HomeMy WebLinkAbout15460 ORD - 04/02/1980• vp:4/2/80:1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF ANNIE BLAKE MO GAN HFAD BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 21.23a ACRE TRACT OF LAND OUT OF II OTS 3. 4, S, AND 8, N SITUATED RTUS R. IN OTHE CITYB�OF TCORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT AND "B-4" GENERAt BUSINESS DISTRI T TO "B-4" GFNFRAI RUSTNESS DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application Of Annie Blake Morgan Head for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, April 2, 1980 , at Special . Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter se;ooutbOt �a� � 15460 SECTION 2. That the hereinafter more fully described 21.23+ acre tract of land out of Lots 3, 4, 5, and 6, Artemus R. Roberts Subdivision, situated in the City of Corpus Christi, Nueces County, Texas, be rezoned from "R -1B" One -family Dwelling District and "B-4" General Business District to "B-4" General Business District: TRACT A Lot 1 of Rand Morgan Subdivision No. 1 An 8.390 acre tract our of Lots 3 and 4 of the Artemus R. Roberts Subdivision, in the City of Corpus Christi, Nueces County, Texas.as recorded in Volume 3, Page 41 of the Nueces County Map Records and being more fully described by metes and bounds as follows: BEGINNING: At a point in the westerly line of Rand Morgan Road (also known as State F.M. 2292 and/or County Road 55A), said point being marked by a 5/8" iron rod set for this survey, and is S 0°-06'E,45.45 feet and S 89°-54'W, 40.00 feet from the intersection of the southerly line of Leopard Street (also known as State Highway No.9) and the east,:r1y lin: of the said Artemus R. Roberts Survey; THENCE: S 0°-06'E,along the said westerly line of Rand Morgan Road, passing the common line of said Lots 3 and 4, in all a distance of 590.14 feet to a 5/8" iron rod set as the SE corner of this'survey; THENCE: S 89°-54'W,parallel to the said common line of Lots 3 and 4, a distance of 480.00 feet to a 5/8" iron rod set for the SW corner of this survey; THENCE: N 0°-06'W,parallel to the said westerly line of Rand Morgan Road, a -'.i-tance of 876.42 feet to a 5/8" iron rod set for the northerly most corm- r of this survey, said point being in the southwesterly line of Leopard str+?et; - THENCE: S 65°-15'E,along the slid southwesterly line of Leopard Street, a distance of 464.97 feet to a 5/8" iron rod set as a corner of this survey, said point is also noted in Volume G3i,!'irp.s 313 and 314, of the Nueces County Deed Records as part of the right-of-way for Leopard Street; THENCE: S 32°-41'E, a distance of 107.85 feet to the point of beginning which is noted in "Tract 3" in Volume 713,Page 487 of the Nueces County Deed R -,curds as part of the right-of-way for said F.M. 2292. CONTAINS: 8.390 acres, more or less. TRACT B Lot 2 of Rand Morgan Subdivision No. 1 A 12.607 acre tract out of Lots 3,4,5 and 6 of the Artemus R. Roberts Subdivision, Corpus Christi, Nueces County, Texas, as recorded in Volume 3, Page 41 of the Nueces County Map Records and being more fully described by metes and bounds as follows: At a point in the southwesterly right-of-way line of Leopard Street BEGINNING: (also known as State Highway No.9),said point being the NE corner of this survey and marked by a 5/8" iron rod set for this survey and is N 65°-15'W,573.07 feet from the intersection of the said southwesterly right-of-way line and the easterly line of said Artemus R. Roberts Subdivision; THENCE: S 0°-06'E,parallel to the common line of Lots 4 and 5, and Lots 3 and 6, passing the common line of Lots 3 and 4, in all a distance of 876.92 feet to a 5/8" iron rod set as the SE corner of this ...=vey in Lot 3; THENCE: S 890-54'W, parallel to the common line of Lots 3 and 4, and Lots 5 and 6, passing the common line of Lots 3 and 6, in all a distanze of 547.42 feet to a 5/8" iron rod set as the SW corner of this cn-vey in Lot 6; THENCE: N 00-06'W, passing the common line of Lots 5 and 6 in all a distance of 1]29.94 feet to a 5/8" iron rod set as the NW corner of this survey and - being in the said southwesterly line of Leopard Street; THENCE: S 650-15'E, along the said southwesterly line of Leopard Street, a distance of 603.28 feet to the point of beginning. CONTAINS: 12.607 acres, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the J,4 day of April, 1980.
