at least once each week at the city hall or at such other -governmentally -owned place within the corporate limits as designated by the council, and the council shall prescribe the manner in which special sessions may be called, name the governmentally - owned place, and provide for recess of any regular or special session. The Mayor or mayor pro tem or acting mayor and three (3) commissioners shall constitute a quorum. Except where state law, Article 6252-17 (as amended now or later) permits closed sessions for seeking limited legal advice, buying or leasing real property, selecting or evaluating public officers or employees, or taking public security measures, all sessions shall be open to the public. Except for the closed sessions, the city secretary shall keep a journal of the council proceedings, which shall be public and one of the archives of the city? PROPOSITION NUMBER 2 Shall Article VIII, Section 2, be amended by adding a new subsection,(d), to provide for grant of franchise or lease for more than five years without the necessity of an election provided the grantee makes certain investments or improvements, so that said subsection (d) henceforth reads: (d) As an exception to the election requirement (a)(4) above, the city council is authorized to grant, renew, or extend a franchise or lease for more than five years without the necessity of an election providing the franchisee or lessee makes an investment which relates reasonably, in the judgment of the city council, to the value and length of the franchise or lease? PROPOSITION NUMBER 3 Shall Article VIII, Section 2, be amended by adding a new subsection, (e), to provide for subleasing by the City of the property leased from another governmental entity for up to thirty years, so that said subsection (e) henceforth reads: (e) The city council shall be authorized, without requiring an election, to subleasefor no more .than thirty years property belonging to another governmental entity when that entity reserves the right to approve such lease? PROPOSITION NUMBER 4 Shall Article VIII, Section 3(a), regarding waiting period before the final passage and effective date of -2- a franchise, as now contained in the Charter of the City of Corpus Christi, Texas, be amended by deleting the thirty -day waiting period, changing the sixty-day waiting period to ten days following date of last publica- tion, and requiring that each such ordinance, franchise and lease be subject to the referendum procedure in Article 1181, Vernon's Texas Civil Statutes, so that subsection (a) henceforth reads: (a) Every ordinance granting, renewing, extending or amending a public utility franchise or a lease of property of the city shall be read at three (3) regular meetings of the council. Within five (5) days following the first and second - reading of the ordinance, the caption thereof shall be published one time in some newspaper of general circulation in the city, and the full text thereof shall be published one (1) time similarly within five (5) days. following the third reading of the ordinance. The expense of such publication shall be borne by the prospective franchise holder or lessee. No such ordinance shall become effective until the expiration of ten (10) days following the third publication, and every such ordinance, franchise and lease shall be subject to referendum procedure provided by state law, Article 1181, Vernon's Texas Civil Statutes, as amended now or in the future? PROPOSITION NUMBER 5 Shall Article IX, Section 29, subsection (b) (1), regarding the Central Corpus Christi Improvement District, as now contained in the Charter of the City of Corpus Christi, Texas, be amended to expand the boundaries of the said Improvement District, so that.subparagraph ,a: henceforth reads: a. Being an irregularly shaped tract -of land within the City of Corpus Christi, and more particularly described by metes and bounds as follows: Beginning at a point in the northwest portion of the intersection of Ocean Drive and Morgan Avenue where the west back of curb of Ocean Drive intersects the north back of curb line of Morgan Avenue for the south- east and beginning corner of the tract herein described; Thence in a westerly direction with the easterly extension of said north right-of-way line of Morgan Avenue, and con- tinuing with the north right-of-way line of said Morgan Avenue, approximately 1.1 