HomeMy WebLinkAbout15435 ORD - 03/26/1980• jkh:3-26-80;1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF AGREEMENT WITH THE COASTAL BEND COUNCIL OF GOVERN- MENTS PERTAINING TO CITY'S PARTICIPATION IN AN URBAN RAINFALL RUNOFF STUDY, AS MORE FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; APPROPRIATING OUT OF THE NO. 141 WATER SYSTEM OPERATING FUND, ACTIVITY 5199, THE SUM OF $8,574 AND OUT OF THE NO. 109 WASTEWATER SYSTEM OPERATING FUND, ACTIVITY 5199, THE SUM OF $8,575 FOR THE SAID PARTICIPATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: • SECTION 1. That the City Manager be authorized to execute a Memorandum of Agreement with the Coastal Bend Council of Governments pertain- ing to the City's participation in an urban rainfall runoff study, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated the sum of $17,149, of which amount $8,574 is appropriated out of the No. 141 Water System Operat- ing Fund, Activity 5199, and the sum of $8,575 is out of the No. 109 Wastewater System Operating Fund, Activity 5199, for the City's participation in an urban rainfall runoff study. SECTION 3. The necessity to authorize execution of the aforesaid Memorandum of Agreement and to appropriate the sums necessary to conduct the study creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 26th day of March, 1980. BRUCE By T'E CITY OFPtCQRBM5ACRStrI, TEXAS Assistant Ci/`torney 15435 6l1b0UfI1.1Y1Ek • MEMORANDUM OF AGREEMENT BETWEEN The City of Corpus Christi and The Coastal Bend Council of Governments This Memorandum of Agreement made this day of , 1980 is entered into by the City of Corpus Christi (hereinafter called CITY) and the Coastal Bend Council of Governments (hereinafter called CBCOG) pursuant to financial assistance and planning coordination within the ongoing Corpus Christi areawide waste treatment management studies, funded in part by authorizations of the Federal Water Pollution Control Act Amendments of 1977, Public Law 95-217 under Section 208. I. Purpose The purpose of this agreement is to provide a basis under which the Coastal Bend Council of Governments agrees to cooperate and coordinate with the City of Corpus Christi in the planning and development of areawide water quality studies in return for a cash contribution by the CITY toward the required local match to secure federal grant assistance from the United States Environmental Protection Agency. II. Areas of Agreement This Memorandum of Agreement makes provision for the following specific areas of agreement: 1. The CITY agrees to contribute cash in the amount of SEVENTEEN THOUSAND ONE HUNDRED FORTY-NINE DOLLARS ($17,149) which will be used to secure additional federal grant money for certain laboratory and environmental sampling costs within the ongoing water quality studies. 2. The CITY and the CBCOG agree that the project for which the contributed funds will be used shall be completed on June 30, 1980 or as soon thereafter as the appropriate rainfall/runoff conditions occur which permit the contracted services to be finalized. 3. The CBCOG agrees to provide monthly coordination with the CITY as the project develops and provide information on progress and findings on a regular basis as mutually agreed. 4. The CBCOG agrees to modify its proposed water and sediment sampling schedule and relocate a site (one of three) in the Oso Creek -Oso Bay drainageway to a point in the Nueces River, slightly upstream of the Calallen barrier dam, to assess the impact of runoff from a developing residential area. 5. The CBCOG agrees to return to the CITY any of the $17,149 which is not required to offset expenditures for the authorized contract services of the water quality study. III. Terms This agreement shall become effective immediately after execution of the Memorandum of Agreement and shall remain effective subject_ to the provisions of part I1.2 above. 1110 .
