PERMISSION TO CONTINUE TO OPERATE AFTER MAY 17, 1980 ON A WEEK -TO -WEEK BASIS DURING CON- SIDERATION OF A FRANCHISE RENEWAL; RESERVING ALL RIGHTS OF THE CITY; AND DECLARING AN EMERGENCY. WHEREAS, the term of the franchise granted to Athena Cablevision of Corpus Christi, Inc. (hereinafter referred to as "Athena") to operate a community antenna television system within the City of Corpus Christi expired on November 17, 1979; and WHEREAS, on October 17, 1979 the City Council notified Athena that its franchise would expire on November 17, 1979 and granted permission for that company to operate after November 17, 1979 on a week -to -week basis at the pleasure of the City Council, but not to extend for more than six months from November 17, 1979; and WHEREAS, by allowing Athena to continue operating beyond the term of its franchise, the City did not waive any rights which it would otherwise have, including, but not limited to, the right to deny Athena a franchise renewal, or to prohibit Athena from operating without a franchise, or to acquire all or a portion of Athena's system; and WHEREAS, it is the desire of the City Council that cable television services to the citizens of Corpus Christi not be interrupted: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. After May 17, 1980, pending the City's submission of a proposed revised franchise to Athena and pending Athena's acceptance or rejec- tion of such proposed franchise, Athena is hereby authorized to continue operating its system according to the same conditions as provided in expired franchise ordinance 012268) and rate ordinance 013193). By allowing Athena to continue operating beyond the term of its franchise, the City does not waive any rights whatsoever. SECTION 2. The necessity to notify Athena Cablevision of this action at the earliest possible date creates a public emergency and an imperative AUG 291980 15541 MICROFILM% • public necessity requiring the suspension of the Charter rule that no ordi- nance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested that the Charter rule be suspended and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and of ect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the / day of May, 1980.
