TEXAS:
AN ORDINANCE
FINDING THAT THE DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT PROJECT NO. TX59-0022-003/115-35192-PM-L8,
SAMUEL PLACE, CORPUS CHRISTI, TEXAS, PROVIDING FOR THE
NEW CONSTRUCTION OF SUBSIDIZED HOUSING UNITS UNDER THE
SECTION 8 HOUSING ASSISTANCE PAYMENTS PROGRAM TOGETHER
WITH A PLAT OF BLOCK "C", CARROLLTON ANNEX #3, IN THE
CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, DATED
AND FILED FOR RECORD ON MARCH 12, 1980, SATISFIES THE
CONDITIONS OF REVERSION DESCRIBED IN ORDINANCES NOS.
12171, 12385, 12386, 13566 AND 13567, PROVIDED THAT
CONSTRUCTION IS COMPLETED AND OCCUPANCY UNDER THE
SECTION 8 PROGRAM IS CONTINUING FOR 20 YEARS SUBJECT
TO CONTINUED NATIONAL AUTHORIZATION OF THE SECTION 8
PROGRAM; AND FURTHER FINDING THAT THE CONDITIONS OF
REVERSION DESCRIBED IN THE ABOVEMENTIONED ORDINANCES
ARE AND SHOULD BE PERMANENTLY WAIVED IN THE EVENT THAT
THE PROPERTY IN QUESTION BE ACQUIRED BY WHATEVER MEANS
POSSIBLE BY THE DEPARTMENT OF HOUSING AND URBAN DEVELOP-
MENT; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Council finds that the Department of
Housing and Urban Development Project No. TX59-0022-003/115-35192-PM-L8,
Samuel Place, Corpus Christi, Texas, providing for the new construction of
subsidized housing units under the Section 8 Housing Assistance Payments
Program together with a plat of Block "C", Carrollton Annex #3, in the City
of Corpus Christi, Nueces County, Texas, dated and filed for record on March 12,
1980, satisfies the conditions of reversion described in Ordinances Nos. 12171,
12385, 12386, 13566 and 13567, provided that construction is completed and
occupancy under the Section 8 Program is continuing for 20 years subject to
continued national authorization of the Section 8 Program.
SECTION 2. That the City Council further finds that the conditions
of reversion described in the abovementioned ordinances are and should be
permanently waived in the event that the property in question be acquired by
whatever means possible by the Department of Housing and Urban Development.
SECTION 3. The necessity to declare the findings of the City
Council as hereinabove set forth at the earliest practicable date creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor
having declared that such emergency and necessity exist, and having requested
the 5opension of the Charter rule and that this ordinance be passed finally

on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the
23 day of April, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
