AMENDING THE AGREEMENT BETWEEN THE CITY AND DEVELOPERS
OF WOODLAND CREEK SUBDIVISION, UNIT 3, FOR CITY PARTICI-
PATION IN THE OVERSIZING OF A SANITARY SEWER LINE TO
CHANGE THE NAME OF THE DEVELOPER FROM "WOODLAND CREEK
DEVELOPERS" TO "NUECES DEVELOPMENT COMPANY"; AND DECLAR-
ING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the agreement heretofore entered into between the
City and developers of the oversizing of a sanitary sewer line, be amended so
as to change the name of the developer from "Woodland Creek Developers" to
"Nueces Development Company", as set forth in the Agreement, a substantial
copy of which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize the agreement as aforesaid
at the earliest practicable date creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed fianlly on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared that such emergency and necessity
exist, having requested the suspension of the Charter rule and that this ordi-
nance be passed finally an the date of its introduction and take effect and
be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the I(r day of April, 1980.

COUNTY OF NUECES
WHEREAS, the City of Corpus Christi entered into an Agreement with
"Woodland Creek Developers", developers of the Woodland Creek Subdivision,
Unit III, on August 8, 1979 providing for City participation in the oversized
construction of a sanitary sewer line and this memorandum of agreement is in-
tended to amend and supplement said contract; and
WHEREAS, a total of $7,710.76 has been appropriated by Ordinance No.
15047, passed and approved by the Corpus Christi City Council on August 8, 1979
which represents the City's share of estimated construction costs in said con-
tract; and
WHEREAS, "Woodland Creek Developers" have changed such name to "Nueces
Development Company";
NOW, THEREFORE, for the purpose of correcting the name of the contracting
party to the oversize sewer line construction contract described above, this memor-
andum of agreement is entered into between the City of Corpus Christi and Nueces
Development Company; and, it is further agreed and understood that all other terms
and conditions of said contract shall otherwise remain in full force and effect,
except however, that "Woodland Creek Developers" shall hereafter be known as "Nueces
Development Company".
Executed in duplicate originals this day of April, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
