COLUNGA THAT TRACT OR PARCEL OF LAND DESCRIBED AS THE SOUTH 1/2 OF LOT 5, BLOCK 4, C. A. MEULY ADDITION IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS FOR A CASH CON- SIDERATION OF $750, ALL AS MORE FULLY SET FORTH IN THE SPECIAL WARRANTY DEED, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: • SECTION 1. That the City Manager be and he is hereby authorized to convey by Special Warranty Deed to Guadalupe Colunga and Jose E. Colunga that tract or parcel of land described as the South 1/2 of Lot 5, Block 4, C. A. Meuly Addition in the City of Corpus Christi, Nueces County, Texas for a cash consideration of $750, all as more fully set forth in the Special Warranty Deed, a copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to immediately authorize the execution of a deed in order to facilitate the sale of the above described tract or parcel of land creates a public emergency and an imperative public necessity requir- ing the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the VI day of March, 1980. Colunga, the receipt of which is hereby acknowledged, and for which no lien is retained, either expressed or implied, has this day GRANTED, SOLD AND CONVEYED, and by these presents does GRANT, SELL AND CONVEY unto Guadalupe Colunga and Jose E. Colunga, of the County of Nueces, and State of Texas, all of the following described real property in Nueces County, Texas, to -wit: the south of Lot Five (5), Block Four (4), C. A. Meuly Addition in the City of Corpus Christi, Nueces County, Texas, as shown by map or plat thereof recorded in Volume 1411, Pages 978-980, of the Map Re- cords, Nueces County, Texas. TO HAVE AND TO HOLD the above described premises herein con- veyed, together with all and singular the rights and appurtenances thereto in anywise belonging to the said Guadalupe Colunga and Jose E. Colunga, their heirs and assigns, forever, and Grantor does hereby bind itself, its successors and assigns, to warrant and forever de- fend all and singular the said premises unto the said Grantees, their heirs and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through, or under Grantor, but not otherwise. This conveyance is made and accepted subject to the follow- ing restrictions and covenants: No separate or detached dwelling structure of any nature whatsoever shall be located on the premises -1- herein described.
