HomeMy WebLinkAbout15426 ORD - 03/19/1980• • VP:3/19/80:1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO.•6106; AS AMENDED, UPON APPLICATION OF WBC HOLDING$ BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A FROM "R--" MULTIPLE1111.112LLEELLIULL FROM "A-1" APARTMENT HOUSE DISTRICT Tn "R -1B" ONE FAMILY DWELL- ING DISTRICT ON BOTH TRACTS, BOTH TRACTS BEING AN 8.328+ ACRE TRACT OF. LAND OUT OF TRACTS 5-C AND 5-D, LOKEY SUBDIVISION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS MORE PARTICULARLY DESCRIBED HEREINBELOW; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING` ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING • AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of WBC Holdings for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on March 19; 1980 Wednesday, ,'at .. Special .- Council Meeting of the City Council in the Council Chamber at City Hall in the City of Carpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve, the hereinafter set forth amendment would best serve public health, Necessity and convenience and the general welfare of the City of Corpus Christi and its citizens NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. 'That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106. as amended, be and the same is hereby amended by making the change hereinafter set out. SECTION 2. That the hereinafter mare fully described 8.328 acres of land, more or less, out of Tracts 5-C and 5-D, Lokey Subdivision, as shown by map recorded in Volume 7, page 16 and Lot 6, Section 12, Flour Bluff & Encinal Farm & Garden Tracts, shown by map recorded in Book A, page 41 of the Map Records of Nueces County, Texas, all situated in the City of Corpus Christi, Nueces County, Texas, be rezoned from "R-2 Multiple Dwelling District on Tract A and on Tract B from "A-1" Apartment House District to "R -1B" One Family Dwelling District on both -tracts: Beginning at a point in the Westerly boundary line of Tract 5-C for the Southwest corner and Point of Beginning of this tract whence the Southwest corner of Tract 5-C bears with said boundary line South,28°59'20" West 37.5°a point in the centerline of a 75' wide easement for drainage;+ THENCE continuing with said boundary line North 28°59'20" East 535' to the North or Northwest corner of this tracts THENCE South 61°00'40" East crossing Tracts 5-C, 5-D, and a por- tion of said Lot 6, Section 12, respectively, 600' to the East or Northeast corner of this tract; THENCE in a Southwesterly direction with a circular curve to the left whose radius center bears South 61°00'40" East 153.96' said curve having a central angle equalling 28°59'20", tangent equalling 39.80' for an arc distance of 77.89' to the point of tangency; THENCE South 100' to the point of curve of a circular curve to the ri gh t ; THENCE with said curve having a central angle equalling 28°59'20", radius equalling 257.41', tangent equalling 66.54' for an arc' distance of 130.24' to the point of tangency; THENCE South 28°59'20" West 178.16' to the point of curve of a cir- cular curve to the left; THENCE with said curve having a central angle equalling 90°, radius equalling 40' for an arc distance of 62.83' to a corner; THENCE South 28'59'20" West 30' to a point in the Northerly. boundary line of said drainage easement for the South or Southeast corner of this tract; - THENCE North 61°00'40" West along said boundary line 740' to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as -herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the. purpose of maintaining•at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance•or resolution shall be passed finally on the date of its introduc— tion and that such ordinance or resolution shall be read at three several. meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter.rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and fter its passage, IT IS ACCORDINGLY SO ORDAINED, this the / day of ?�%[� / , 19 S) ATTEST: C Secre ary. • APPROVED: /9 DAY OF ' ,/9 : J.
