HomeMy WebLinkAbout15491 ORD - 04/23/1980AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AI AGREEMENT WITH THE CORPUS CHRISTI INDEPENDENT SCHOOL DISTRICT TO PROVIDE FOR REIMBURSEMENT TO THE CITY BY THE DISTRICT OF COST OF WIDENING OF SHERIDAN DRIVE, FROM SOUTH ALAMEDA STREET TO HARRY ALONGSIDE WINDSOR PARK SCHOOL, EXCEPT FOR A PORTION OF SHERIDAN DRIVE ADJACENT TO CITY PARK (WINDSOR PARK), AND DEVON DRIVE, FROM GOLLIHAR ROAD TO ALEXANDER STREET ALONGSIDE FANNIN SCHOOL; PROVIDING FOR ENGINEERING, STORM SEWER AND LABORATORY COSTS T,0 BE PAID BY THE CITY, A SUB- STANTIAL COPY OF WHICH AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute an agree- ment with the Corpus Christi Independent School District to provide for reim- bursement to the City by the District of cost of widening of Sheridan Drive, from South Alameda Street to Harry alongside Windsor Park School, except for that portion of Sheridan Drive adjacent to the City park (Windsor Park), which will be paid by the City, and Devon Drive, from Gollihar Road to Alexander Street alongside Fannin School, and providing that engineering, storm sewer and laboratory costs shall be paid by the City, all as more fully set forth in the agreement, a substantial copy of which is attached hereto, marked Exhibit "A", and made a part hereof. SECTION 2. The necessity to authorize execution of the aforesaid agreement at the earliest practicable date in order that the street improve- ments may be commenced without delay creates a public emergency and an imper- ative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and • necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage. BRUCE AYCOCK, CITY ATTORNEY By: 0( ,/ i Assistant Cuff orney 15491 MAYOR THE CI OF CORPUS CHRISTI, TEXAS MICROFILMED VG 29194 AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES II This Agreement is authorized by Ordinance No. and is entered into between the City of Corpus Christi, Texas, a municipal Corporation and Body Politic operating under the Home Rule Statute, hereinafter called "City",and the Corpus Christi Independent School District, being referred to as "School District", and pertains to the joint participation in the widening of Sheridan Drive and Devon Drive alongside Windsor Park School and Fannin School in the City of Corpus Christi and within the Corpus Christi Independent School District. NOW, THEREFORE, the City and the School District agree as follows: 1. The City will advertise for bids and cause to be constructed the widening of Sheridan Drive by approximately ten (10) feet from a point near South Alameda Street to Harry Street (north side) alongside Windsor Park School and the widening of Devon Drive from Gollihar Road to Alexander Street (north side) alongside Fannin School. 2. The School District will pay all cost of the widening of both Sheridan Drive and Devon Drive as described, except that the City will pay the cost of widening Sheridan Drive alongside the City Park (Windsor Park) and will pay the engineering, storm sewer and testing laboratory costs for the total project. The estimate for direct construction cost for the School District is $45,000.00. Invoicing to the School District will be based on actual low bidder prices, and not estimated costs. 3. All work will be in accordance with plans and specifications prepared by the City Department of Engineering and Physical Development, as shown on plans on file in said City Department, bearing drawing number STR 588. 4. Upon completion of the required widening work on Sheridan Drive and Devon Drive, and after formal acceptance of the project by the City, the School District will pay the City, upon proper invoicing, the School District's cost or share of the street widening project as outlined in Item 2 of this Agreement within thirty (30) .days.of the invoice. date. 5. The City hereby agrees to schedule the project such that the widening of both described streets will be completed, barring inclement weather by September 1, 1980. 6. This Agreement shall be executed in duplicate, both of which shall be considered one instrument. When both of the duplicates have been executed by the City, and at least one duplicate has been executed by the School District, this Agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors and assigns.