miles to its intersection with the east right-of-way line of State Highway No. 286, also known as the Crosstown Expressway, for the most southerly southwest corner of the tract herein described; -3- Thence in a general northerly direction with the east right-of-way line of said State Highway No. 286, and its northerly extension across Interstate Highway No_ 37, a distance of approximately 1.4 miles to itsintersection with the north right-of-way line of said Interstate Highway No. 37 for an interior corner.of the tract herein described; Thence in a general westerly direction with the north right-of-way line of said Interstate Highway No. 37, a distance of approximately 0.3 mile to its intersection with the southeast right-of-way line of Port Avenue for the most westerly southwest corner of the tract herein described; Thence in a general northeasterly direction with the southeast right-of-way line of said Port Avenue to its intersection with.the east right-of-way line of Stroman Road for an interior corner of the tract herein described; Thence in a northerly direction with the east right-of-way line of said Stroman Road and its northerly extension across .the Main Turning Basin to its intersection with the original north city limit line of the City of Corpus Christi, Texas in the Texas Pipe Line Company Tank Battery for a north- west corner. of the tract herein described; Thence in an easterly direction with said original north city limit line of the City of Corpus Christi, Texas, to its intersection with the city limit line that bounds the area known as Corpus Christi Beach on the northwest, for an interior corner of the tract herein described; Thence continuing with the city limit line running north- easterly approximately 130 feet west of West Causeway Blvd., a distance of approximately 1.3 miles to an interior corner of the city limit, said corner being the point of beginning of that portion of the city limit annexed by the City and - described by City Ordinance No. 12306; Thence N. 570 52' W., with said annexation Ordinance No. 12306, a distance of 430 feet to an iron pipe on the easterly bulkhead line of Canal A, for a corner of the tract herein described; Thence N. 32° 08' E., along the existing city limits line as described in said ordinance, along the easterly bulkhead line of Canal A, at a distance of 2095.49 feet pass an iron pipe set on line for a reference point, a total distance of 2345.49 feet to the north bulkhead line of the Rincon Canal for a corner of the tract herein described; Thence in a southeasterly, southerly and southwesterly direction with the "Mean Tide Shoreline" around said Corpus Christi Beach Area, at approximately 2.1 miles cross the Corpus Christi Ship. Channel and continuing in a southwesterly direction to the centerline of the south concrete bulkhead of said Ship Channel for a corner of the tract herein described; Thence in a southeasterly direction with the centerline of said bulkhead to its intersection with the most northeasterly concrete bulkhead of the Barge Dock for a corner thereof; -4- Thence easterly and southerly, respectively, along the centerline of the Barge Dock bulkhead to a point where the Barge Cock bulkhead centerline at.its south end intersects the west curbline of West'Shoreline Drive for a corner of the tract herein described; Thence southerly along the back of the curb on West Shoreline Drive to a point where the back of curb on West ShorelineDrive intersects the back of the west curb of Ocean Drive immediately south of the Furman Street intersection with West Shoreline for a corner of the tract herein described; Thence along the west back of curb of Ocean Drive southerly until such west'back of curb of Ocean Drive intersects the north back of curb of Morgan Avenue to the point, of beginning? PROPOSITION NUMBER 6 Shall Article VII, Section 6, regarding discounts for early payment of taxes, as now contained in the Charter of the City of Corpus Christi, Texas, be amended to clarify that discounts for early payment may be allowed, at the discretion of the City Council to conform to state law, Article 7255b, Vernon's Texas Civil Statutes, so that said Section 6 henceforth reads: Sec. 6. Collection of taxes. The city council shall have power to provide for the prompt collection of taxes; prescribe when taxes are due; when delinquent; prescribe penalties and interest for delinquent