AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT
TO THE CONTRACT DATED MARCH 10, 1971, AS AMENDED, WITH
SHWC, INC., AND CAUDILL ROWLETT SCOTT, ASSOCIATED
ARCHITECTS, FOR ARCHITECTURAL SERVICES ON THE CORPUS
CHRISTI COMMUNITY CONVENTION CENTER, A SUBSTANTIAL COPY
OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A", WHICH DELETES FROM THE ORIGINAL
AGREEMENT ALL RESPONSIBILITY FOR PREPARATION OF "SITE
DEVELOPMENT WORK, INCLUDING UTILITIES, PAVING AND DRAIN-
AGE"; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE
AN AGREEMENT WITH SHWC, INC. FOR ARCHITECTURAL SERVICES
RELATING TO THE DEVELOPMENT OF A SITE PLAN WHICH INCLUDES
UTILITIES, PAVING, DRAINAGE, PARKING, LANDSCAPING, AND
TRAFFIC FLOW FOR THE AREA SURROUNDING THE CONVENTION CENTER/
BAYFRONT PLAZA, A SUBSTANTIAL COPY OF WHICH IS ATTACHED
HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "8";
APPROPRIATING $200,000 OUT OF THE NO. 209 COMMUNITY CONVEN-
TION FACILITY BOND FOR ARCHITECTURAL FEES PAYABLE TO SHWC,
INC., APPLICABLE TO PROJECT NO. 209-76-1.2, ARCHITECTURAL
SERVICES AND ENGINEERING (CONVENTION CENTER); AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY. COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute an
amendment to the contract with SHWC, Inc. and Caudill Rowlett Scott,
Associated Architects, for architectural services on the Corpus Christi
Community Convention Center, a substantial copy of which is attached hereto
and made a part hereof, marked Exhibit "A", which deletes from the original
agreement dated March 10, 1971, as amended, all responsibility for prepara-
tion of "site development work, including utilities, paving and drainage."
SECTION 2. That the City Manager be further authorized to execute
an agreement with SHWC, Inc. for architectural services relating to the develop-
ment of a site plan which includes utilities, paving, drainage, parking, lands-
caping, and traffic flow for the area surrounding the Convention Center/Bayfront
Plaza, a substantial copy of which is attached hereto and made a part hereof,
marked Exhibit "8".
SECTION 3. That there is hereby appropriated $200,000 out of the
No. 209 Community Convention Facility Bond Fund for architectural fees payable
to SHWC, Inc., applicable to Project No. 209-76-1.2, Architectural Services
and Engineering (Convention Center).

SECTION 4. The necessity to authorize execution of the aforesaid
amendment to contract and agreement and to appropriate the sums necessary for
the architects to develop a site plan for the area surrounding the Convention
Center/Bayfront Plaza at the earliest practicable date creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally on
the date of its introduction but that suchordinance or resolution shall be
read at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity, exist, having requested the ..
suspension of the Charter rule and that this ordinance be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /"

AMENDMENT TO THE CONTRACT FOR ARCHITECTURAL
SERVICES ON THE CORPUS CRRISTI
COMMUNITY CONVENTION CENTER
The City of Corpus Christi, hereinafter called "City", and the Associated
Architects, SHWC, Inc.. (formerly Swanson, Hiester, Wilson & Claycomb, and formerly
Swanson, Hiester, Wilson and Boland) and Caudill Rowlett Scott of Houston (also
known as CRS), hereinafter call "Architects" hereby agree to the following amendment
to the contract for architectural services on the Corpus Christi Community Convention
Center which was authorized by the Corpus Christi City Council March 10, 1971 and _
by the passage of Ordinance No. 10147 and subsequently anenderi January 2, 1974:
SECTION III, Paragraph (1) B shall be emended as follows: -
Architectural services relating to."site development work, jnr.uoing ell
utilities, paving and drainage" is hereby deleted from the contract.

