HomeMy WebLinkAbout15415 ORD - 03/19/1980jkh:3-5-80;1st 1110 r , AN CRDPNANCE ANNEXING APPROXIMATELY 36,861 ACRES OUT OF THE WILLIAM BRYAN SURVEY, ABSTRACT NOS. 44 AND 46, WILLIAM LITTLE SURVEY, ABSTRACT NO. 217, URIAN HAYDEN SURVEY ABSTRACT NOS. 161 AND 162, AND THE GULF WATERS OF THE GULF OF MEXICO, MORE FULLY DESCRIBED HEREINAFTER, PURSUANT TO ARTICLE 970a, V.A.C.S., TEXAS, AS AMENDED, AND CITY CHARTER ARTICLE I, SECTION 2(c), PROVIDING FOR ANNEXATION TO THE CITY OF CORPUS CHRISTI OF ROADS, HIGH- WAYS, STREETS, PUBLIC LANDS AND WATERS OF THE GULF OF MEXICO, ADJACENT AND CONTIGUOUS TO THE CITY OF CORPUS CHRISTI; AND PROVIDING FOR SEVERABILITY. WHEREAS, on the 20th day of February, 1980, a public hearing was duly held at the Regular Council Meeting of the City Council, following publication of due notice of said hearing in the official newspaper, pur- suant to Article 970a, V.A.C.S., Texas, as amended, for the consideration of proceedings for the annexation of a defined area wholly within the extra- territorial jurisdiction of Corpus Christi, at which all interested persons were afforded an opportunity to be heard, and by motion duly made, seconded and carried the said hearing was closed on February 20, 180; and WHEREAS, it has been determined by the City Council that the territory above mentioned, and more fully described hereinafter, and now proposed to be annexed, abuts and is contiguous and is adjacent to the City of.Corpus Christi and constitutes lands and territories used for public purposes and which is owned by any governmental subdivision, or dedicated to a public use within the meaning of the City Charter, Article I, Section 2(c); and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid and hereinafter more fully described area: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby annexed the hereinafter described lands and Gulf waters of the Gulf of Mexico, pursuant to Article 970a, V.A.C.S., Texas, as amended, and City Charter Article I, Section 2(c), said area being more fully described as follows: 15415 s 'Being an approximate 36, 861 acre area out of the William Bryan Survey, Abstract Nos_ 44 and 46; William Little Survey, Abstract No. 217, Uriah Hayden Survey Abstract Nos. 161 and 162. and the Gulf waters of the Gulf of Mexico, or more fully described as follows: BEGINNING at the most northerly corner of tfie Uriah Hayden Survey. Abstract No. 162 on the southwesterly boundary line of the R. S. Harvey Survey, Abstract No. 164. such point also being on the present city limits of the City of Corpus Christi. Texas as established by Ordinance No. 11201 pas sed on December 13,1972. for the beginning point of this description; . • THENCE in a southeasterly direction with the southwest boundary line of the R. S. Harvey Survey, -Abstract 164. to the 1. 37 foot line above Mean Sea Level of the Gulf of Mexico side of Mustang island with elevation based on U. S. C. and G. S. datum of 1929 to a point for corner; THENCE in a northeasterly direction with the meanders of the west shoreline of the 1.37 foot line above Mean Sea Level of the -Gulf of Mexico side of Mustang Island to the City of Port -Aransas' one half mile extraterritorial jurisdiction line - to a point for corner; - - THENCE extending into the Gulf waters of the Gulf of Mexico along the City of Port. Aransas' one half mile extraterritorial jurisdiction line to the Nueces County-- • Aransas County line to a point for corner; THENCE extending eastward into the Gulf waters of the Gulf of Mexico on the county line between Nueces County and Aransas County to the City of Corpus Christi's - five mile extraterritorial jurisdiction line to a point for corner; THENCE southward along the City of Corpus Christi's five mile extraterritorial - jurisdiction line to a line that is parallel with and two miles southeast of the 1_ 37 foot line above Mean -Sea Level of the Gulf of Mexico side of Mustang Island to a point for corner. .