taxes; and may allow a discount for advance pay- ment of taxes at the discretion of the council, not to exceed the sums provided by state law, Article 7255b, Vernon's Texas Civil Statutes, and Article VIII, Section 20, Constitution of Texas; provided that no person shall be elected mayor or council member who owes any delinquent taxes to the city. A11 taxes due the city andall fines, forfeiture and penalties shall be collectible and payable only in current money or current funds of the United States,except as provided by Article XI, Section 6 of the Constitution of Texas? PROPOSITION NUMBER 7 Shall Article II, Section 3(b), regarding runoff . elections, as now contained in the Charter of the City of Corpus Christi, Texas, be amended to reduce the time between elections from three weeks to two weeks, so that subsection (b) henceforth reads: -5- (b) Runoff elections. In the event any candidate for mayor or council member fails to receive a majority of all votes cast for such office at any regular or special election, there shall be held on the second Saturday following any such election a runoff election, at which runoff election the two (2) candidates receiving the highest number of votes for such office in the first election shall again be voted for? PROPOSITION NUMBER 8 Shall Article II, Section 17, concerning certain City Council actions being unlawful within the period beginning 30 days before a regular election and the taking of office of the City Council, as now contained in the Charter of the City of Corpus Christi, Texas, be amended to permit Council action upon the affirmative votes of five members, so that Section 17 henceforth reads: Sec. 17. Contract before election. It shall be unlawful for the city council, within the period beginning thirty (30) days before any regular election and extending to the taking of office of the newly -elected council to pass any ordinance or resolution whereby any appropriation of money not included in the budget is made or contract or obligation of the city is attempted to be created or franchise granted, or any zoning or rezoning- ordinance passed or hearing held without five (5) affirmative votes and any such appropriation, contract or grant or zoning or rezoning ordinance without five (5) affirmative votes shall be void? PROPOSITION NUMBER 9 Shall Article IX, Section 14(c), regarding competitive bids be amended to increase contract sums requiring competitive bidding and City Council approval from $2,000 to $5,000 to conform to state law, Article 2368a, and to allow the City Manager to exceed that sum in case of emergency equipment repairs which shall be reported to the City Council, so that the last sentence of said subsection (c) henceforth reads: No contract shall ever be authorized except by ordinance or motion duly passed by the city council; provided, however, that, without such authoriza- tion the city manager shall have authority to contract for expenditure for all budgeted items not exceeding five thousand dollars ($5,000), as provided by state law Article 2368a, Vernon's Texas Civil Statutes, now or in the future, and may exceed that sum in the case of emergency equipment repairs which shall thereafter be reported to the city council. All contracts involv- ing more than five thousand dollars ($5,000),except contracts for personal services and emergency equipment repairs or contracts with any governmental body or agency, must be advertised as described in this section? -6- PROPOSITION NUMBER 10 Shall Article II, Section 16(d), regarding emergency passage of ordinances or resolutions, as now contained in the Charter of the City of Corpus Christi, Texas, be amended to permit five members of the Council or the Mayor to request a finding of an emergency, so that subsection (d) henceforth reads: (d) No ordinance or resolution shall be passed finally on the date it is introduced but same shall be considered and voted upon at three (3) regular meetings, except in the case of emergency and then only when requested in writing by the mayor or five members of the council, and the finding of an emergency by the council shall be conclusive. No ordinance or resolution granting any franchise or special privilege shall ever be passed as an emergency measure? PROPOSITION NUMBER 11 Shall Article II, Section 27, regarding Corporation Court, as now contained in the Charter of the City of