This Agreement is made and entered into this day of March, 1980
by and between the City of Corpus Christi, hereinafter called "City", and the
Associated Arehitects, SHWC, Inc. (formerly Swanson, Hiester, Wilson & Claycomb,
and formerly Swanson, Hiester, Wilson & Boland, hereinafter called "Architect";
WITNESSETH
That Whereas the construction of the Corpus Christi Community Convention
Center is now under construction in the City of Corpus Christi, Texas:
Now, Therefore, the City and the Architect, for the consideration here-
inafter named, agree as follows:
The Architect agrees to perform the professional services as hereinafter
set forth:
Professional services relating to site work shall be performed indivi-
dually by SHWC,'Inc. under the direction of David M. Wilson. Should it become
necessary for the Architect to employ the services of Caudill Rowlett Scott of
Houston (also known as CRS) on a consultation basis, or any other consultant firm
or other outside service, the Architect shall have sole responsibility for nego-
tiation of any contract or agreement and for payment of any fees incurred for
such services. The City's sole responsibility shall be with the Architect.
The basic professional services for the site work, including all utilities,
paving, drainage, traffic -flow analyses, parking, and all other items as delineated
in the Site Planning Program attached hereto and made a part hereof.

The landscaping design portion of this site plan shall be deferred
until a later date. Procurement of a landscapeconsultant by the Architect shall
be subject to approval by the Corpus Christi City Council.
The Architect shall be paid on the basis of 8% of the cost now estimated
to be $2,50,000, which will be adjusted to reflect actual costs when known.
Payment for professional services relating to site work shall be made on a percentage
of completion basis with the Architect submitting periodic invoices as the work
progresses. Upon request, Architect shall furnish City interim status reports
regarding the planning progress.
IN TESTIMONY WHEREOF, WITNESS OUT HAND IN TRIPLICATE, each of which shall
be considered an original on the day and year below written.

SITE PLANNING PROGRAM

CORPUS CHRISTI BAYFRONT ARTS 8 SCIENCES PARK '
Corpus Christi's Park at the City Nater Front dedicated to public use
is the location for the City's Museum, the Art Museum of South Texas,
the Harbour Playhouse Theatre, three restored Historic Houses, the
Bayfront Plaza Auditorium and the Bayfront Plaza Convention Center.
Also, at the seawall is the "Barge Dock".
Located adjacent and virtually contiguous to the Park are the Corps of
Engineers Building; the Maritime Union Building, the Corpus Christi
Port Authority Wharf Facility, the Corpus Christi High Bridge and
potential hotel sites.
The public visiting the Park will be both local citizens and visitors
to the City. Most visitors to the Park will be visiting the specific
facilities listed above rather than incidental "recreation or_walks"
in the Park.
PHYSICAL ASPECTS
The Park situated on the City Bayfront at the junction of Marina
Waters and the entry to the Port of Corpus Christi encompases the
equivalent of 17 city blocks.
The boundaries are the Marina Bayfront from Hughes Street to the
ship channel on the north (excluding Corps of Engineer property) to
the High Bridge to Mesquite Street on the south west to Fitzgerald
Street on the south to Water Street back to Hughes Street.
The site is low lying natural and man deposited shore Tine fill. The
site is protected by a 14' high seawall which drops moderately to a law
of 4 1/2' to 5' above sealevel at Water and Chapparal Streets.
The original street system and utilities are intact except where
removed or altered by the public buildings on the site.
Little landscaping has been accomplished except immediately adjacent to
existing complete buildings. Much of the recently acquired Park
property and tract yet to be acquaired still has a variety of
existing light structures to be removed.

TASK
Design, produce construction documents and administer the implementation
of the Land Plan for the Bayfront Arts & Sciences Park.
The Land Plan shall encompass the site development for all of the land
area of the Park.
The implementation shall take into account the existing construction
of the Convention Center on the site and the continued public use of
the existing facilities of the Park. Phasing of the implementation
of the site develbpment is a major concern.
The concept and design of the Land Plan is primarily to support
existing facilities, cultural expectations, enhance the aesthetic
appeals of the exterior spaces of the Park. -

For the reasons set forthin the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
