HomeMy WebLinkAbout15483 ORD - 04/16/1980• . jkh:4-16-80;lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF L & L CONSTRUCTION CO. BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTION OF LOT 1, BLOCK 7, ROBERTSON'S FARM TRACT SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "1-2" LIGHT INDUSTRIAL DISIRICF EXCEPT FOR A DEPTH OF 200 FEET OFF SARATOGA BLVD._, WHICH AREA SHALL BE REZONED "B-3" BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of L & L Construction Co. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on April 16, 1980 Wednesday , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106. as amended, be and the same is hereby amended by making the change hereinafter set out. 1VI1CRDR1MI D 15483 P�� r SECTION 2. That the hereinafter described tract or parcel of land, described as Lot 1, Block 7, Robertson's Farm Tract, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby rezoned from "R -1B" One -Family Dwelling District to "I-2", except that for a depth of 200 feet off Saratoga Boulevard the tract be rezoned to "B-3" Business District: A 7.5575 acre tract, out of Tract 7 of the William Robertson's Ferre Tracts, a map is recorded in Volume 3 at Page 31 of the Nueces County, Texas Map Records, a metes and - bounds description follows: Beginning at a 3/4 inch iron rod found to mark the North— west corner of Tract 7 of the William Robertson's Farm Tracts es. stated above. to mark the Northwest corner of this tract and the place of beginning: THENCE on the North line of Tract 7, the North line of this tract, North 89 degrees 49 minutes. 45 seconds East. 434.64 feet to a 5/8 inch Iron rod set on the Southwest line of Saratoga Blvd. to mark a corner of this tract THENCE on the Southwest line of Saratoga Blvd.. South 61 degrees 13 minutes 15 seconds East, 307.68 feet to the mostEast corner of the tract THENCE South 29 degrees 10 minutes 43 seconds West, 600.02 feet to the most South corner of this tract THE. RICE North 61 degrees 13 minutes 15 seconds West, 466.57 feet to a 5/8 inch iron rod set on the West line '-of Tract 7 to mark a Southwest corner of this tract THENCE on, the West line of Tract 7, the West Line of this tract, North 0 degrees 22 minutes West, 446.09 feet to the place of beginning SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map- of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an 1 • imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, haying requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /jQ day of 19 *.
