HomeMy WebLinkAbout15486 ORD - 04/16/1980•vp:4/16/8O:1t AN OnUINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE QRDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED. UPON APPLICATION OF NOEL BLACKWOOD BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 0.59+ ACRE PORTION OF LOT 11, BANCROFT FARM LOTS SITUATED IN THE CITY OF CORPUS CHRISTI. NUECES COUNTY, TEXAS, FROM "A-1" APARTMENT HOUSE DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Noel Blackwood for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, April 16, 1980 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change here after NI set out. 15486 • SECTION 2. That the hereinafter more fully described 0.59- acre of land, more or less, out of Lot 11, Bancroft Farm Lots, situated in the City of Corpus Christi, Nueces County, Texas, be rezoned from "A-1" Apartment House District to "AB" Professional Office District: BEGINNING at a tack in the pavement on the North boundary line of the Bancroft Farm Lots, as recorded on page 46, Map Book "A", in the office of the County Clerk of Nueces County, the Northeast corner of the West one-half of Lot No. Eleven (11), of said Bancroft Farm Lots, being also the Northeast corner of a 2.14 acre tract conveyed to H.D. Countiss by S.G. Rogers by Deed recorded in Volume 183, Page 26, of the Deed Records of Nueces County, Texas, for the Northeast corner of this survey, whence the Northwest corner of said Lot 11, Bancroft Farm Lots, bears N. 53 deg. 20' W. 358.10 feet; THENCE, S. 29 deg. 43' W. with the East boundary line of said 2.14 acre tract conveyed to H.O. Countiss by S.G. Rogers, at 30.79 feet an iron pipe on the South boundary line of the UpRiver Road, 229.75 feet to an iron pipe for the Southeast corner of this survey; THENCE, N. 53 deg. 20' W., parallel with the North boundary line of said Lot 11, 154.45 feet to an iron pipe in the center of a 20 foot lane for the Southwest corner of this survey; THENCE, N. 33 deg. 16' E., with center line of said 20 foot lane and the West boundary line of said 2.14 acre tract, at 197.85 feet, an iron pipe on the South boundary line of said UpRiver Road; 228.46 feet to a tack in pavement, the North- west corner of said 2.14 acre tract, for the Northwest corner of this survey; THENCE, with said North boundary line of Lot 11, S. 53 deg. 20' E. 142.11 feet, more or less, to the PLACE OF BEGINNING. Subject to that portion of said property occupied on the North by the right-of-way of UpRiver Road, and all that portion thereof embraced in Werner Lane on the West side of said property. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full. force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an • imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its IT ACCORDINGLY SO ORDAINED, this the k day of 19, passage, ATTEST: y Secretary WDAY OF J.
