HomeMy WebLinkAbout15548 ORD - 05/21/19804 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH CENTRAL POWER AND LIGHT COMPANY FOR SHARING IN THE COSTS OF INSTALLATION OF ELECTRIC AND GAS FACILITIES TO SERVE THE PEOPLES STREET T -HEAD, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, IN SUBSTANTIALLY THE FORM ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: • SECTION 1. That the City Manager be authorized to execute an agreement with Central Power and Light Company for sharing in the costs of installation of electric and gas facilities to serve the Peoples Street T -Head, all as more fully set forth in the agreement, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to authorize execution of the aforesaid agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 2/ day of May, 1980: ATTEST: qty Secretary APPROVED: DAY OF MAY, 1980: J. BRUCE AYCOCK, CITY ATTORNEY THE Y OF CORPUS CHRISTI, TEXAS 4C 0141 !t/) 15548 • AGREEMENT FOR INSTALLATION OF FACILITIES WHEREAS, the Utilities Department of the City of Corpus Christi, Texas (City) desires to install certain underground gas and water distribution facilities along a portion of Peoples Street in said City; WHEREAS, Central Power and Light Company (CPL) desires to install certain underground electric distribution facilities in approximately the same locations; WHEREAS, the parties hereto desire to cooperate in the installation of said facilities and thereby lower each party's cost of installing said facilities; NOW, THEREFORE, in consideration of the premises and of the mutual covenants contained herein, the parties hereto agree as follows: 1. The parties agree to cooperate in the construction and installation of facilities as specified in Exhibit A, attached hereto and incorporated herein for all purposes, and all documents referenced therein. The parties agree that Naismith Engineers, Inc., shall let and open bids. The parties agree that the construction contract specified in Exhibit A shall be let to the bidder bidding the lowest overall price for the project specified in Exhibit A, pro- vided that the parties reserve the right to either party to reject all bids or to negotiate with the successful bidder for a lower total price. 2. City agrees, at City's sole expense, to remove the existing asphalt and/or concrete pavement and install City water line from approximately Sta. 4+80 to approximately 10+62 prior to the commencement of any work specified in Exhibit A. The removal of the asphalt and/or concrete pavement shall be of sufficient width to permit installation of the facilities as contemplated on Exhibit A. 3.
