HomeMy WebLinkAbout15429 ORD - 03/26/1980• jkh:3-26-80;lst P.N ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF BERRY CONTRACTING, INC. BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTION'OF LOT 36, H. B. SHEPPARD FARM LOTS, CONSIST- ING OF 8.517 ACRES, MORE OR•LESS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTIRCT TO"R-2" MUL1I-FAMILY DWELLING DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Berry Contracting, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, March 26, 1980 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 15429 SECTION 2. That the hereinafter more particularly described 8.517 acre tract, more or less, out of Lot 36, H. B. Sheppard Farm Lots, situated in the City of Corpus Christi, Nueces County, Texas, be rezoned from "R-18" One -Family. Dwelling District to "R-2" Multi -Family Dwelling District: Being a 8.517 acre tract of land, more or less, out of Lot 36, H. B. Sheppard Farm Lots, as shown by plat recorded in Nueces County Map Records, Volume A, page 51 and further described by metes and bounds as follows: BEGINNING at a point in the South boundary line of said Lot 36, said beginning point being located West 40 feet from the original Southeast corner of said Lot 36 which is in the original center line of Tuloso Road as shown by said plat; THENCE West 856.43 feet along said South boundary line of said Lot 36, to point for the Southwest corner of this tract; THENCE North 219.24 feet to a point in the Southeast boundary line of a 60 foot Exxon Pipeline Company easement, as shown by deed recorded in Volume 1240, Page 101, of the Deed Re- cords of said county and state, said point for a Westerly -corner of this tract; THENCE along said Southeast boundary line of Exxon Pipeline Company easement N43°19'17"E 469.84 feet to a point for the Northernmost corner of this tract; THENCE S81°40'20"E 314.98 feet to a point for a Northerly corner of this tract, said Northerly corner being the West- ernmost corner of Lot 1, Tuloso Road Unit II, as shown by plat recorded in Volume 34, Page 102, of the map records of said county and state; THENCE along the Southwesterly boundaries of said Lot 1, Tuloso Road Unit II S21° 30'20"E 175.07 feet to a point for an interior Northerly corner of this tract and 564°09'48"E 175.16 feet to a point for an Easterly corner of this tract, said Easterly corner being in the West right-of-way line of said Tuloso Road. THENCE 500°07'17"E 276.23 feet along said East right-of-way line to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. -2- SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from an after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 24 day of 19 kd .
