HomeMy WebLinkAbout15553 ORD - 05/21/1980• jkh:5-19-80;1st, AN ORDINANCE AUTHORIZING THE FILING OF A GRANT APPLICATION ON BEHALF OF THE CITY OF CORPUS CHRISTI FOR FEDERAL FINANCIAL ASSISTANCE UNDER THE FEDERAL WATER POLLUTION CONTROL ACT AMENDMENTS OF 1972, PUBLIC LAW 92-500, AND THE RULES AND REGULATIONS PURSUANT THERETO IN CONNECTION WITH THE ALLISON WASTEWATER TREATMENT PLANT IMPROVEMENTS (STEP 1), EPA NO. C-48-1457-01, DESIGNATING THE CITY MANAGER, R. MARVIN TOWNSEND, OR HIS SUCCESSOR, AS THE AUTHORIZED REPRESENTATIVE AND SIGNATORY AGENT;AND FURTHER AUTHORIZING AND DIRECTING THE CITY MANAGER TO MAKE APPLICATION FOR GRANT ASSISTANCE UNDER PUBLIC LAW 92-500 AND THE RULES AND REGULATIONS PURSUANT THERETO, SPECIFICALLY 40 CFR 30.315-1 (1975), AND TO SIGN THE ACCEPTANCE OF THE GRANT ASSISTANCE, WHEN MADE, AND ANY OTHER DOCUMENTS REQUIRED TO COMPLETE THE PROJECT ON BEHALF OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: / • SECTION 1. That authorization is hereby given to filing of a grant application on behalf of the City of Corpus Christi for Federal Financial Assistance under the Federal Water Pollution Control Act Amendments of 1972, Public Law 92-500, and the rules and regulations pursuant thereto in connection with the Allison Wastewater Treatment Plant Improvements (Step 1), EPA No. C-48-1457-01, and designating the City Manager, R. Marvin Townsend, or his successor, as the authorized representative and signatory agent. SECTION 2. That the City Manager be authorized and directed to make application for grant assistance under Public Law 92-500 and the rules and regulations pursuant thereto, specifically 40 CFR 30.315-1 (1975), and to sign the acceptance of the grant assistance, when made, and any other documents required to complete the project on behalf of the City of Corpus Christi. SECTION 3. The necessity to authorize filing of grant application in connection with the Allison Wastewater Treatment Plant Improvements (Step 1), to make application for grant assistance and to sign the acceptance of the grant assistance, when made, all as hereinabove set forth, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall 15553 be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,this the .2/ day of May, 1980.
