HomeMy WebLinkAbout15470 ORD - 04/09/1980AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON 8.80 MORE OR -LESS ACRE TRACT OF LAND OUT OF LUF II, SL(..I1UN 5, IJUHLNIAN LULUtlf LAat . SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" oNE-FAMILY_DWELLING DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN • EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of City of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, April 9, 1930 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. i5470 SECTION 2. That the hereinafter more particularly described 8.80 acre tract, more or less, out of Lot 11, Section 5, Bohemian Colony Lands, situated in the City of Corpus Christi, Nueces County, Texas, be rezoned from "R -1B" One -family Dwelling District to "B-4" General Business District: Being.8.80 acres of land, more or less, out of Lot 11, Section 5, Bohemian Colony Lands, as shown by plat recorded in Nueces County Map Records, Volume A, Page 48 and further described by metes and bounds as follows: BEGINNING at the west corner of Lot 1, Unit 2, Greenwood Terrace, on the north right-of-way line of S. Padre Island Drive, as shown by plat recorded in Nueces County Map Records, Volume 37, Page 28, for the south corner of the tract herein described; THENCE N 64°28'30" W along the north right-of-way line of S. Padre Island Drive a distance of 255 feet more or less, to a corner of said right-of- way line for a corner of this tract; THENCE N 59°52'00" W continuing along the north right-of-way line of South Padre Island Drive, a distance of 637.90 feet more or less, to a point, the intersection of the north right-of-way line of South Padre Island Drive and the southeast right-of-way line of a 100 foot wide drainage easement for the west corner of this tract; THENCE N 28°57'15" E along the southeast right-of-way line of said 100 foot drainage easement a distance of 380 feet, more or less, for the north corner of this tract; THENCE S 61°33'30" E in line with the southwest boundary line of Lot 1, Block 1, Greenwood Terrace Unit 3, as shown on plat recorded in Nueces County Map Records, Volume 39, Page 135, a distance of 875 feet, more or less, for the east corner of this tract; THENCE S 28°57'15" W in line with the common northwest boundary line of Lot 3, Greenwood Terrace Unit 3, and Lot 1, Greenwood Terrace Unit 2, as shown by plat recorded in Nueces County Map Records, Volume 37, Page 28, a distance of 406 feet, more or less, to the point of beginning. . SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency -2- and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 9th day of April 19 80 . Public Service Employment participants employed through Title VI of the Comprehensive Employment and Training Act Amendments of 1978 will be re- cruited and employed consistent with the Rules and Regulations as published in the Federal Register, April 3, 1979, Volume 44, Number 65. The City of Corpus Christi's Title VI grant will be used to balance Title VI non -project and project expenditures as required by CETA regulations. B. Recruitment for position vacancies will be conducted by the City of Corpus Christi's Personnel/CETA Unit through the Texas Employment Commission. Eli- gibility certification of the applicant will be consistent with established policies of the Coastal Bend Consortium. Selection and hiring of applicants certified as eligible for Title VI Program participation will be conducted as specified in the Act and its 78 amendments by the contractor. C. Monitoring of the program will be the responsibility of the contractor and is also subject to monitoring by the City of Corpus Christi as the program agent. D. The City of Corpus Christi's Title VI grant will be used to balance Title VI non -project and project expenditures as required by CETA regulations. B.
