HomeMy WebLinkAbout15514 ORD - 04/30/1980• jkh:4-28-80;lst r AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE QRDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF TED M. ANDERSON BY - AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 7.40 -ACRE TRACT OF LAND OUT OF KIBBY INDUSTRIAL SUBDIVISION , SITUATED IN THE CITY aCORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO"A-L" APARIMLNI HUUSt UISIKII.I ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. T WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Ted M Anderson for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday April 30, 1980 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 15514 ROIL 838 !CE36t6 THE STATE OF TEXAS 1 COUNTY OF NUECES 179221 NOTICE DEED RECORDS VOL 1739PAGE 186 That the City of Corpus Christi, Texas, acting by and through its duly elected and constituted City Council, on the 7th day of May , 19 80 , by Ordinance No. 15515 determined the necessity for and ordered the improvement of a portion of the following street(s): (1) Marguerite Street, from South Port Avenue to 19th Street; (2) Bluntzer and 20th Streets, from Mary Street to Agnes Street; 3 21st Street, from Ruth Street to Agnes Street; 4 Meuly Avenue, from Ruth Street to Mary Street; 5 25th Street, from Morgan Avenue to Mary Street; 6) 22nd and 23rd Streets, from Buford Street to Mary Street, within the City of Corpus Christi, Nueces County, Texas, said street(s), within the limits above described, to be improved by raising, grading, filling, widening, paving, repaving or repairing same and by the construc- tion, reconstruction, repairing or realigning of concrete sidewalks, curbs, gutters, and driveways where the Director of Engineering and Physical Development determines adequate sidewalks, curbs, gutters and driveways are not now installed on proper, grade and line, and by the construction of such storm sewers and drains, if any, together with all other necessary incidentals and appurtenances, all as deemed adequate by the Director of Engineering and Physical Development and as provided for in the plans and specifications for such improvements thereof as prepared by said Director of Engineering and Physical Development. That Ordinance No. 15515 , passed by the City Council on the 7th day of May , 1980 , provided that the amounts -`" payabi e-liy-the real and true owners of said abutting property shall be paid and become payable in one of the following methods at the option of the property owner: 1. A11 in cash within thirty (30) days after completion and acceptance by the City; or, 2. Payment in monthly installments not to exceed sixty (60) in number, the first of which shall be payable within thirty (30) days from the completion of said improvements and. their AUG 2 91000 • RGLL638 VE3607 - . acceptance by the City of Corpus Christi, and one installment each month thereafter until paid, together with interest thereon at the rate of five and one-quarter (5-1/4%) percent, with the provision that any of said installments may be paid at any time before maturity by the payment of the principal and accrued interest thereon. The total number of monthly installments on owner -occupied property may be extended be- yond sixty in 'number so that, at the owner's request, the total monthly payments will not exceed Ten Dollars ($10.00) per month. Any property owner against whom and against whose property an assessment has been levied may pay the whole assessment chargeable to him without interest within thirty (30) days after the acceptance and completion of said improve- ments. And said ordinance further provided that the amounts payable by the abutting property, and the real and true owners thereof, to be assessed against said property and said true owners thereof shall constitute a first and prior lien on such abutting property and a personal liability of the real 'Th, -'and true owners thereof. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall beread at three several meetings of the City Council, and the Mayor having declared that such emergency -2- and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 30th day of April 1980 .