- • THENCE in a southwesterly direction two miles southeast of and parallel with the • - 1.37 foot line above Mean Sea Level of the Gulf of Mexico side of Mustang Island ' and Padre Wand to a point, such point being the extension of the northerly boundary of the Padre Island National Seashore Park where it extends to the Gulf waters to a point for corner. , - 'THENCE in a westerly direction with the extension of the northern boundary of - • Padre Island National Seashore Park where it extends to the Gulf waters to the -1/37 foot line above Mean Sea Level of the Gulf of Mexico side of Padre Island ` • to a point for corner, THENCE in a northeasterly direction with the meanders of the west shoreline of . the Gulf of Mexico on the 1.37 foot line above Mean Sea Level of the Gulf of Mexico side of Padre Island and Mustang Isle.nd to the southeast corner of, the Williarn • Bryan Survey, Abstract No. 46. to a point for corner, such point alsobeing the most southeasterly corner of Mustang Island State Park; .THENCE in a northwesterly direction with the southwest boundary line of the William Bryan Survey, Abstract. No. 46, and the southwest boundary of Mustang Island State Park to the northwest right of way line of Park Road No_ 53 to a point for corner; THENCE in a northeasterly direction with the northwest.right of way line of Park Road No_ 53 for a distance of ,3, 105.23 feet to a point for corner; THENCE in a northwesterly direction with the most southwesterly boundary line.of ' Mustang Island State Park west of Park Road No. 53 to an elevation of 0.68 feet above Mean. Sea Level on Corpus Christi Bay for a point for corner, such point - being the most southwesterly corner of Mustang Island State Park; THENCE in a northeasterly direction with the meanders of said east shoreline of • Corpus Christi Bay on elevation 0.68 feet above Mean Sea Level and the westerly boundary line of Mustang Island State Park to a point for corner, such point being on the southwesterly extension of the southeast boundary line of a 160 acre tract of land owned by Mr. Ted Anderson, such line also being the' Mustang Island State Park boundary line; THENCE in a northeasterly direction with the southwesterly extension of said " 160 acre tract of land orned by Mr. Ted Andersoa.and Mustang Island State . Park boundary line to -the northeast corner of said tract to a point for corner; THENCE in a northwesterly direction with the northeast boundary of said Anderson. Tract and Mustang Island State Park boundary to a point on the present city limits of the City of Corpus Christi which, is the northwest boundary line of the William Bryan Survey, Abstract No. 44; - THENCE continuing wiffi the present.city limits of the City- of Corpus. Christi and . in a general northeasterly direction with the northwest boundary line of said William Bryan Survey. Abstract No. 44, William Little Survey, Abstract No. 2.L7.1 and the Uriah Hayden Survey, Abstract. No. 161, to the most northerly corner of. the Uriah Hayden Survey, Abstract No. 161, to a point for corner, - . THENCE continuing with the present city limits of the City of Corpus Christi and. in a southeasterly direction with the northeast boundary line of said Uriah Hayden Survey, Abstract No. 161. to the most westerly cornerof the Uriah• Hayden Survey Abstract No. 162, to a point for corner; THENCE continuing with the present city limits of the City of Corpus Christi and in a northeasterly direction with the northwest boundary line of said Uriah Hayden Survey. Abstract No. 162, TO THE=POINT OF BEGINNING.." . The above described area shall hereafter be a part of the City of Corpus Christi, Texas, and shall be subject to the general laws of the State of Texas, the. City Charter of the City of Corpus Christi and the ordinances, resolutions, laws, rules and regulations of the City of Corpus Christi, to all intents and purposes as the present City of Corpus Christi is so sub- ject, and subject to all the rights, privileges and burdens thereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, sbudivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. This ordinance of annexation shall be effective from and after its final passage.
