AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH THE CORPUS CHRISTI MUSICIANS' ASSOCIATION, INC.
LOCAL NO. 644, FOR TWELVE CONCERT PERFORMANCES AT A
COMPENSATION OF $542 PER PERFORMANCE, NOT TO EXCEED
$6,500 TOTAL, FOR THE PURPOSE OF PROVIDING THE CITIZENS
OF CORPUS CHRISTI WITH MUSICAL PERFORMANCES FOR THEIR
BENEFIT AND ENJOYMENT, A SUBSTANTIAL COPY OF WHICH
AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute an
agreement with the Corpus Christi Musicians' Association, Inc. Local No. 644,
for twelve concert performances at a compensation of $542 per performance,
not to exceed $6,500 total, for the purpose of providing the citizens of
Corpus Christi with musical performances for their benefit and enjoyment, all
as more fully set forth in the agreement, a substantial copy of which is
attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the afore-
said agreement at the earliest practicable date creates a public emergency
and an imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared that such
emergency and necessity exist, having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage, IT
IS ACCORDINGLY SO ORDAINED, this the 2/ day of May, 1980.

AGREEMENT
KNOW ALL MEN BY THESE PRESENTS:

That this Agreement, made and entered into on this the day of
, 1980, by and between the City of Corpus Christi, a muni-
cipal corporation, hereinafter referred to as "CITY", and the Corpus Christi Musi-
cians' Association, Inc., Local No. 644, A.F. of M., of Nueces County, Texas_, here-
inafter called "UNION":
WITNESSETH!
The Union has agreed to provide twelve (12) concerts to be held in Cole
Park Amphitheater on the following dates in 1980:
June 1, 8, i5, 22, and 29; July 6, 13, 20, and 27; August 3 and 10;
and one performance at the Texas Jazz Festival on July 6, 1980, for the benefit and
enjoyment of the citizens of Corpus Christi.
In consideration of providing music for these performances, the City
agrees to pay the Union the sum of Six Thousand Five Hundred ($6500) Dollars. Pay-
ment up to the agreed sum is to be made on presentation of requests for payment sub-
mitted at the end of each month at the rate of Five Hundred Forty -Two ($542) Dollars
per performance held during that month.
In addition to the concert fimding, the City further agrees to provide use
of facilities for these performances through the Park and Recreation Department.
The City further agrees to provide the transportation of music stands and
musical instruments before and after each outdoor concert. Transportation will be
between Del Mar College and the site of the twelve (12) concerts at Cole Park.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