Corpus Christi, Texas, be amended so as to comply with state law, Article 1196(a), regarding municipal courts and to clarify term of the judges and clerks, so that said Section 27 henceforth reads: Sec_ 27. Municipal Court. There shall be a court for the trial of misdemeanors known as the municipal court, with such powers and duties as are defined and described in Article 1196(a), Vernon's Texas Civil Statutes. The magistrates of the court shall be known as municipal judges, who shall be licensed attorneys, practicing law in Nueces County for at least two (2) years prior to appointment, and a qualified voter. Each judge shall be nominated by the mayor and elected by a majority of the city council, and shall receive such salary as may be fixed by ordinance. The city council shall appoint a clerk of said court who shall receive such salary as may be fixed by ordinance. The city council may also appoint a deputy or deputy clerk from time to time as they may deem neces- sary. The term of office of municipal judges and the clerk shall be the same as the term of office of the appointing council or until their successors have been appointed. A vacancy in the office of municipal judge or clerk shall be filled by the city council for the unexpired term only. In the event of absence, illness or inability to act the mayor may nominate and the city council appoint some suitable person to serve during such absence, illness or inability to act, who shall have all the rights, powers, duties and authority of the regular appointee during such time? -7- PROPOSITION NUMBER 12 Shall Article VI, Section 1, regarding appointment of the Civil Service Board, as now contained in the Charter of the City of Corpus Christi, Texas, be amended to provide for appointment by the City Council instead of the Mayor, so that said Section 1 henceforth reads: Sec. 1. Civil Service Board. There is hereby 2stablished a civil service board, which shall consist of three persons, citizens of Corpus Christi, each of whom shall have resided in the city for three years or more immediately preceding appointment. No member of the board shall during his or her tenure be a candidate for or hold any public office or position, except notary public. The city council shall appoint the members of such board. Of the first three members so appointed, one shall be appointed for a term of one year, one shall be appointed for a term of two years, and one shall be appointed for a term of three years; thereafter, the term of office of each member of such board shall be for three years, or until a successor is appointed? PROPOSITION NUMBER 13 Shall Article IX, Section 14(b), regarding signature of Director of Finance as now contained in the Charter of the City of Corpus Christi, Texas, be amended so as to delete the Director's signature on City contracts, so that said subsection (b) henceforth reads: (b) Nor shall the city or anyone acting for it make any contracts for goods, materials, services or supplies for the current use of any department of the municipality for more than one year, except as in this charter provided, until included in the budget and an appropriation has been made therefor, and no contract or purchase shall exceed the amount appropriated. All contracts, except for professional services and except contracts with any governmental body or agency shall be made upon specifications, and no contracts shall be binding until it has been (1) examined by the city attorney and has been either approved by him or his objections thereto have been filed with the council, and (2) it has been signed by the city manager. Any contract for current expenditures exceeding the budget or the appropriation therefor shall be void? PROPOSITION NUMBER 14 Shall Article VII, Taxation and Bonds, Section 1, paragraph "b", concerning maximum tax rate, as now contained in the Charter of the City of Corpus Christi, Texas, be repealed in its entirety and the following substituted therefor: -8- (b) THIS MAXIMUM TAX RATE SHALL BE AVAILABLE AT ALL TIMES FOR THE PURPOSE OF MEETING INTEREST AND PRINCIPAL REQUIREMENTS OF DEBT EXISTING, INCLUDING BONDS PREVIOUSLY AUTHORIZED, BUT NOT YET'• . SOLD, AS OF THE DATE OF ANY TAX LEVY. THE MAXIMUM TAX RATE. FOR ALL PURPOSES, INCLUDING DEBT SERVICES EXISTING AND PROPOSED, 'SHALL NOT EXCEED SIXTY-EIGHT CENTS ($0_68) PER ONE HUNDRED DOLLARS ($100.00) OF ASSESSED VALUE. THE PERCENTAGE OF INCREASE OF ASSESSED VALUE OF ANY TAXABLE PROPERTY SHALL NOT EXCEED SIX PERCENT (6y) PER ANNUM; UNLESS AN ADDITION OR IMPROVEMENT I5. MADE TO THE TAXABLE PROPERTY, THEN THAT INCREASE IN VALUE SHALL' BE ADDED TO THE ASSESSED VALUE_ IF ANY PROPERTY IS SOLD, THAT PROPERTY SHALL BE ASSESSED AT THE SALE PRICE AND THEREAFTER. BE SUBJECT TO THE AFORESAID SIX PERCENT (66) PER ANNUM LIMIT? SEVERABILITY CLAUSE If any phrase, clause, sentence, paragraph or section of this Amendment shall be declared unconstitutional by the valid judgement or decree• of - any court of competent jurisdiction, such unconstitutionally shall not - affect any of the remaining phrases, clauses, sentences and paragraphs - SECTION 2. The ballots for said election shall be in such form as those voters intending to vote "YES" shall show on their ballots a vote "FOR" the respective proposition, and those intending to vote "NO" shall show on their ballot "AGAINST". The respective propositions shall appear on said ballot as follows: PROPOSITION NUMBER 1 FOR: Amending Article II, Section 16(a), regarding public AGAINST: council sessions to permit closed sessions of the city council where state law, Article 6252-17, Vernon's Texas Civil Statutes (as amended now or later), permits closed sessions for seeking limited legal advice, buying or leasing real property, selecting or evaluating public officers or employees, or taking public security measures. PROPOSITION NUMBER 2 FOR: Amending Article VIII, Section 2, Franchises and Leases, by adding an exception authorizing franchises and leases for more than five years without voter approval if an investment is made which relates reasonably in the judg- ment of the city council to the value and length of the franchise or lease. AGAINST: -9- PROPOSITION NUMBER 3 FOR: Amending Article VIII, Section 3(a) to add a new provi- sion to permit, without requiring an election, subleasing AGAINST: by the city for no more than thirty years property belong- ing to another governmental entity when that entity reserves the right to approve such lease. PROPOSITION NUMBER 4 FOR: Amending Article VIII, Section 3(a), regarding waiting period before final passage and effective date of a AGAINST: franchise ordinance by (1) deleting the thirty -day waiting period between the first and third readings; (2) reducing the sixty-day waiting period following the adoption to ten days; and (3) subjecting each such ordinance, franchise and lease to the referendum procedure in State law, Article 1181. PROPOSITION NUMBER 5 'FOR: Amending Article IX, Section 29, subsection (b)(1) regarding the Central Corpus Christi Improvement AGAINST: District to expand the boundaries of said Improvement District to include the area bounded on the east by the shoreline of Corpus Christi Beach and west curb line of Shoreline Drive; on the south by Morgan Avenue; and on the west by the Crosstown Expressway to Interstate 37 to Port Avenue to salt flats drainage ditch to the city limits; and on the north by Nueces Bay. PROPOSITION NUMBER 6 FOR: Amending Article VII, Section 6, regarding the City Council's discretion in allowing discounts for early AGAINST: payment of taxes to conform to state law, Article 72556. -10- PROPOSITION NUMBER 7 FOR: Amending Article II, Section 3(b), regarding runoff elections to reduce the time between elections from AGAINST: three weeks to two weeks. PROPOSITION NUMBER 8 - FOR: Amending Article II, Section 17, to permit ordinances and resolutions affecting appropriations, contracts, AGAINST: franchises and zoning within thirty days of a regular election and until the new council is seated to be passed with five affirmative votes. PROPOSITION NUMBER 9 FOR: Amending Article IX, Section 14(c), regarding competitive bids to increase contracts requiring competitive bidding AGAINST: and City Council approval from $2,000 to $5,000 to conform to state law, Article 2368a, Vernon's Texas Civil Statutes, and to allow the City Manager to exceed $5,000 only for emergency equipment repairs which shall be reported to the City Council. FOR: AGAINST: FOR: AGAINST: PROPOSITION NUMBER 10 Amending Article II, Section 16(d), regarding emergency passage of ordinances or resolutions to permit five members of the Council or the Mayor, rather than only the Mayor, to request .a finding of an emergency.. PROPOSITION NUMBER 11 Amending Article II, Section 27, changing the name of Corporation Court to Municipal Court to comply with state law, Article 1196(a), Vernon's Texas Civil Statutes, and to clarify the term of judges and clerks so that the term is the same as the appointing Council. -11- PROPOSITION NUMBER 12 FOR: Amending Article VI, Section 1, to provide for appointment of the Civil Service Board by the City Council rather than AGAINST: by the Mayor. ' PROPOSITION"NUMBER 13 FOR: Amending Article IX, Section 14, which requires the signature of both the City Manager and the Director of AGAINST: Finance on all City contracts to delete the requirement for the, signature of the Director of Finance on contracts approved by the City Council. PROPOSITION NUMBER 14 FOR: Repealing Article VII, Taxation and Bonds, Section 1(b) in its entirety and substituting the following therefor: AGAINST: (6) THIS MAXIMUM TAX RATE SHALL BE AVAILABLE AT ALL TIMES FOR THE PURPOSE OF MEETING INTEREST AND PRINCIPAL REQUIREMENTS OF DEBT EXISTING, INCLUDING BONDS PREVIOUSLY AUTHORIZED, BUT NOT YET SOLD, AS OF THE DATE OF ANY TAX LEVY. THE MAXIMUM TAX RATE FOR ALL PURPOSES, INCLUDING DEBT SERVICES EXISTING AND PROPOSED, SHALL NOT EXCEED SIXTY-EIGHT CENTS ($0.68) PER ONE HUNDRED DOLLARS ($100.00) OF ASSESSED VALUE. THE PERCENTAGE OF INCREASE OF ASSESSED VALUE OF ANY TAXABLE PROPERTY SHALL NOT EXCEED SIX . PERCENT (6%) PER ANNUM; UNLESS AN ADDITION OR IMPROVEMENT IS MADE TO THE TAXABLE PROPERTY, THEN THAT INCREASE 111 VALUE SHALL • BE ADDED TO THE ASSESSED VALUE. IF ANY PROPERTY IS SOLD, THAT PROPERTY SHALL BE ASSESSED AT THE SALE PRICE AND THEREAFTER BE SUBJECT TO THE AFORESAID SIX PERCENT (6.%) PER ANNUM LIMIT_ SEVERABILITY CLAUSE • If any phrase, clause, sentence, paragraph or section of this -Amendment shall be declared unconstitutional by the valid judgement or decree of any court of competent jurisdiction, such unconstitutionally.shall not.. affect any of the remaining phrases, clauses, sentences and paragraphs. SECTION 3. The election shall be held pursuant to Article 1170, R.C.S., Texas, and the general laws of Texas pertaining to elections insofar as such are applicable hereto. The polls shall be open from 7:00 a.m. to 7:00 p.m. on the date of said election, and voting machines shall be employed at the election herein ordered pursuant to the Texas Election Code, V.T.S., Article 7.14, as amended., -12- SECTION 4. The. Corpus Christi Junior College District Regent Elec- tion shall be held jointly with an election of the City of Corpus Christi; the shared expenses of such elections shall be borne by the City of Corpus Christi• and by the Corpus Christi Junior College District in proportion to the number of voting precincts utilized by each; a single ballot form con- taining all of the offices to be voted on and each proposition.to be voted on shall be used at each joint polling place; the poll lists, tally sheets and return forms for such elections'may be combined and multiple sets of the joint returns of such election may be made by the election officials holding such elections; one set of all returns and tally lists shall be delivered to the City Council of the City of Corpus Christi; and one set of such returns and tally lists shall be delivered to the Board of Regents of the Corpus Christi Junior College District; and only one set of election pre- cincts, voting places and election officials (hereinafter designated) shall be used in the conduct of such joint election. SECTION 5. Bill G. Read, whose office is situated at the Office of the City Secretary, Third Floor, City Hall, 302 South Shoreline Drive, Corpus Christi, Texas, is hereby appointed Election Manager and Judge of said election, and he is hereby authorized and directed to make all neces- sary arrangements for the holding of said election in accordance with and subject to the laws 'of this State, and Bill G. Read, B. R. Venters and C.C. Kelly are appointed to hold such election in accordance with'the laws of this State. SECTION 6. Voting machines shall be used for the conduct of said election on election day and for conducting absentee voting, except that for absentee votes cast by mail, paper ballots shall be used. Absentee voting in person shall be conducted in the lobby of City Hall, 302 South Shoreline Drive, Corpus Christi, Texas, from 8:00 a.m. to 5:00 p.m., Monday through Friday, beginning on March 17, 1980 and ending April 1, 1980.
